Their explanation of how their home was foreclosed is not how the foreclosure process works. If you’re making your $70,000 monthly mortgage payment, the bank will not “buy” your home in an effort to resale it for extra money. A bank will foreclose on your home if you stop making monthly payments, which means you defaulted on your loan agreement. The bank will then sell the house in an effort to get back the money that the bank lent you to buy the house in the first place. A foreclosure is the last thing a bank wants to do because they will most likely lose money. Why won’t they just tell the truth? They can’t afford their house anymore.

I’ve worked in construction for a long time and all this bulllshit they got scammed by the contractor is almost certainly not true. You need to hire an architect who would draft up a design to take to the city, who would then have their head architect approve. Then the city would be doing inspections throughout this entire process on every level this is a giant project in a nice city. It’s not some tiny addition to a house where you could probably get away without having to run it through architects and city inspections. I just don’t believe them especially considering they bought both properties brand new, something is off here.

My family lives just above the poverty line, and my mother ALWAYS has put us before her. We never were neglected, but there were times where we DID have to go without or make do with what we had, she wasn't perfect (no one is and she had it worse growing up), we always had a roof over our head and food in the fridge/pantry, and I can NEVER imagine her doing this to us. In the uk when you apply for a mortgage on a property its common for the bank to send out an independent surveyor who value it and check there are no major issues, without this the bank will not approve your mortgage. its then also advised to instruct your own surveyor to check the property.

I don't really buy these "the house was leaking" clips, I think they filmed them after the foreclosure news hit and they needed to come up with a reason for it because you simply cannot stop paying your mortgage because your house is leaking. You were the one who purchased and renovated and authorized building two mansions into a mega mansion, this isn't a lease situation where you are refusing to pay your rent because the landlord isn't fixing the issues in the home. They are the landlords, if the renovations weren't done to their satisfaction, that's when they fight with the contractors, get lawyers involved, sue the contractor but still you pay your monthly mortgage payment. NOTHING they mention in these clips, explain why they didn't pay their mortgage. They didn't pay their bills, they got foreclosed on. They could of gone after the contractors if all of this was true but I haven't heard of a single lawsuit going on against the contractors.

This is all a lie though. The Hollywood Fix has a video of the auction. California TD Specialists have been their lender since July 2019. They didn’t have to go around ‘searching’ for a lender, they always had one. And the lender doesn’t buy back the house. When no one buys the property at auction, it goes back to the lender. Catherine is lying in that video. They stopped paying, point blank. The video of the auction straight up says the lender has had the property since July 2019. You also can’t be foreclosed on because of an occupancy permit. You can get fined, but you only get foreclosed when you don’t pay.

A certificate of occupancy has nothing to do with foreclosures. It's just something that goes along with building permits. If they didn't get a cert of occupancy... That means they also never got building permits from the city, meaning anything they changed or added was done illegally. Which is a big problem. THATS why there is the massive discrepancy between what the house is appraised for and what it was sold/is being sold for. All those illegal additions they added are going to be a big, expensive problem for any new owners and a massive headache for sales. Either huge fines need to be paid; the additions need to be torn out (because they are illegal); or, the house goes in a cash-only fire sale bypassing banks and official channels for like 2/3 of it's value. I'm not a real estate agent but my family has flipped houses my whole life and I know how this shit works. They are so fucking full of shit. Once again, they're banking on their super young audience being naive and ignorant and buying what they say, feeling sorry for them. They are horrible.... Seriously knowing how many real, actual lawsuits they have against them, and what kind of tenants/buyers they are I'd be surprised anyone would be willing to sell or rent to them at this point. They're radioactive. And also, foreclosure only happens when you don't pay your mortgage (or, in their case, 2 hard cash loans with stupid high interest rates because banks wouldn't touch them). See Spencer Cornelia's vids for a breakdown on the type of hard cash loans they took out since they couldn't get a mortgage. They're drowning in debt and bad decisions.

My husband is a city planner in CA: if they didn't have a COO, they can be fined a fee for each day they occupied the house illegally. There are myriad reasons why the city didn't give them a COO, including exceeding lot size, using too much of the land (you have to leave green space in some places to prevent communist block style buildings), etc.

I am assuming the reason they couldn’t get a certificate of occupancy because it wasn’t permitted as a residential property. From other videos I’ve seen it sounds like they got it permitted as a commercial property which would mean they can never have a certificate of occupancy. Also, if it was inspected and deemed unlivable they wouldn’t be able to get a certificate of occupancy, or one was never obtained before the start of building the house. There is so much that could have prevented them from getting one. I really believe they got it permitted as a commercial property and not a residential.. 🤷🏻‍♀️ I don’t feel bad for them because they had the money the entire time to not stay in that situation. I feel bad for their kids because their parents are awful and not intelligent at all..

