I have a zero-tolerance policy for anyone invading my home or anywhere around it.
So the thought of someone breaking into my home and making me feel unsafe in my own home enrages me.
So when I see stories like this, I have minimal sympathy for the intruder.
However, the lawyer in me knows that what I feel is a justified use of force isn't always what the law deems justified.
Unfortunately, this woman is experiencing firsthand the unpredictable world of the legal system regarding self-defense, and if you ask me, it's ridiculous.
As responsible gun owners, we already have everything stacked up against us.
A criminal get's to plan an attack against you, and what do we responsible gun owners get to choose? Almost nothing!
The only thing we can do is hope to see the attack soon enough to give us enough time to do something about it.
Considering all the disadvantages legal gun owners already have to deal with when it comes to protecting themselves, you'd think the government would do everything to help us equal the playing field, but no, because the government is against us too.
If the day ever comes and we have to use our gun to defend ourselves, at that moment when our life is on the line, and we only have a split second to make a decision, we could still end up going to jail because the legal system didn't think our actions were justified.
After all, it wasn't positively clear that the person who broke into our house or property in the middle of the night was dangerous enough to use deadly force.
The crazy thing is, even if you beat the criminal case, the family can still try to destroy you financially in civil court.
I'm not saying that we should be able to shoot anyone who shows up on our property at night.
I'm saying that deciding to use deadly force in a situation like this lady was faced with is already hard enough without our government making it ten times harder on legal gun owners.
If you use your gun in self-defense, you may have saved your life, but you now may lose your freedom.
If you saved your life and maintained your freedom, you may now become financially ruined.
If you saved your life, maintained your freedom and money, you still may have to deal with the emotional trauma of having to take a life.
All of it is messed up, but that's our reality, and it's also why I encourage people to get some form of membership with an organization like USCCA.

This kind of reminds me of those stupid school policies on bullying, where bullies get almost no repercussions when assaulting someone, but when a victim stands up for themselves through force when absolutely necessary, the victim gets in massive amounts of trouble through the school system. This shit is so backwards.

I was suspended 23 times, from 6th grade to 12th, just for defending myself. This is the reason why I have cameras EVERYWHERE, and why I turn on a sound recorder, on my phone (512 gig microSD), EVERY SINGLE TIME I leave my home or car. You blindside me, I shoot. You get aggressive with me, you get ONE verbal warning, and if you persist, I shoot. I don't play anymore

I had the misfortune to have four drug addicts break into my apartment. The vast majority of people will never experience the palpable fear of being beaten at minimum or simply killed. I was fortunate to have escaped them, however, if I were armed at the time I'm sure I would have fired. If someone breaks into your home, you don't have the luxury of knowing whether or not they will harm you or your family. Anti-gun advocates need to experience such a fear, I bet most of them would change their minds about self protection.

@@Army12Bravo236 The trouble is that they will then sit there and be like "oh but you don't need an AR-15 for home defense, just get a shotgun, run outside and fire two blasts..." IMO, "arms" in the second amendment applies to anything which constitutes a bearable weapon. Whether that is a musket, AR-15 or M60. And I don't think it's the government's place to be telling people they can't own it.

I love how some people can understand and put in writing that a person broke into someone's house in the middle of the night (probably to do harm or to commit wrong doings it's the middle of the night when people do bad things) and still defend the person who broke in, some fucked up world we live in I swear

The person didn't break into the person's house. It was a detached garage and so the the intruder wasn't a direct threat. The homeowner chose to go and confront the intruder and shoot them. If the garage was attached to the house, I don't think the duty to retreat applies because you can't retreat from your house without running from your home and you could perceive the person to be a threat. The garage is separate from the house

@@jamessavent3636 The issue of your statement is that you are assuming that your garage, attached or unattached, isn’t a part of your “home.” Your home is defined as “the place where one lives permanently, especially as a member of a family or household,” it doesn’t state what exactly a home is. Is it the house? The property? Here’s the question you need to ask, do you think of your garage as a part of your home?

