Exactly, also that's not how it works. There's this thing called overarching regulation, especially when it comes to foods and drinks. Someone should tell them that the "Terms and conditions" of their products aren't everything, and one can still be sued if their product is wildly harmful. Or, to use another example: you can't kill someone just because they wanted you to do it, and you two agreed on a specific method. To later being forced to go into court and claim something like _"well, he _*_wanted_*_ me to do it and we had a mutual deal!"_ is ridiculous.

TLDR at the end, but long story short, no, that's an incredibly dishonest way of describing arbitrations and arbitration clauses. people know very little about what arbitrarion actually is. Arbitration is literally just "hey, before you waste both our and your time and money with a lawsuit, let's take the cheap route first". Arbitration is basically just getting a third party mediator (or, literally, "arbitrator") and having them act as a judge, rather than spending months or years and god knows how much money going through the court system. Additionally, many arbitration agreements aren't even fully binding. You can be bound to go through arbitration first, but that doesn't necessarily imply that you're bound to the arbitrator's decision. These non-binding arbitration agreements are quite literally as simple as "look, can we just take the cheap and fast option first and then if you're *_still_* pissed we can take the expensive and tedious option?". Now, granted I'm not a lawyer and I certainly don't specialize in arbitrations, (I'm just of the mind that "yeah, maybe it's a good idea I know how the law works, y'know just in case") but I checked their terms and they rely on the American Arbitration Association for managing arbitrations and _they_ have a document (or section/excerpt from a document, can't tell) titled "Challenging an Arbitration Award" which says "If a party to an arbitration wishes to challenge an award for any reason, they need to make an application to a court except in the rare case where the parties’ agreement provides for some type of appellate proceeding within the arbitration." which implies that, even in their rules which, full admission, *_do_* appear to be binding, you can still challenge their decision in court, meaning even binding arbitration agreements aren't 'binding' as much as they are strong suggestions. To be clear, I'm not defending this company or anything, but waaay too many people are drinking the Rossman-esque koolaid and blindly calling stuff like arbitrations anti-consumer when, no, not really. A biased arbitrator *_can_* lead to bad results, (although their consequences are far more limited in-scope than what havoc a biased judge can wreak) but that's specifically something that you can challenge in court if you think that's happening. And, bear in mind, an arbitration organization getting dinged for biased arbitrations would go about as well as an auditing company that gets outed as covering up mistakes. They are literally being paid to be unbiased third parties, if people discover they've been biased then *_eeeeeeveryone_* else will avoid them like the plague because that kinda defeats the entire point and immediately draws every ruling they make into question. It's not impossible that it'd happen, but holy shit it's bad business. What happened is the government got more and more and more and more and more bloated, eventually companies realized "hey, the government and our lawyers are fucking us with chainsaws with these fees even when the disputes are incredibly minor, can we just make this go smoother and stop relying on the government to do this?", and so arbitrations became more popular because they're faster, cheaper, and easier all-round. Granted, you do see people saying "oh but arbitrations are way less likely to give payouts, and when they do they're far smaller!" but there are just so many gotchas there it's really hard to say that's worth much. For one, it's a cheaper, easier process with less overhead, it could just be that way more people are doing it for small/invalid reasons. (akin to small-claims court) For two, are those payouts including shit like lawyers fees? If so, well then I might be able to tell you why the payouts are so much smaller. So many completely different things are being lumped together and compared that it's just kinda a non-starter to try to compare them. Is this a cop out? yeah, sure, sorta, but it's also just the truth. There isn't any easy way to compare these, and everyone who tries has a motive, so without painstakingly going over every single study or report yourself to try to analyze their methodology (if they even honestly and fully include it all anyway which, yeah, good luck) it's impossible to find any meaningful comparison. Plain and simple, the government did what governments do and got too overpaid and bloated to do it's job correctly because there was no pressure for them to do better, so the private sector took over and people started settling disputes without them. That doesn't mean "THEM BIG FAT CAT CAPITALIST PIGS ARE TRYIN' TO RIG THE GAME AND TAKE ADVANTAGE OF THE PROLETARIA-", no, *_you_* are a part of the private sector too, *_everyone_* is. It means people saw "this thing we're relying on the government for is expensive and bad, let's make it not-that by doing it ourselves". The courts are still there if you have a justification for challenging an arbitration, these clauses are just there because everyone defaults to "let's sue 'em" and no-one actually thinks about arbitrations first. I'm not saying that they're pro-individual, I'm just saying that they're not anti-individual. They're just a cheap way to settle disputes, that's it. ( cheap for both the companies *_AND YOU_* )

As a kid when Lunchables first came about, I always thought that they were gross. More plastic than lunch, and soggy flavorless shit. If you can't tell turkey from ham, it's shit.