They did put it as an company. Its on public records as an inc. If I remember correctly. When I looked it up in a database that I have I was surprised that it was an inc instead of a trust or an LLC which most people that can buy/get a house like it use.

But even if it was permitted as a commercial property, I don’t see why they were unable to get utilities at the house. Businesses need utilities too! I’m fairly certainly even business properties need a certificate of occupancy. An inspection is part of the certificate of occupancy process, so I’m thinking they failed the inspection regardless of what the property was being used for. However, I don’t know anything about their story other than what was in this video, so I’m probably missing something.

Apparently this loan was probably a business one which is why it was months instead of decades. The records show the house was bought through their business and it says it’s a commercial property

What I believe: Overpaid for a house, set it up under a company to claim as a tax right off and decided to live in a house under construction to flex their lifestyle. What I don't believe: It had no water/electric/gas (supposed gas leak happened from nowhere huh?), they were scammed so someone could flip their house and it's worth $16 million dollars. Atozy you also don't need a certificate of occupancy for your house, you only need that when you're building a new construction; a building built for one use is to be used for another (e.g., an industrial building converted for residential use), occupancy of a commercial or industrial building changes, or ownership of a commercial, industrial, or multiple-family residential building changes. (Wikipedia definition). If this was a legitimate problem (I have my doubts because it's the ACE family), it's probably due to the fact they listed the home as a business (ie a place to film) and then tried to change it from a business to residential property during construction and had none of the proper permits or sign offs.

The certificate of occupancy basically is the local zoning authority has approved the place for human occupancy, meaning it’s safe for someone to be there.

Yes. Also the city has to vote if it comes down to zoning. I went to a zoning meeting for my own town because my neighbors wanted to use their land as an event space to hold weddings and gatherings. I live in a TINY ass town. I'm talking less than 2000 people. They still had to have a meeting to approve their zoning change. If the Ace family wanted to convert their property to a residential space I'm sure they would have to go through the same process.

As someone who writes zoning reports, a new single-family in LA’s jurisdiction HAS to have a Certificate of Occcupancy (CO) in order to be legal. A CO is only issued to the property once all inspections have been performed and appropriate permits have been obtained. This is a fucking mess, and I genuinely do not know how they were able to occupy the residence legally.

I highly doubt they got a loan for another house. The fact that they’re on a sinking ship with all their other ventures is enough for any lender to want nothing to do with them. I’d guess they gave one of their parents the cash and a family member went and rented them or bought them a new home in the family members name. The snowballing continues.

@@JakeDrives1 You can’t give down payment cash to someone to go get a home loan for you. Banks are really picky about tracking where your money came from. The bank has to make sure that you can afford to make the loan payments. If they see that you were given money and don’t have the means/income to make the payments, you’re not getting a loan.

It’s sad because a lot of their audience is very young. These kids don’t know what being a homeowner (or a ‘home buyer’) really consists of. Damn near everything they said was bullshit and they had the opportunity to not sign the paperwork to own the house as they should have had it inspected beforehand to find the poor quality work. Like, if there’s no gas to the house how do you not know that before buying? They’re either lying, dumb as fucking hell, or they didn’t pay their gas bill. Personally, I think this whole story is bullshit and they actually made the problems within the house so they can sell this to their fans.

My aunt and uncle had a house built years ago by a larger company to take care of everything and they never had their "punch list" completed and never will by the contractors because they bailed after being paid. When my parents built a house a few years later, they went with a smaller guy with his own team and it was a little bit more expensive that way but nothing was missed and it was incredibly well built. When making that big of a commitment you really have to make sure you have the right people for the job or you'll get the short end of the stick. Man the ACE family got screwed big time.

Home inspector here... They obviously did not get any home inspections during their build. Usually new builds get a pre-foundation inspection, a phase inspection (mid-construction), and a final inspection before the property goes into the buyer's name. Even one inspection would have detected these issues up front.

That's not how foreclosures work. They were talking and not making sense. It cost the bank money to foreclose. Between the cost to file the eviction, the cost to kick them out, holding cost while trying to get a buyer, and the fact that foreclosures normally sell for less than what is owed, there is no reason for the bank to foreclose if they were making payments. And on a house in this price point with all the work that needs to done concerning the leaks, the roof, the water damage and possible mold it will take them a while to find a buyer. It already failed to sell at auction, which screams no one wants it. The bank could be holding onto this house for years trying to find a buyer.

You get a certificate of occupancy when all the inspectors sign off on the contractor's work. If they don't pass inspection, you're not supposed to move in.
