The uncle coming to the second stop was excelent. He listened to the entire story of the cop, and then said "I don't believe you. I already watched the video" and calmly explained to the cop he was wrong. He risked getting arrested and beat up himself, but he stood up for right and wrong over threats.

Not gonna lie I can understand why if the other cop was denying to do his job. While I don't think either cops rating is outrageously wrong, I think it's crazy that the no breathalyser guy got a higher rating despite being completely wrong. In the end, if this guy were to go off the road and kill some kids I don't think justice would have been served.

He was the Sergeant and when he made the comment about having each other’s back should only apply when you are right in the first place. If this officer was.a supervisor, he needs serious retraining. His ignorance of the law is disturbing for someone with supervising responsibilities. Kudos to the junior officer for calling him out in light of his flawed logic. The only thing the junior officer did wrong was trying to express a different opinion in front of the driver. Praise in public, but reprove in private. One of the least applied skills in leadership is this one. It will keep you from accidentally bruising a sensitive ego and a little bit of public recognition an go a long way.

He got fired because of this incident because he was dead ass wrong and made all the officers look stupid on the side of the road. Motor vehicle drivers are absolutely required to submit to a breathalyzer test. If they refuse, they go to jail and get the DUI anyway.

Even without qualified immunity, they're typically indemnified by the city etc. It's common in police union contracts. So the cops still pay nothing themselves. Also states like Colorado that eliminate QI set very low limits on direct damages. I think it's something like $25k in Colorado.

Imagine if he was white and victim black. The whole nation would be in uproad (at least according to longnose media) and there would be presidential calls for "justice". Now all we get is deafening silence from the system. When roles are the kind that they are here, it is very much ok for media and those who own the media. They probably get enjoyment out of it, too. If the whole point is to be blind to the race and only judge individuals according to their ACTS, then this kind of ACTING should get the same treatment as if the actor was white. There should be uproar in BOTH cases (not only when the victim is black and perpetrator white) or NONE in either. Current situation is pure opposite of true justice.

I think police should automatically have to pay 100 $ out of pocket per minute for any kidnapping. i.e. Any time an arrest is made that does not result in charges filed. That way, they cannot get away with punishing us for exercising our rights. I bet they would quickly learn how to do their jobs correctly.

@Adventist1997 Protecting someone's rights doesn't really apply here. The guy was seen swerving by an officer. Got a call he was swerving. The driver even admitted to drinking and driving 🙄 So the way ATA put it, it's affordable to stand up for citizens rights, but should be now knowledgeable. He also stated the officer was condescending to the officer on the scene, as well as arguing with his supervisor in front of citizens. So since nothing was done illegally it's not an F/D, but it can't be a B because he was wrong in his assertions, asking to alkysensor doesn't violate rights when the driver admitted to drinking.

They didn't have his body cam or anything, but I guess you ignored that too... 🙄 Disagreeing with a supervisor isn't inherently bad especially when they want to make sure an Innocent person isn't put in jail. We need more cops that are willing to stand up for citizens. Imagine how many innocent lives could have been saved if the cowardly cops standing by would have spoken up like this dude!

I think Canon deserves a better grade. The cop who drove away made it sound like the driver had to do the breathalyzer. Officer Canon, especially after the 1st cop left, had no proof of the driver’s behavior. Officer Canon was making it very clear he was uncomfortable with what was occurring.

I agree, he didn't say that the officer's couldn't use the breathalyzer, he asked if the driver would consent to it. His analysis of Federal constitutional law may have been wrong, but he came to the correct conclusion under George law. It is also not his fault that the initiating officer had too short of a temper. I also don't see any problem in an officer questioning the judgement or orders of their fellow officers while on the scene, if they have the time (such as not being in a grave or dangerous situation), I thought that was what all the audit channels were advocating for.

The officer may be the one civilly liable but the police dept or the city often have insurance policies that they'll use to pay it off for the officer.

Here in New Zealand it's much simpler they just use a sniffer test and if it picks up alcohol on your breath then they give you a breathalyzer which is compulsory.

I feel like there needs to be a D grade for cases like this. It’s fine for the F grade to be reserved for cops whose actions are straight up unconstitutional, excessively violent etc, there needs to be a grade between that and a C- for cops whose actions are “technically not illegal but unprofessional to the point of bringing the department into disrepute”.

The Civil Rights Lawyer also discussed this video. The cop trying to make sure everything about the stop was on the up and up got fired for this stop. The cop that abandoning the stop just because the other cop asked some questions about it call a supervisor while in the car as he was driving off. You can criticize him for arguing with another cop in front of people if you want, but the fact that he got fired for this while other cops shoot people, give people concussions, and get put on administrative leave for a little bit and keep their jobs is telling.

It is not out of Mr. Davis's pocket. Losing qualified immunity means that the case can go forward. Winning the civil case means that whoever indemnifies Mr. Davis pays the penalty (like an insurance company, the city, the police department, all of which actually means the taxpayers pay). There are some exceptions to this such as if Mr. Davis were criminally liable as well as civilly liable.

