Surely at this point it would have been cheaper for NR to purchase the land adjacent to yours and build an access road than to pay all these legal fees? I see in the comments that they appear to have another agenda besides the access, which would explain why they have not taken the cheaper option.

Don't put yourself down, it's a fair question! This train is going to collect fuel that is from Vulcan Naval Base, the fuel is meant to be from a nuclear submarine. Sometimes the train goes past with no armed guards on carriages and collects the nuclear waste from Dounreay power plant, there was a nuclear disaster there in 1977 I think it was.

Haha, you're confused and causing problems where none exist. You are not within 2.5 nautical miles of a licensed aerodrome, therefore the mast can be 150m tall before it needs a red light. it doesn't matter that you are in a military low fly zone, that is not covered by the regulations. Why don't you just get on with enjoying the countryside and stop bothering EE about the angle of their aerials and the lack of red lights that don't even need to be there in the first place, you'll find it less stressful when you do. "For obstacles that are not in the vicinity of a licensed aerodrome, Article 222 of the Air Navigation Order (ANO) 2016 (as amended) requires that lighting only becomes legally mandated for structures of a height of 150 metres (m) / 492.1 feet (ft) Above Ground Level or more."

Perhaps you should tell that to EE / BT and the solicitor as they have a different opinion to you. EE / BT's solicitor told the Court that the aircraft warning lights were 'vital' because the mast is located in a military low flying zone. Also, for your information Altnabreac is a Tactical Training Area and MOD military aircraft can fly as low as 100ft in TTAs. The MOD have NOTAMS in place warning about this mast as a hazard. Seems you are the one who is confused. The NOTAM would not be in place if we had not reported this hazard. Furthermore, you seem to be overlooking the main issue we've brought to light about EE / BT and their solicitor which is that EE's solicitor falsely told the Court that it was our fault the warning lights were not working. That's untrue. They have never been connected. That's the crux of the issue - solicitor's giving false information to a Court of Law. We thoroughly enjoy this beautiful land and we will continue to enjoy it. What we will not tolerate is big corporations using their solicitor to falsely accuse us in a Court of Law. I guess that sort of behaviour is okay with you.

You're confused more like! This area is 1 of 3 TTA (Tactical Training Area) in the U.K. where military aircraft can fly as low as 100ft. Bit more to it rather than just typing 'Mast' into Google and copying and pasting it in comments, with a little 'Haha' trying to look clever.

I've only just caught up with your awful situation. You're doing everything you can, within the law, so keep going. Boundary disputes can be nasty. I had one years ago, nothing like your issue, but over a fence being 8 inches too far onto my land when I bought my house. It took over a year to sort out, and thousands of pounds, and in the end was completely pointless, just my dickhead of a neighbour being, well, a dickhead. Don't let the bastards grind you down, you are clever, intelligent people, and the right outcome will be yours in the end.

We are right: We own the driveway. We are right: The officers had no jurisdiction to deal with our land dispute and abused their powers attending our property 'advising' us we didn't own our driveway and responding to a false complaint from NR that we were 'trespassing' on our own driveway.

I have no idea about the situation, I would assume they have rights of access over your land, I would also assume even if that is not on your title it is probably unavoidable that they can claim rights of access by being a proxy/government agency. Worst case they could always get rights of access by compulsory purchase. And I would assume the transport police are there to make sure that they can carry out their job safely and without interference. I’m not saying they are nice, the situation is logical or ideal, or that they carried it out in the correct way. But fundamentally, it’s a national agency - they can do what they want because they are doing it on ‘our’ behalf.

@@ciarantaylor367 Exactly, you 'have no idea about the situation' because you've obviously not watched all of our videos where we show the surveyor confirming we own the entire driveway. Furthermore, NR are not claiming to have 'access rights' over own land, they're falsely claiming to own it. Your assumptions don't cut it so what is the point of commenting based on 'assumption. I will clarify for you one more time: we own the land, NR do not. If NR want to access and use our land, they require our permission like they got permission from the forestry company to use their private tracks to get to Altnabreac and to use their land for other reasons. That's the position. It's really a very simple solution but unfortunately NR want to abuse the law and try and take our land from us rather than doing things the right way. As a result, the station remains closed to the public which is solely the fault of NR although they've tried their best to place the blame on us. You may support NR abusing the law to take people's land but we do not and NR will not take any of our land, I assure you of that.

@@ciarantaylor367 NR had no right to be on our land and as it is not railway property but private land, BTP had no authority in the situation. The BTP do not adjudicate on land disputes. The BTP should have refused to attend but instead acted with total bias and assisted NR in gaining unlawful access onto our land. NR and BTP are an utter disgrace.

I live in So Cal and when I got the survey done on my property I made a request to have a concrete monument, not a wooden stake because the crazy neighbor would have taken it out. She wanted 10 feet of my property, took me 1 year to finally get her off.