Plus, if someone fires 4 warning shots and are still advancing toward a person and reaching for a waistband you need to be shot before you kill the homeowner. That intruder obviously meant to do harm otherwise he would have taken off with the warning shots. What kind of person are you that you think it’s ok for people to go into other people’s property and attack them without consequence?

@Corey Gonzo You must be mentally challenged, all I did was add questions to the current question. I didn’t state that the detached garage was part of the home, just that the definition of “home” is vague. It was to make people think further in regards to these definitions and how they affect law. What blows my mind though, is that people like you actually think that someone that is on someone’s property illegally won’t have any bad intentions. I think this needs to be a more normal occurrence. If thieves start to see that their lives are at risk for their bad decisions, then maybe this country might have less thieves. If a thief believes that an object is more important then their lives, then that’s their problem. Not mine. Grow up and stop acting like a child that isn’t getting your way.

Update to that case in Minnesota: The woman was not charged by the state. Also, the woman did not have a duty to retreat because there was a child with her.

I am often very confused how a criminal who breaks into your home has more rights than the homeowner. Criminals have no right to be in your home. And I believe that in itself constitutes an emanate threat!

There should never be such a thing as a "Duty to retreat". If someone is on your property against your will and is displaying any kind of hostility, that should be 100% self defense. If you break into any part of my property, I'm not asking questions and yes my property is worth more than your life.

I have listened to some self-defense attorneys talk about what they go through trials, and most of them say this: Warning shot(s) is a terrible idea. If you had time to do so, what is it actually self-defense? If it is genuinely in self-defense, you should not have time to shoot warning rounds into the air.

they're a terrible idea for a multitude of reasons. the biggest being you're responsible for every shot. a shot into an attacker might go through them or around them and hit someone else, and that's sometimes a risk you gotta take. but a shot where you purposely miss could still hit someone else and then you're still in danger. not to mention that gives an attacker time to react, and their reaction may be more aggressive. and if you have a low capacity gun, like a revolver or shotgun, thats one less round to defend yourself and you may need every single one. also if a warning shot were to stop the threat and it goes no further, the attacker can argue in court that pulling the trigger was the use of deadly force, and since that alone stopped the threat, the use of deadly force was an escalation. in which case you're looking at possible attempted murder charges. just all around a warning shot is the worst thing you could do in a self defense situation besides just not pull your gun because you're afraid of the legal consequences after

I would add one caveat to that. Somebody is walking home drunk and gets the wrong house. Other than that, yes I agree with you, especially if you have a family. If a stranger comes into your house conscientiously and uninvited, my personal belief is that they should be fair game.

Any DA would not prosecute this woman except those looking to make a name for them selves by convicting every person they can. These DA's are a danger to us all & won't hesitate to use an innocent person as a stepping stone. My state is notorious for this. Organized Crime is getting worse in Oklahoma.

@Lone Wolf 13 13 I would like some clarification on the trespassing part. My family lives in a rural area and owns quite a bit of acreage. We have found people inadvertently trespassing quite a number of times, all we do is point them in the right direction and everyone is good to go. I assume you aren’t talking about shooting someone merely for being on your property in a non-threatening fashion.

There was one case a few years back (R. v.Talbot) where a homeowner was chased around his house by a 'friend' with a knife, until he was finally backed into a corner of his bedroom. He had a gun hidden in his nightstand and was able to retrieve it and kill his attacker. He was still charged and the case dragged on for a year or more. When the charges were finally dropped, the Crown said: ”the occupant of the home had no means of escape. As a result, this makes the use of a firearm more reasonable.” So, not only the duty to retreat - but the duty to retreat until you CAN'T retreat anymore, regardless of the circumstances. Only then does it become reasonable self-defense to the government. What a joke.

