I see many channels with millions of views reading children’s books out loud. Some have included legal clauses within their descriptions and some do not. If it truly was a copyright infringement, wouldn’t KZbin flag the videos? I’m interested in starting my own channel and want to be sure I’m doing things the right way. Thank you!

How would KZbin magically know? They don't have access to the transcripts of the books. Unless it's reported, they can't have that information to know. Having a clause in the description doesn't mean anything, as discussed in this video. Without written permission, it's illegal. And just because KZbin doesn't flag it doesn't mean it's not illegal-the entire point is that unless you get written permission to read a book of any kind out loud in a video, on a stage, etc, you're violating copyright. Hi there! What about if I am not the person reading the book, what if I’m simply turning the pages of the book and the coinciding cassette tape is playing. As in a children’s book and cassette tape. @@Aunt-Shirley then you're violating two copyrights, the audiobook and the book. There's no difference between them, they're all a public performance. Even reading the book to neighborhood kids in your back yard is a public performance and requires a license.

I own a bookstore. One thing that wasn't covered was reading a small excerpt from a book. Creating videos to increase the sale of a book seems like fair use when you only plan to read a couple of paragraphs from different parts of a book as part of a review to sell the book

Because you’re a bookseller, most publishers and authors will be willing to have a discussion with you on it, and if they give you permission, it’s their decision what passages you’ll be able to share publicly. Even as a seller, you still fall under the same rules as everyone else…and you also have the added layer of profiting off those sales, so it’s especially important to make sure you’re getting that writing permission and consent to be reading passages. @@KMRobinsonBooks Did you ever make this video? My search for whether I can read a small excerpt and then comment on how those lines made me feel is what brought me to this video. I think it's intuitive that reading an entire chapter or an entire book on KZbin is a no no. Afterall, if I can come on KZbin and listen to a book then why buy the book? (...adversely impacting the revenues and thus royalties to the author.)

Most of rhe books I've bought for myself and as gifts are ones that I've listened to in KZbin . I would hope authors would grant permission, it makes them$$$. Over the past year alone I've spent a several hundred $ on books I first heard of and listened to on KZbin.

It doesn't make them money. Even if they get a few sales, it's hundreds-thousands of dollars they don't get from people who don't buy it. If a channel is monetized, that person who stole the content makes money off the stolen content. Unless it's specifically from a publisher or author directly, it's likely stolen content, and we 100% do not support that. It literally ends authors' careers.

Hello there, thank you so much for the info. I got my first strike from reading a paragraph from a book that was only 11 seconds. Does that mean even just a quick read can cause this hey or showing the inside of a book that is no public domain?

Public libraries often have reading days where someone reads a different children's book each week. I guess maybe they're asking permission

They are required to since it's a public performance. Most authors and publishers grant permission to libraries, schools, etc.

Summarizing books chapter by chapter is a huge no no. That's infringing on so much. Book reviews as a whole are designed to help people decide if a book is a good fit for them or not, not a summary of the book or the chapters ;) There's a great video listed as the main video on the channel talking about the correct way to do book reviews that might be very valuable for you to check out. Going through a book section by section can most certainly get you in big trouble. We've done tons of episodes on this here on the channel with our lawyer that would be highly informative on why it's not okay to be doing chapter by chapter things with books ;)

A whole book summary is like a 5 sentence overview of the entire book, not chapter by chapter. You are not giving away the details of the book, but can reference the giant over all themes. The entire point is you can't give away the content of a book. Don't break it down it. Think about what themes are already presented in the book blurb...that's the kind of thing you can talk about because that's public information to describe the book.

I’m guessing you are an author based on your passion for this issue. KZbin is full of channels doing book readings. I’m curious how many copyright cases have been litigated against small channels doing book readings by publishers and authors? And of those how many have been successfully litigated? The music industry for years has tried to grapple with copyright issues; some successful some not. But one thing that has emerged is the concept of alterations or transformative works. If a book is written, obviously someone can’t just copy the enter text and publish it as their own since that would be a blatant copyright violation. However, if someone is taking a written copy, and then speaking the copy out loud, or even further, acting the parts of the text out loud, that sounds like a transformation from written to verbal content. Does it not?

