Early in the morning of May 6, 2016, Weirton Police Officer Stephen Mader responded to a domestic dispute call. When he arrived on the scene, he encountered R.J. Williams, a young African American man. When Officer Mader asked Mr. Williams to show his hands, Mr. Williams revealed that he was holding a gun. As Mr. Williams began waiving his gun around, Officer Mader ordered him to drop his weapon. Mr. Williams ignored Officer Mader’s demand and repeatedly responded, “Just shoot me.”
Officer Mader did not “just shoot” R.J. Williams. He analyzed the full situation. He did not just view Mr. Williams as an African American man. He didn’t even view him solely as a man with a gun. And given Mr. Williams’ anguished demeanor, his failure to aim his gun or focus any sort of aggression on others, and his plea to be shot, Officer Mader concluded that Mr. Williams was not a threat. He was attempting to commit suicide by cop.
In this tense moment, Officer Mader did exactly what we want our police officers to do. He calmed his voice and attempted to deescalate the situation. He attempted to save R.J. Williams’ life. Officer Mader looked Mr. Williams in the eye and said, “I’m not going to shoot you brother.”
In the meantime, Mr. Williams’ former girlfriend called 911 and reported that Mr. Williams had an unloaded gun and was suicidal. The 911 dispatcher relayed only that Mr. Williams had a gun. While Officer Mader was attempting to deescalate, two other officers arrived on the scene. At that point, Mr. Williams began to raise his gun. One of the newly-arrived officers shot and killed Mr. Williams.
When the officers approached Mr. Williams, they discovered that his gun was unloaded. Officer Mader’s deduction had turned out to be correct-R.J. Williams had not been a danger to anyone other than himself.
A young African American man was tragically killed by law enforcement officers. A father, a brother, a son is dead. And we, as a society, have failed him like we have so many others. Sadly, this is a story that we have heard far too often in this country. But what makes this story different is that a few weeks after Mr. Williams’ death, the Weirton Police Department fired Officer Mader for not shooting and killing R.J. Williams.
A police officer is not constitutionally entitled to use deadly force unless he or she reasonably believes the target poses an immediate threat of death or serious physical injury to the officer or others. Officer Mader had determined just the opposite, that R.J. Williams was no threat to the safety of others. As such, Officer Mader was not constitutionally permitted to shoot Mr. Williams. Essentially, Officer Mader was fired for respecting R.J. Williams’ constitutional rights by not using deadly force.
Firing Stephen Mader for not killing R.J. Williams sends a chilling message to every law enforcement officer on the Weirton police force and across the country; they are to err on the side of killing citizens. And what message does firing Stephen Mader send to the community at large? What value does it assign to the life of R.J. Williams?
Today, along with the Law Office of Timothy P. O’Brien, we filed a lawsuit on behalf of Stephen Mader in the U.S. District Court for the Northern District of West Virginia against the City of Weirton. We simply cannot believe that our state’s public policy could permit a police officer to be terminated for not killing someone he reasonably concluded was no threat. After Mr. Mader spoke to the media about his termination, the City then engaged in a pattern of retaliation designed to destroy his reputation. Our lawsuit argues that in terminating Mr. Mader and its actions thereafter, the City violated his rights under the United States and West Virginia Constitutions.
We believe this lawsuit highlights the need for reforms at so many police departments around the state. We will continue to advocate for increased de-escalation training, implicit bias training and suicide prevention training for WV law enforcement officers. We will redouble our efforts to increase police transparency and improve community responsiveness and oversight of law enforcement activities.
We will not forget the tragic death of R.J. Williams. We must attempt to honor his legacy by fixing a broken culture in policing.

Sending an unarmed civilian to deal with a man with a gun is a bad idea. Smdh this cop did the right thing. We need this cat to train other cops. His military background and training saved that kids life and kept him safe.

PLEASE, be all means, send someone else first. Can we have an agreement that they won't just call us when the subject of the call is scary? I can't see how sending unarmed social workers to a suicidal person call can possibly go bad.

Update: Stephen Mader won the case and was awarded $175,000 for wrongful termination. He will not be refused employment as a police officer in any other department.

