Seems like some officers will take the barest pretense of someone violating the law and once you’re over that line, they feel fully justified in taking your life. It’s like they completely forget the context they’re in. She wasn’t kidnapping someone or wildly trying to run people over. At most, it was simple trespass. Sounds like his ego couldn’t afford to let her go even though it was the safest, most logical, least problematic approach.

A personal experience that I think relates to this incident: I worked at an Italian restaurant on Cape Cod for many years. Popular place and the owner befriended all the cops in the surrounding towns, so on any given night there would be several police officers having a bite to eat. As a side note, Cape Cod is a real “Old Boys’ Network” and insular place. One night while I was finishing up closing, two undercover detectives who were big buddies with my boss were casually chatting about what a quiet night is was - so they decided to go up the street and start some fights with folks coming out of the bars at closing. I was pretty shocked, although I’d heard some really corrupt stuff over the years. I mentioned to them that harassing and threatening people who’d had a few drinks was bound to result in a fight and you’re dressed in plain clothes, so the bar patrons you start punching aren’t even going to know they’re hitting a cop. You guys are effectively going to destroy some guys’ lives when they get arrested for assaulting a police officer. The snide grin on their faces was chilling. There are so many dirty cops who love to bully people and abuse their power. Real psychopaths.

I think the officer fired at her vehicle because he was angry. His entire attitude was indicative of someone who is not in control of their emotions. Theresa was wrong not to cooperate and driving away from the officer with her car door wide open was reckless and malicious. But shooting into the back of her vehicle as it was driving away from him is like shooting someone in the back.

I don't think he had probable cause to ask her out of the vehicle, because she wasn't committing a crime. In fact if she had found her keys sooner, she probably could have just driven off. The cop would've been pissed but it's not a crime to drive away if the cop hasn't detained you yet and you are not commiting a crime, thus it isn't considered fleeing.

That Cop escalated that situation from the start and he is 100% responsible for the outcome! If he had grounds to remove her from her vehicle than he should have frisked her and cuffed her then secured passenger till other officers arrived or he could sort the situation out! Then he would have her keys and she would not have tried to leave! The entire interaction from beginning to end was completely unprofessional on his part. He should have led with his name and badge ID and informed them of his bodycam. I don't know if those are rules cops have to follow but I think it's the very least a cop can do in any interaction. Second, he should have dealt with the alleged trespasser and the paintball gun. Teresa was hardly the potential threat at that point. The cop should have called in his supervisor or some higher ranking cop to assist and he could have radioed that in whilst walking to the other side of the car. I don't buy the argument that he only had seconds to make a decision. He had many minutes to make many decisions that could have led to a different outcome. Instead, he decided to overcompensate for being a bicycle cop by power tripping with people who posed little or no threat to anyone. I appreciate Dr. Grande's neutrality, but this is hardly an outlier in any police department. This kind of behavior is encouraged from the moment recruitment begins.

That same standard is true for law enforcement. He had her information and could have proceeded peacefully and reasonably after that fact. If you are in the presence of an armed person berating you and threatening you with bodily harm, such as a taser being presented to coerce you out of your vehicle under duress, your fight for your life begins long before the legal proceedings. Any agreement with the practices shown in this video only lead to violence and horror. If you agree with any of the actions taken by this officer in this instance you are morally broken and numb to the loss of life of this innocent woman and thousands of others slaughtered by police before legal proceedings can ever begin.

A mentally stable cop would either go up & tell them to leave with a warning, or at worst issue a ticket/citation for whatever law they think they broke. And in ideal circumstances the driver could fight to get it dropped in court. I think sometimes willingly giving cops information like "He has a paintball gun" is a bad idea and sets the tone for a downhill encounter. Just tell them if you have a weapon WHEN they ask if you have one. Only give them necessary information. And if they're dead set on arresting you, wait to talk to a lawyer. This lady mixed up when to cooperate and when not to. Telling the cop "he has a paintball gun" yet refusing to give her name, or exit the vehicle, can make the officer think something shady is going on. I have to watch the full footage to have an idea of why she made these decisions, but regardless, she never deserved to be shot.