The libtoids are slowly changing the laws to punish gun owners for owning guns. They'd rather let the criminals win by using them as their cannon fodder to weed out gun owners by breaking into gun owners homes. When they kill the home owners, "Good on them!", they'll release them soon enough from prison to do it again, yet if the home owners take out the criminal invaders, "SHAME ON THEM! YOU BROKE THE LAWS! YOU GO TO PRISON!" I used to belong to USCCA until the "wonderful" governor here in WA called it a "license to kill" and made it illegal. By this logic having fire insurance on your home is a license to commit arson. I'm not sure how he can get away this. Isn't he taking away our right to retain legal council?

Other than the inflammatory phrase "license to kill", I wonder what grounds the governor used? USCCA is basically having legal representation on retainer should you need it. Also, people being represented by USCCA attorneys don't receive any special treatment under the law. If they make a bad decision, they'll have to pay the penalty. The biggest thing is that while you get access to training to help make decisions in these situations if, God forbid you need to, you have someone who knows the laws on your side. But I guess that fits the pattern of most gun laws... You're not supposed to be able to figure them out to deter people from becoming gun owners.

It’s so incredibly sad when criminals have more rights than law abiding citizens. wtf is wrong with lawmakers. I have a wife and children. If a person KNOWINGLY breaks the law by breaking into my home, I’m not taking any chances. I don’t have time to wait on the police when I don’t know these fools intentions. Wasn't her home. It was a detached garage and as soon as she steps outside and starts blasting off warning shots that could have killed one of her neighbors her self defense claim goes right out the window. And I love how she said he was running towards her reaching for his waistband. Did the cops find a weapon on this guy?? Duty to retreat is the same as duty to remain a victim. We should apply these laws to Politicians so that when people try to harm them they have a duty to retreat and are never allowed to attack... same for their body guards. The objective is to make you subservient and nothing more. You are a subject of the state and your agency is gone.

No, it's not murder Colion! She fired 4 warning shots, and he's still dumb enough to advance on her. He's reaching into his waist for a weapon as far as she knows. Retreating will only get her shot in the back as she does. Her home or place of residence, and he has no right or reason to be there at that time, other than nefarious reasons. He put his own life in jeopardy when he decided to enter someone else's home with ill intent. And she has a right to protect her own life and family!

The warning shots are what can get someone jailed. Not only are they a potential hazard to others, if you have time to fire warning shots, you’re not exactly in immediate danger are you? If you have cause to draw your gun then the only shots that should be fired are at the threat.

Hell depending upon the lawyer they could be knowledgeable in things like car insurance laws, but are not nearly as knowledgeable in something like going after companies who fuck around with personal safety towards customers and employees.

Living in Maryland with "A duty to retreat", the Castle Doctrine would not apply to a detached garage in the state. It only applies to the immediate building wear you live. I can not use deadly force to protect "mere property". I bought carry insurance. It is important to read the fine print of the policy - insurance restrictions vary. Some policies even require repayment of their expenses for the claim, if you are found guilty in a court of law.

Although i believe its justified, i feel she gave up a strong case with the warning shots. Now a prosecutor could use that against her regardless if the self defense was justified. I wonder if they’ll try to charge her for unlawful discharge of a fire arm, prior to determining the person posed a real threat when he “advanced” on her? Could it be used against her in that she has committed a crime and then shot someone during that? I know how crazy that sounds but seems like thats something they’ll try to get her with.

In those states you're obliged to wait until the intruder either physically injures or kills you before you're allowed to use lethal defense....which proves extremely difficult for a dead home/property owner.

Anyone who crosses onto your property? I feel like that's a bit too far. People don't need permission to walk onto your property. They need permission to stay. If I walk up to your garage and you shoot me from inside your probably going to jail. Cause all I was trying to do was sell you a box of chocolates. All i'm trying to say is a blanket rule like this isn't going to work in a complex world. If you ask someone to leave and they don't that's strike one. If they start walking toward you that's strike two. Ignoring a warning shot(or a verbal "Freeze!") that was never necessary is strike three and I'll definitely shoot them. But claiming we can shoot someone for walking on our property just isn't going to cover a wide variety reasonable of situations.

