In one of my first college music classes I had a professor tell me that nobody in the future will ever create 100% original music unless they have never heard music before. We take influences from everywhere and make it our own. Any musician knows this without being taught this but I’m glad my teacher pushed that point early in my studies.

All Amy’s stand up is original and some of the best comedians including Dave attell still stand by her being funny. Carlos mencia on the other hand is shunned from the comedy world because of plagiarism

I’ve heard that in Australia the side that wins the court case has the losing side pay for their legal bills. This dramatically cuts down on the amount of legal cases and suing culture. I think we should adopt that here in the US, or something similar to discourage all of these frivolous lawsuits!

Not a big Ed Sheeran fan but in this case, he is 100% correct. ANY rock or pop song is based on SOMETHING that came before it. As Chuck Berry used to say, "there is nothing new under the sun". Every songwriter "borrows" just a little bit from songs of the past. As long as it is not a direct lift (as in "Surfin USA" vs "Sweet Little Sixteen"), there is a LOT of leeway in what you can use that has already been used by other writers.

It’s always the Gaye family that wants to sue ANYBODY that has anything similar to what Marvin made. The 2 songs doesn’t even sound alike…so what the drums and bass are similar, everything else is unique. The Gaye family has created so many enemies in the industry, I wouldn’t be surprised if Marvin Gaye’s music disappears.

When it comes down to it and the way I remember copyright law, an infringement would take place if you have a sequence of 7 notes with the same intervals between them but it also must have the same exact melodic rhythm.This is actually rare but it has indeed happened many times... In terms of the chords, you can't copyright chord progressions. This is why this is so controversial because most people judge it by what they hear only.. but that's not how it works in copyright law. The law it's technical and specific as to what constitutes infringement but most don't know the definitions of it. An interval (example): the first note in a sequence is C and the 2nd is E.. that's a major 3rd interval meaning that there are 2 whole steps between C and E. If the 3rd note would be an F that would be a half-step interval between E and F (one half-step or "semitone") The melodic rhythm refers to whether the duration of the notes is also the same. A quarter note followed by two 8th notes in a 4/4 bar measure for example... These things need to happen exactly when comparing songs to confirm a case of copyright infringement.

Thank goodness. Pop songs are usually simple chord progressions and are often very similar. I know we hear other songs in them later and may even pay tribute by pulling them in when doing live performances. That does not mean we ever copied them. These progressions are in our unconscious tool chest. This happens constantly. This is an example of mostly non-writers trying to get money off of rich musicians. Still mad at Tom Petty for doing this. And what about the tradition of the "Folk Process?" This is where people did get direct inspiration off of each other's music, and it was a rich, historical tradition. People are just too money hungry and egocentric these days, thinking their art is so uniquely important.

What happened is a bunch of investment companies bought "partial rights" to songs and artists repositories. Wherever possible, they are trying to make money off that "partial ownership" by suing any artist who creates or created music that even closely resembles that of which they bought. Because in America you can sue anyone for just about anything, including potential "copyright infringement", it is worth it for some of these companies to go after big artists with deep pockets in an effort to make even more money off their investments. America is well known for its rampant abuse of the legal system, but it works and in some cases is "worth" the effort. Remember, the claim can be RIDICULOUS, but the plaintiff still has their day in court. There is risk. In this case they lost, but if it costs them $1 million in legal fees (just a number I'm throwing out there), and they won $10 million in damages, that's a net of $9 million and often, the loser pays the other party's legal fees on top. That's why these things happen. Now, judges are "supposed" to determine if a case has real merit, but in a lot of instances, in more corrupt jurisdictions, they side with the person paying their campaigns and allow cases that shouldn't go to trial, go to trial.

Well I listened to the 2 songs. They definitely have the same beat. It's timed in both cases to a 4/4 measure. If you use a music editor and line up the very beginning, the start is very similar for like the 1st 8 beats. After that both songs are fairly unique. I would however argue the Marvin Gaye song was clearly used for some inspiration. But i didn't see enough substance for a lawsuit to be filed.

Long are the days when acknowledgment of sampling other artists is lost. Now we sample and say yup it's my original work if I change the lyrics and a few bars. The reality is most music I hear today comes from days when my parents were growing up and we heard it in the background on vinyl records. I can name that old-school tune just by a few bars and know darn well it was sampled. For those of you that do not have the nostalgia of music from other generations than you may not realize the problem if you have not been exposed to the music but for those of us that have been it's like stepping on those that paved the way for the up and coming artist today to express themselves so freely.