Issac Bueno there was context to the call, when dispatch relays a call they give an in depth description of the situation, what the cop sall was a man being ordered to drop his weapon and failed to comply, sense he was non compliantly was shot, yes he was suicidal but there was no way they could of known what that man would have done with the gun

There are many other ways to de_escalate the situation. If non works y kill the man there is always a choice to shoot the person on the leg/shoulder/ armed hand ... But that's not preferred , And There lies the problem. One need to understand the difference between "needing" and "wanting". Here the dept. "Wants" the cops to shoot down the armed man Rather than "disarming" . Guns can be used not just for killing it can be used for intimidation if that doesn't work it can be used for hurting, disarming .killing should always be the last "choice". And by the looks of it there were many other and they chose to kill him . If any are saying killing was only option because he was armed and waving the gun(not pointing). I say sry for u A cop should away access the situation first before taking action .the first cop at the scene did exactly that but the others took the different choice . In Most case there are few types of cop behavior 1. thrive to live in the excitement and would shoot or use force rather than trying make peaceful solution. 2. Those who get frantic and rash use of Force at the first suspicion of trouble saying they were scared for their life(that's cowardliness not bravery ). 3. There are few who doesn't know shit they are doing and when one of them shoots a suspect to disarm him/ her , and they shoot along with their partners after hearing the first shot it's like competition who hits the target first . 4.then there are those who are like this officer trying to take the right decision and actions. And use force only when necessary if no other choice.that too to in an "appropriate manner". A cop should know not just to shoot.but to shoot "when, Where (body parts....)and how(coordinated)" but first of all if he should use force or not.Using force is not always "necessary ". " Presence of mind" is what most needed. If any are saying they had to shoot because the suspect had a weapon and there is a "probability" that the cops life is in danger. U R WRONG risking their life is part of job description.- I'm not saying so the cops have to die but what I'm saying is "no one has to". If cops with above first 3 behaviors are allowed to continue things are only gonna get worse.

Archie Hung good cops don’t exist. They’re fired for doing the right thing. One cop elsewhere was fired for charging his chief and mayor for forgery. He literally walked in as a cop, to serve papers, and was fired.

there was also a cop here in australia who was fired for doing the right thing, he and some of his fellow officers were out patrolling one night and one of the officers said something along the lines of "i wonder who we'll get to beat up tonight?", which the good officer found really disturbing. they came upon a drunk man and police brutality from the bad officers ensued. the good officer noted the incident in his report, and was fired afterward.

They only get away with their corruption because officer's chain of command are in position to make decisions to cover-up brutalities, deaths etc. The most trusted profession in my opinion are firefighters! Do you really think during an emergency response and their like," Nah I ain't helping them or going up in there because they're orange, purple, maroon, black, spanish, white, muslims, hell fucking no!Firefighters save lives, straight like that! Officer's took an oath to: Serve and Protect the community and obey the law they' damn selves too. Now they pull people over and wanna block and obstruct traffic.. Park in parks, sidewalks where people walk through.... They wanna give someone a summons for turnstyle jumping when someone is shooting heroin, smoking crack or K2 literally nearby! About a month ago in NYC, I was shocked witnessing a heavy set guy smoking crack out of a freaking soda can next to people who were in close proximity... I'm like wtf! No bullshit, 2 cops just so happened to walk by and noticed the guy.... Kid you not, they told him basically," wtf man" train pulls up and they let him board the train smh Let that would've been me smoking a practically NYC half legal joint? Yeah they would've ticketed me. They don't wanna deal with the homeless, drug attics, the paperwork, for what? Same guy they take to the hospital for tweaking out on drugs, comes right back out and do the same drugs that hospitalized them. It's a genocidal drug too. The Cops know what I'm talking obout. Salute to the scarce few who are professionals, straight like that! 🙏

@@CrispDuck maybe but it takes nothing to pull the trigger by accident, if the gun is waved around the bullet has a chance of hitting an officer or innocent bystander or child even, in which case they then have to answer questions to parents and families on why he wasnt shot in the first place. While i agree the officer shouldn't have been fired for trying to de-escalate the shooting is justified. It's not always about what the persons intentions are, it's the outcomes that can happen from their actions while clearly not thinking straight, it's better he got shot than an officer or just someone random nearby.

You didn't pay attention did you the man was waving his gun around when other officers arrived so they thought they were going to be shot and they shot back officer Mader never said to dispatch "I have it under control dont shoot" that's probably what caused him to get fired and for the man to be shot

chris Prizzle nah, they used Officer Mader as a scapegoat to covert themselves. In the report it shows that the woman who called dispatch notified them that he wanted to kill himself and when he found out officers were coming he got a gun that was NOT loaded and had the intent of officers killing him. Why the quotation marks? The criminal whose reaction to an eleven year old girl was to physically attack her was a moron and he did not descalate the situation. This man tried to and he was fired, the dispatch clearly didn't transmit all the details, thus failing their principal job, the other cops were less trained and capable, nothing makes tackling a girl and over "taking too many milks" the correct course of action.