Even in rural areas where working farm owners have the right to protect their equipment, crops, and livestock, just because someone has wondered onto your land, you can't just shoot them on the spot. You have to show that all other means were exhausted for their removal before you used deadly force. A homeowner is in the wrong if they go into their garage and shoots an intruder, because there is a wall and door that separates the garage from the home. Defend in place laws does not protect a gun owner if they go into their garage or barn, no different than it does not protect leaving the top floor of a home, down to the bottom floor, or even basement to check on a bump that was heard. You shoot the person, be prepared for a prosecutor to charge you with murder, manslaughter, or negligence.

I wouldn't dream of shooting a trespasser who inadvertently wandered onto my wooded acreage, but entering the chain-link fenced half acre that surrounds my home is a completely different different story. My state/rural county has laws that protect home & land owners who use lethal force against intruders who purposely enter a home without invitation, open a gate to enter fenced property, and detached buildings lying within that gated fenced property. We have always been an open carry state & my rural county was the first in the nation that voted overwhelmingly to allow ALL school teachers to conceal carry firearms in the classroom. Now every county in the state has the same law.

Yup same here in Pennsylvania. My 5 years will be up in October, so I asked the sheriff what was the soonest I could renew, they told me I could renew anytime, but then my next 5 year period would begin from the renewal date, not the original expiration date. Stupid crap.

Absolutely self defense, if you think it is ok to break in, terrorize, steal, and then threaten or harm a person.... this is your consequence for thinking that is ok to do by that person defending themselves or their family. As a Canadian, defending yourself or your home with a firearm even if you're legal to own one is not an option. 99% of the time you will be investigated and tried for murder even if the person is strung out and just kicked in your door with his buddy's who are all armed with bear spray and machetes. At least some of you down there in some states have a chance to avoid jail time for protecting your family.

Tbh Canada's case law in terms of self defense itself is very red state-ish, i.e. no duty to retreat, etc. The obvious problem however is that they'll easily get you on gun charges that are designed to make self defense impossible

What colion said about how he feels about intruders in the beginning is perfect, people who think they can come to my home and wrong me in any way enrages me. I had a guy follow me home once because I gave him a dirty look after he honked his horn at me for letting children cross the street safely, he also tailgated me the whole way, grabbed my .500 which is my truck gun, walked up to him holding it by my side and he immediately started trying to apologize and said he was just coming to make things right, told him if he was any dumber he'd be buried in the woods. I remember saying to my friends "yes I want a .500 magnum, if anyone ever fucks with me I don't even have to point it at them to make them piss themselves" i know this is not really related but thought it was funny, invest in a .500.

Reminds me of a self defense case from a couple of years ago. Basically a guy broke into a home with a pistol and the homeowner defended his life and property with an AR. The family of the criminal tried to say that it was an unfair fight. In my opinion the second you break into someone’s home for any reason you have thrown away your rights in every regard.

“Duty to retreat” laws are intended to give prosecutors permission to claim any self defense case is unjustified. People the prosecutor does not approve of, whether politically or the wrong ethnic group, can be charged at will.

I love that the crook’s cousin had to emphasize that that he “was a father of 2” as if any reasonable father figure is gonna go breaking into peoples garages in the middle of the night. So I have learned that multiple things can be true (or not true) at the same time. "Wokeness" has nothing to do with "victimhood". However, liberals DO in fact trade votes for giving things. Having said that, being "woke" is about seeing beyond your own shortsightedness and actually taking other's thoughts, experiences, and points of view into consideration. As bad as the liberals have done, conservatives have played the game as well. It is all about identity politics and trying to force you into one camp or the other. Hence the whole "woke" term which is just a conservative political word takeover to make you discount the other side. It is impossible for a country of 330M+ people to divide our socio, economic and political ideology into 2 parties. You need to get "woke" to the game (see what I did there?).