On the first one you keep coming back to "the driver's exhibited driving behavior" for how you judge the second officer. Neither that second officer nor the supervisor witnessed the driving behavior. The only officer who did see it already said he wasn't pursuing a DUI because he didn't like that they had him working nights and then left. So where would the cops that didn't witness his driving be getting the probable cause to compel a breath test?

Yeah exactly my takeaway too. The only person I'm giving a C or below to is ATA themselves. It's just lazy work to take the word of something not present in the footage. If you are gonna properly weigh on these situations then what the cops claim to be true shouldn't matter. To say Officer Cannon was in the wrong to not escalate the situation is literally advocating for police to use excessive force as long as they get permission from a supervisor.

@seeya205 Nope, the video addresses this directly it's willful ignorance to claim this. The law states there must be proof of lack of control NOT proof that they've had a drink. The guy was coherent, he was able to stand just fine, he knew where he was, where he was going, what he was doing, and why. There was no indication he was under the influence whatsoever. It's extra jarring compared to the second clip where AtA points out how the footage is manipulated to make the officer look better due to the officer muting it as convenient for himself, and him not recording the original altercation. Somehow this isn't extended to the first case where the same conditions are present. This isn't even about the conduct of the cops specifically at this point. If AtA wants to be a trusted source for these things the channel has to remain impartial to what the viewers can see so we are all on the same page. This first clip doesn't clear that bar at all.

"He didn't want to answer whether he robbed that bank, so he must've robbed it!" is almost exactly what you're suggesting

If we used your way of thinking then you could never arrest anyone for drink driving 😂 if everyone who drank and swerved all over the road refused a breathalyzer and said "welp I guess your free to go." If you refuse a breath test typically they take you in for a blood draw if they have probably cause.... Which they did. I should also point out if you refuse a breath test even if the blood test shows legal limit, you still get your license suspended in most states. The bank robbery metaphor is a weak argument. a bank gets robbed, suspect confirms they were at the bank but didn't rob it. Witness account says that's the guy. Gun matches video surveillance.(Even though let's say it's legal to open carry) "Well guys he said he didn't do it let him go" according to you. Your completely missing the probably cause in both instances. Without probably cause, let's say they pulled him over for a light being out and he says he had one beer. Then yes they can't bring him in for refusing to test, as there was no reason to believe he was intoxicated.

The supervisor from the first clip was pretty solid. He asserted his authority and took Cannon aside to remind him that, right or wrong, there's a time and place to argue, and a time and a place to follow through and obey your supervisor. Cannon was VERY held up up on allowing the driver to refuse the alco-sensor, which is great, but he allowed his assertion to disrupt the purpose of the stop, continually repeating it over and over ad nauseum. After Cannon decided to hang back and allow his supervisor to actually complete the stop without interrupting and arguing with him every 2 seconds, the supervisor was able to reach a solution that required no further police interference, and would ensure the safety of the man without infringing on his rights.

"You got a bodycam on" is the question that changed the pace. They should all be recording each interaction with people AND other officers.

The comment on the body cam was to indicate the camera was on upside down, which the officer rotated to the proper position.

I’m with the officer that didn’t want to administer the breathalyzer. First, I didn’t witness the driving. Second, the arresting officer left the scene. Lastly, but most importantly, why are we giving a breathalyzer if we’re not going to arrest the driver if the numbers come back above the alcohol limit? It is the totality of these events that would make me not want to administer the breathalyzer.

The grading on this by ATA is complete garbage. Cannon deserved at least a B. The Georgia constitution backs up what he says about the breathalyzer, which was mentioned, but not taken into account in the grading.

​@bchap1233 Yeah. Cannon gave the man the choice, and the man declined. ATA went through the laws as though Cannon didn't think he could even ask him to do it. I'm not aware of any state where the roadside breathalyzer can be compelled. Implied consent laws usually don't come into play until they're back at the station after the arrest has already happened. As soon as the initiating officer left the scene, the stop should have been over.

In Ontario (and I believe across Canada too) it is illegal to refuse a roadside breathalyzer test and officers are allowed to request a breath sample absent probable cause.

The 5th Amendment is absolutely NOT a " Privilege " but an ABSOLUTE RIGHT. PRIVILEGE can be taken away

That's not the definition of a right. You also have a right to own firearms... until you're in prison. You can't own a gun in prison despite the 2nd amendment. It's not even a question. A lot of your rights are taken away in prison.

​@crazyrobots6565 Rights can't be taken without due process. In order to perform a search there can be only two reasons. One a warrant being issued to perform a search after probable cause or suspicion is established. The second would be a pat down for weapons to protect officers who are concerned about personal safety. Understand though to suspend a right constitutionally there must be due process. Only after you have been allowed to face your accusers and allowed to mount a legal defense and face the accusations that necessitates a suspension of your liberty. Don't forget that there must be a process followed and there must be a lawful and legitimate reason for the suspension. Whether it be temporary or permament.

Officer Cannon is showing that he is improving as an individual amd as a police officer. This is the kind of performance WE WANT and should be encouraging in our law enforcement officers. Fact is that educating people on what there rights are is needed when other cops make requests sound like orders. I'd give him an A.