In Florida my son is being put through an extensive series of aptitude tests, psychological testing and many interviews to join the police academy. They are making certain to not hire anyone who is unstable, unethical or a prior criminal. But I think an attorney can make an argument that she tried to run him down since the car door was open which itself could be presented as lethal force/vehicular assault. But he shot her while she was fleeing. He was way too wound up for no reason in the interaction. Probably power tripping or taking out his life stresses on her. People, when youre stopped by police, just do what they say and the chance that anything bad happens to you is almost zero. Damn near every case that ends like this, the victim is resisting or fighting the officer in some way. Just leave your hands 10 and 2 and keep the convo robotic and pleasant. He definitely scared her. She was probably in fear for her life. Cops are overly aggressive, they lie, they do not care about anyone's safety but their own, they exaggerate everything, and most are not very smart. The door barely touched him and I am sure he would have cried and try to charge her with assault on an officer. Why can't they just be nice, respect people when their rights don't align with what they want someone to do, and do their job peacefully? The "us vs them" attitude and assuming everyone is a criminal has got to stop. He basically shot a woman in the back. She is probably a mother and that officer most likely ruined the lives of many people including children. He should be charged in the same way he would charge someone. With as many charges they can possibly come up with. What a horrible situation.

What about Teresa fearing for her life? This officer threatened her with violence and treated her with no dignity. He told her he was going to make her life a living hell. She asked not to be touched. Maybe in her mind, she thought she was just going to be another person killed by the police. I am a special education teacher who has taught emotionally disturbed students. I have been trained annually not to escalate a situation when a student is in crisis. You speak in a calm reassuring manner. You remind them that they are safe. I have been trained not to physically restrain a student unless the student is a threat to himself/herself or others. I have been punched, kicked, choked, and bit when a student was in meltdown. In these situations, I had to physically restrain them using non-violent MANDT guidelines. When students had to be restrained, they were put in an isolation room that is padded for their safety. People in crisis have a predictable patterns of upset. You do not engage them until they have fully de-escalated. In my 33 years of teaching, I have never touched a student in violence. Why can't officers walking around with guns be taught to avoid conflict rather than escalate it too? I believe it actually help them be relaxed and be in more control. My biggest disappointment after George Floyd was murdered is that there has not been any national standard for training police officers not to escalate and try non-violent tactic first in encounters especially with motorist. At least they should be reminded that every human should be treated like their life matters. It is heart breaking.

If it was true that they had been told not to come back (and that was mentioned in the video so let's assume it's true), why were they there again? Visiting grandma? I love your channel Dr. Grande. My question for you is, are there any cases in which an officer at fault admits fault in the immediate aftermath of the incident? It seems that any given officer’s account of any given incident involving the guilt of someone else is always manufactured by the officer rather than it being a true and accurate account of the situation. And then on the flip side when the officer’s guilt or innocence is on the table the officer once again manufactures a scenario favorable for the officer. It boggles my mind how an officer’s testimony in a court of law is even allowed after so many situations that it rove officers lie all the time.

In my personal opinion there was no reason for this officer to ask this woman to exit the vehicle. He could clearly have asked all his questions with her sitting in the car. I would be reluctant to get out of my vehicle especially at night without a reason such as I am under arrest.

But I've seen cops act this way before in situations, either where they were trying to clear a bus stop of vagrants and drunks, and they would swear at the ones they knew from previous encounters. If that's how the cop treats stops in general, then he's clearly been on the force for too long, and needs to find other work. I think citizens deserve better. The lady clearly pushed all his buttons which is maybe why he focused on her. He should NEVER have stood in a position where the vehicle could have caused him harm. He should have stood away from the open door. I wonder if his anger and frustration with the lady made him overlook other more serious matters hence her sudden desire to depart. This shouldn't be hard to figure out. US police are US citizens just like everyone else, and are subject to the same laws. They aren't elevated to a different set of rules because of the job that they chose to do. If it is illegal for someone to shoot at another person from behind as they drive away, and are no longer a threat, then they should be charged just like anyone else.
