*EE's Solicitor said this about us in the court of session:* "On 22nd February 2024, the Pursuer's contractors attempted to refuel the generator at the Mast Site. They were unable to do so. The Second Defender was present at the time and asserted that the Pursuer did not have access rights over the level crossing. As a consequence of the generator not being refuelled, the Mast Site ceased to be operational. The telecommunications service was disrupted. The aircraft warning lights on the top of the telecommunications mast ceased to function and the Military of Defence required to be informed. The Mast Site is located within an RAF training and low flying area. As such, it is vital that the aircraft warning lights on the telecommunications mast remain operable."

It's the MOD that 'give a hoot' or at least should do given that it's mandatory for aircraft warning lights to be working on a mast situated in a TTA when military aircraft can fly as low as 100ft. Also, EE have falsely blamed us for the lights not working but we've proved they were not even connected - the mast has been there 12 months! Shame you miss the obvious corruption at play here.

EE contractor said it was 51 metres. It's a low flying area at Altnabreac and EE / BT have a aircraft warning light on the mast OBVIOUSLY because it is required legally. Indeed, EE claimed it is VITAL for the warning light to be working and they had to inform the MOD apparently because it was not 'operable,' I.E. lit up. Will check out the legislation because I've read the CAA rules and they say otherwise to what you're saying and will check the rules for low flying areas for training military aircraft.

RAF fighter aircraft train to fly a lot lower than 500 foot in order to avoid enemy radar, as at 500 foot you're going to be shot down. During the 1980s they often flew Tornados as low as 150-200 foot, even down in Kent. I'm not sure what the regs are today though.

The law needs to change in this country so Companies stop being fined, but its the individual decision makers, the ones who get the big salaries and even bigger bonuses, are prosecuted for their choices. You may have edited it out but I would have thought you would introduce yourself first before asking questions and filming the sub sub sub workers. Anyone would be suspicious about the approach you made. Also you said the mast is on your land you should be entitled to notification that workers will be on site and should provide you with a method statement and risk assessment. Also the workers didn't set up a work area with appropriate warning signs. Good luck and keep sticking up for your rights.

The camera is there to protect the cabin and the VERY valuable lithium ion batteries that are within the cabin to provide power and maintain mobile coverage from the mast (for public safety) if the mains power (or in this case generator) go down. Rural sites like that are regularly broken into so that the batteries and copper feeder cables can be stolen. Nothing more.

If that camera captures anything beyond the boundary of the compound and is recording personal data of members of the public, then there should be CCTV warning signs visible with contact information for the data controller which is a legal requirement.

Hi, well I went up to see if the light was on the evening that they left, but it wasn't. I was told when I was up there (on the day of this video) that the light/beacon was never connected to the "Photocell" and that it could not be connected without "Powering-Down". They haven't been back since and it's still off as far as I know, although I didn't go up last night.

The camera is just to monitor the site and ladder. I wouldn't be concerned about, they need security purely because they are hit regularly by thieves wanting copper. Just be happy that you now know the light has never worked and the knowledge that this can be used against them in court.

I suggest you tell EE / BT and their solicitor then because they claim the light is VITAL and they apparently had to inform the MOD in February this year because it was 'inoperable.' You think EE / BT and their solicitor would know if no light was required because if it was not required, why install it and why try and connect it to get it working two days after we published that it is not working! So either you're wrong or EE / BT and their solicitor is wrong about needing a warning light for aircraft on their mast. Either way, they still falsely claimed to the Court the warning light was not working because of us and we have proved by the mouth of their own contractor that it has NEVER EVEN been connected.

Not sure where you get the low flying figures from. From my days as a flight instructor, I recall the relevant figures as being 500' - but that is distance from any vehicle, vessel, person or structure, unless taking off or landing obviously. It is not a minimum height limit, rather it is a distance from. An aircraft could fly at treetop height provided it remains at least 500' away from, as above.

I think GDPR would cover the camera if it records personal data of members of the public. If that is the case, there should be clear signage and contact information for MOPs to contact the data controller to obtain footage of their personal data held by EE / EE's security company. Will find out.

I.e. as a company if your request to delete this data, we have to. However if you stand outside the front of our building for example and our CCTV records you, that's not covered under GDPR, you have no right to request it deleted etc. Same as you can film the police etc. The camera footage does not apply. Sorry, not trying to be an ass! I'm just trying to give guidance.

From what I recall, he explained that because his camera overlooked beyond the boundaries of his property, any images captured of neighbours or members of public not within the boundaries of his property would mean that he would be considered a data controller and subject to GDPR.
