Bleach and Soul Society arc are pretty much about what the different characters are in terms of personality according to D&D's alignment system (lawful good etc.). Some people are very lawful, so that even actions that don't really seem as good things to do, are something they think should still be done. Others, like Ichigo, don't really care about rules and laws, only about what is right in terms of good or wrong. Respecting the law and order comes second to him.

Soul society got some sort of a court house (central 46 were hitsugaya is heading ), if they issue an execution order, the soldier (13 squad) have to follow their orders no matter what, so the 13 captains justice in that case doesn't matter. Think about it in today's society, if the court issue an order it needs to be followed other wise it's only chaos. Also the lame ass sword of the 4th captain is not lame it heals people for now ;)

Two characters you guys are SEVERELY underestimating: Unohana Retsu, the 4th division captain, and Yamamoto the head captain. Also, this calls for a few clarifications. No worries, no spoilers. Shunsui and Ukitake aren't first gen captains. They are are first gen ACAMDEMY students to have become captains. Secondly, Yama didn't become Head Captain recently to fulfill some long drawn plan. He CREATED soul society and was the first ever head captain over a 1000 years ago. Unohana IS a first generation captain. She was a captain of one of the divisions of the first set of captains with Yama. I can't say much here, cos spoilers, but she is one of the most powerful captains, easy.