If you are granted permission by the copyright claimant, how do you document that in your KZbin video or other online read aloud? Do simply say aloud - I'm reading this book with permission from X? Does it need to appear in text in the video? And, for a children's picture book, is it assumed that a read aloud also includes showing the pictures? Or does showing the pictures require a different approval process? Thanks!

All of that would be covered in the licensing agreement contract and will vary contract to contract. That's something you have to discuss with the copyright holder and you have to make sure is in the paperwork giving you permission to use in, spelling out the very specific capacity in which you are allowed to use it.

So what is considered fair use? I'd like to read just the first page of 200-ish page middle grade novels to get people interested in reading the whole book. Is that okay or not? I've reached out to several publishing companies to ask their permission, but that was back in November, and I haven't heard from any of them. It makes me wonder if they're like, "Why are you even asking about 1 page?" Or maybe that's not the case. Confused. Thanks!

I wouldn't recommend it. Read the blurb that's public on Amazon/Barnes and Noble. Give an overview in your own words on what you find interesting and exciting about the book. If you're excited about a book, the listeners will be too, so tell them all the wonderful reasons they should be reading it, but don't read any of the actual book without express written permission from the copyright holder (you don't want to sour any potential relationship with them or hurt your love of the story when they get upset you did something without permission)

Thank you for this interesting information, but then what about the classics. I mean Shakespeare or Conan Doyle etc for example. Cuz google says: "How long is copyright on books UK? - Literary works are protected when they are original, and the duration will depend on when the works were created, not their popularity at any given point. However, recent works may be protected by copyright until the next century, as copyright lasts for 70 years after the death of the author" or about America: ''One secret of the publishing industry is that most American books published before 1964 never extended their copyright, meaning they're in the public domain today."

We discuss copyright and public domain at length in many of these videos. Things that are out of copyright because they are super old obviously aren't going to have copyright protection. It is your obligation to do extensive research on each individual piece you're considering to see if you legally have the rights or freedom to work with each specific piece.

Question- is it ok to take pics of the pages of smaller kids story books (not chapter books) books with pictures & words. Take pics of these pages, crop & share the pics in order in a post. Is this allowed? I have so many great books from many years of my kids growing up, now they're older and I'm going through these books and just thinking I would really like to share these with other people & kiddos. I think that's a way to do it. Is this ok? Maybe I can start an instagram page for this? Thank you!

That's a massive copyright violation, do not do that without written consent from the copyright holder. So I want to teach English based on some coursebooks. I now know that I can't show the pdf, but how about the examples? If I give my explanation of a certain grammar rule and then use examples in the book which are a single line each. would it be copyright infrigement? Another scenario, if I show the picture of a coursebook on my videos or the pages I'm going to teach for a few seconds would it be an infridgement?

Former teacher here! Make up your own examples to show on screen. You can use similar sentences with the same structural issues to illustrate your point. Don't use their imagery as that would be infringement without properly licensing it (would advise to reach out to company as they might okay it)

All of this seems to cover reading the book and posting a public video. What if I record the book and share it only with my kids using the private listing within KZbin. Before Internet, when I was deployed I used to record books on cassette tape and send them to my kids. I could, of course, do the same thing and send them a copy of the video, but hosting this on KZbin and providing them a private (not just unlisted) link in KZbin. I'm sure I could still go through the process of asking permission and being clear to my usage, but this use case doesn't seem to meet the public reading aspects.

It's up to you to do the leg work for each individual one, it's not the same across the board. You most certainly cannot use a newer printing of any of them as they all have copyright protections; you'll have to find an old one that is in the public domain.

Reprints have their own (much newer) copyright protection. So you can't use Penguin's edition because it's a much newer production covered by copyright.

We discussed this in the video. Everything is protected for a very long time. Things from the early 1900s are just starting to be public domain and not even all of those count. Things from 2007 won't be public domain until at earliest 2087 IF it qualifies at that point.

IT IS COPYRIGHT INFRINGEMENT and up to $250,000 in fines. Just saying "not mine, no copyright theft intended" doesn't mean you're allowed to use it or that you'll be spared legal ramifications. Because if those are the rules we're trying to play by, anyone could walk up to your house and say "I don't own it" and then enter and do whatever they like with no repercussions. A copyright protected book is not yours and you don't get to do anything with it without a license.

