The unfortunate reality of this is that the supreme court ruled years ago that cops don't have have to know the law effectively. They can legally act with "reasonable misunderstanding" of a law. Ignorance is an excuse within the context of qualified immunity.

I've been a LEO in both the military and as a civilian for a combined 37 years. This was a bad shoot PERIOD...no if;s, and's, or but's. The suspect MUST demonstrate intent, opportunity, and capability before deadly force can be used. While the Airman demonstrated opportunity and capability, there was no intent. This officer is going to prison.

That was a bad shoot. I wouldn't have even opened the door. The airman didn't even bring his firearm up, and that policeman opened fire. The last ROE I had in Iraq wasn't even met in this video.

As a retired MP, BAD SHOOT. This young man being a service member is our Brother and should be alive to be with us today. I will side with the police when they are right. However, this is NOT one of those times... the video does in FACT speak for itself.

I was a cop for thirty-four years in a very busy So Cal jurisdiction. I too think this was tragic but I'm not sure it was a bad shoot. I'm not sure the deputy went to the wrong apartment. He went to the apartment number he was given by the civilian. Did she provide the wrong apt number? I've seen other vids saying he went to the right place. I'm unsure. I would have preferred he wait for backup. Preferred he announced his identity earlier, but he still announced a couple times before the airman opened the door. The airman should have set the gun down before he opened the door. Could he or should he have yelled drop the gun and given the airman time to do it? I think so and I hope I would have. I don't know his level of training and experience. The dirty secret here is lack of training. defund the police? Training is the first thing to be cut. Even with full funding cops get a very small fraction of the training the operators on this show have. I think I read that SEALs get an 18 month training workup for a 3 to 6 month deployment. Please correct me if that's wrong but the point is cops get very, very little tactical training. My dept sent us the tactics and survival training once (8 hr day) every two or three years. Cops need much more training.

Officer is banging on door announcing he is the police..repeatedly. If the guy inside thinks there is enough of a threat to arm himself, why open the door? Why not yell through the door? Why not take a defensive position and wait to see if the person at the door kicks it in (assuming the guy inside DIDN'T know it was the police)? Do a little thought experiment here. Say this was a car stop and the the guy at the wheel opens the center console and pulls out a pistol. Doesn't point it at the cop. Just puts it on his lap. If you were the officer on that stop what would you do? Wait and see if the guy points it at you? As to the "well he had the gun pointing down" crap....I don't know what they are teaching in the military these days, but do any of these guys know just how fast that gun could have come up and shot? WAY faster than any of them could could react to it. Of course if they were out on a hit they would be at the door guns up anticipating violence. That guy in the upper right corner is correct..he is certainly not the Police. I was Mil and an currently LE. You guys should be careful to stay in your lane. I'm calling this a "lawful but awful" shoot in the end.