@@junglejim5785 The only way to do something about this is by removing the politicians who have wrote these laws into effect and then rewriting the laws entirely. But in order to do that you would have to restructure the entirety of the US government because it is corrupted from within, victims equal money. And criminals make victims.

Video of this(doorbell camera I believe) showing that he wasn't shot until reaching for his beltline was part of the reason she wasn't charged. At least, thats what some of the local(MN) news reported during the whole 15 seconds they covered it.

A detached garage is legally considered part of the curtilage of the property. It 'should' have the same status as the main house building. Whether it will be treated the same or not is doubtful.

The question at hand is what happens if your firearms haven't been taken away by a red flag law before you need them and you use one against an intruder in a detached building. In the 60's people KNEW that if you entered a mans PROPERTY without ANNOUNCING yourself you would be automatically considered a murderer or a thief and it did not matter if you were inside a mans house or not! Even the police would NEVER have just willy nilliy just walked onto a mans property without announcing themselves FIRST. And God help them if they EVER attempted a "no knock" warrant! A no knock warrant even with an actual warrant was just asking to get shot for breaking and entering! Like I said this is all bullshit, its the slow motion method of turning America socialist!

@@orppranator5230 it is even worse here in brazil, you can only go from your home to a gun club with ccw, if you go somewhere else you might be arrested, or lose your gun and your rights ( its not on the constitution) and you need to carry 3 different licenses to have one, let alone the price of a good handgun is extremely expensive and some lawyers here said the same exact thing as Colin, you might win the battle but in the end of the day you will be poorer if you kill a thug because of the blatant laws we have and the "human rights seat" on the parliament. Cops also gets penalized here even on duty.

The homeowner chose confrontation because the garage was detached and wasn't in the house. If the intruder was in the house, castle doctrine applies and there is no duty to retreat. Because the garage is separate to the house I believe the city to retreat applies.

@@jamessavent3636 Incorrect. Under the "castle" law every inch of your property including all land and adjacent structures is considered the same as inside your actual home. If a homeowner faces a physical threat there is no duty to retreat anywhere on their property. The state this shooting occurred in does not have the castle law I believe. That apparently is the problem.

There should be no duty to retreat or any laws restricting home owners. You should be able to use deadly force if anyone breaks into ur home. It's the place u feel safest, where ur family is. When someone violates that sanctity by breaking into ur house, even if they are unarmed, home owners should be allowed to use deadly force. Maybe that will deter home invasions and break INS.

What do you jeep in a garage, your cars. Cars are not only one of your most expensive possessions, but also your means to get to your job and provide for your family.

Exactly. Pennsylvania had a duty to retreat, which they said you had to get as far away from the threat (so you had to get to the furthest room in the house away from the criminal, lock the door and then announce to them as they tried to break the door down that you were armed). Thankfully they got rid of that. It basically amounted to locking yourself away in the highest room in the tallest tower for potential security.

I ask this question, is because i'm a legal gun owner living in Pennsylvania (born & raised) who also has a CCW license for Self-Defense as the main reason (my apartment was broken into years ago in a targeted hit while I was at work, while my mom was dying in the hospital.....now imagine if that same burglary happened if she hadn't died in the hospital)

Especially because retreating means you turn your back on the threat to you. That is the most dangerous thing you can do. Clearly the criminal had no qualms breaking the law to commit burglary so who knows if they would assault or kill you as well. Don't risk it.

Any law that is unjust is to be resisted. Any law that prevents you from defending your property strips you of the right to property. Any law that seeks to strip you of your property is unjust. Therefor any law that makes it such that you can not defend your property is unjust and must be resisted. these are the values we must hold to maintain a fair, honest, and strong society.