First of all Not everyone is American!!!!! Second ok yes lot of cops mostly don't have to deal with high stress situations but it can still happen! Think about it this way. Around 40 million people got some sort of fine for speeding alone, which requires an officer to give a ticket, but not too much else. In contrast, around 6 million people get arrested for some sort of violent crime, which are cases in which de-escalation skills would be useful. That's about a 15% chance of needing those skills, give a bit due to other things like preventing someone from committing suicide for example. Compare that to marines, who are constantly in warzones where they have to calm people who got stuck in the middle of well, a war.

Yea why blast a guy to death if he "appears to be self-suicide" by cop? That cop could have shot the guy and it would have been justified according to the cops testimony! Plenty of other cases and videos in which individuals tell the officer to shoot them. One case the officer did not and paid the price with his life. In my opinion the officer put other responding officers life in danger.

Its not wven fair to consider that the officer should give up his own life because a policy states that talking should be done first while having a gun pointed at his head. The cop's gift is maybe being a counselor, mentor or maybe a suicide prevention advocate. He did the right thing yes, but it could have quickly cost him his life at the same time. Protocol in police training is everything. It is not based on emotions feelings etc. No room for hesitation. It is based on the situation in front of you. Also, by this cop not shooting the suspect, the way the police department look at it is that he could have cost another officer their lives by not acting. So regardless if we agree or disagree with what this cop did, training protocol tells you that if the suspect has a gun and goes to grab it you must shoot.

Sandy Red He only received a $175,000 settlement on this case. He deserves at least half a million on a wrongful termination case. I am surprised at this low settlement. I hope he can become a cop again but in a different department that honors the badge and his character and wouldn't discriminate against him based on the choices he makes in trying to rationalize with the troubled man, instead of shooting first and asking questions later.

@@degenerals6127 He was a cop when actually tried to "serve and protect" a civilian in distress. Because he was a competent Marine, he didn't freak out and kill an innocent civilian. So yes, I can respect the cop he was at that time. That he was fired and not rehired tells me all I need to know about that institution of cowards. He lost his job, but he didn't commit murder - I salute him for that. I hope he gets a better job. He was fired because they want to protect their cowardice and offensive narratives.

Unbelievable he's was trying to save a life. He used his training. Yet he got fired. That tells you that the police department he worked for doesn't care about lives. The Criminal on Patrol that shot that man...shot him in the head? You can clearly see he wanted to kill him. Welcome to America the Great. My respects go to you...Sir for trying to save a life. Here's a story, There was this guy in his apartment that was upset because his girlfriend fucked another guy, his girlfriend didn't like the fact he was pissed off and wanted her to leave, so she called the cops and told them he was upset and didn't know what he was going to do. So the cops show up at this guys apartment and the girlfriend lets them in, the guys setting on his couch on his cell phone and he didn't put down the cell phone and his hands up fast enough so the cops shot him dead.

That "poor man" had just assaulted his girlfriend and was holding a gun. He was not a good person. This happened 2 blocks from my house. And now the former police officer who was fired for potentially putting lives in danger works at the same place I work making a lot more money than any cop does.

@@rayray6490 refusal to drop the gun when a police officer says drop the gun is more than enough. The guy has a serious criminal record. And to be honest real men dont hit women period. Walk away if it's that bad. The fact is no way for a cop to know if a guns loaded if they refuse to comply they are putting the cop and people in the area in danger. There is protocol and reason for it. It's pretty easy to not get shot by a cop. Simply dont make them think you are a risk. People like you are quick to stick up for a guy who isn't worth it but if someone you cared about was killed by someone because a cop refused to shoot them then I bet your tune changes. And by the way the cop who did end up shooting the criminal is still a police officer so it was obviously justified.

Who cares what his background looks like! That shouldn't be a reason to be killed. He didnt beat his gf or hurt her for that matter. The officer did an amazing job thru an opposing situation. He was willing to give his time to read a situation without enabling a situation to go wrong.Not that every situation can be dealt with in the same manner but who would know unless u take ur time before acting. Hats off to not only an outstanding officer but a true man to rise above . Get back into law enforcement .The world needs u there.

You wouldnt know a good one from a bad one. In real life there are consequences and things to consider in the heat of the moment when dealing with someone who holds other lives in their hand. That suicidal guy could have fired off rounds if it wasnt for that head shot but you dont want to consider that. Life is precious and when your the one who has to take a second to consider all the things that could go bad by your inaction, you have already failed.