I have a set of books from an old true crime author - from South Africa who wrote these books from 1929--1970. He was the reporter for a newspaper in capetown in his time and is long gone. These are out of print and have indepth cases which are fascinating. Should I try one chapter and see if it is accepted?

No, you should not "try it and see if it's accepted"...that's a very easy way to get yourself sued. Never do that without actually checking to see if it's truly in the public domain or obtaining a license. Furthermore, if you Google what year books go into the public domain, you'll see not a single one of those books are anywhere near qualifying, but even IF they were old enough to hit the year for public domain, there are still factors that would keep it out of public domain, so even IF they were old enough (and none of them are) you would still be required to do the work to find out. This is the law and there are no "but I didn't know"s in the law. You will need to reach out to his estate/family to get written permission.

Thank you this is very helpful. I’ve been a viewer of booktube videos for a while. If I were to want to create content, is it okay to show a book? Like perhaps the cover or perhaps read a quote from the book to support point you are making. Or show an image of a quote you highlighted? I will continue to do research on the legalities of this. Of course that's illegal. It's copyright infringement. You do not have the rights to use ANYTHING without the express written consent of the copyright holder. THEY can do what they want...if they want to put it on KZbin, cool, they're the copyright holder. YOU cannot touch it without their permission.

Are of that is super illegal. You would have to pay (a lot) of money to license each individual piece you’d want to read and it would be very unlikely you’d monetize enough to cover the licensing fees when you eventually get monetized. I’d strongly recommend picking something else.

How about if I am reading a book that hadn’t been published in another language and I have translated it (I’m trilingual and do translation and localisation work so I have a few authors who have given me permission but would like to expand)

If you’re translating books, that’s serious violations (unless you were hired by the copyright owner to do so) Absolutely do not do this unless you’re under written contract. Definitely don’t read them in any video/livestream/audio/etc without a license. If you’re translating without being hired to, that’s multiple violations and some serious fines you don’t want to mess with. If, however, you can get hired to translate, that’s a pretty great gig that pays pretty well, so if you’re interested in that and can get in with some publishers, it might be worth your time.

I probably didn't explain clearly but yes, I am the only translator who curated the EN→IT and vice versa book localisation and translation directly for the author. I was employed free lance to work on the project and got permission to use the Italian version ebook but need to have a conversation with the author to see what he is ok with. My main concern is, the original ebook (English) is now on audible and I don't want anyone to think I'm trying to compete with the platform. Must find a way to make it happen without getting myself in trouble! Cheers

I wonder how far this goes with nonfiction because I don't read novels or fictitious work but I read a lot of nonfiction usually historical or political stuff. Considering how controversial political books can be, I can see someone dedicating time and energy into rebutting every chapter or paragraphs of a political book they disagree with. Now I think of it I'm sure that has happened millions of times because at the end of the day they are discussing an idea that is presented in a copyrighted work.

No, that's copyright infringement and can get you sued, fined, etc. Even if you're only looking to read a sentence or two, you need to get permission first because fair use only holds up if you meet very, very specific things, as discussed in the video.

Those are two very different licenses. If you think about it, a public performance is a one-time thing for a specific audience. A reading for KZbin lives on forever, has no cut of date for consumption, has no location, and can reach globally. These are two very different licenses.

You must identify the copyright holder. If it's based off a different language translation, you'll need permission from both the language copyright holder AND the main copyright holder. You should expect to pay several thousand dollars minimum for a public performance. If you want to create actual audiobooks, you can expect to pay much more. The cost will be determined by the copyright holder and will vary from book to book.

So youtube channel like "Buddy Son Storytime" is illegal? it has a huge following. They read childrens books (I don't think it is public domain) and monetize with ads and amazon links. I read somewhere if you have your own intro/outro, you can claim partial money? Not sure how accurate that is.

I'm not familiar with it, but unless they licensed the books, it's highly illegal. There is no partial monetization for this (is for music within the music library under a specific license) and if someone is using copyrighted materials, they're violating the youtube terms of service and can be banned permanently what they're reported.

Both are copyright infringement and illegal without securing a proper license. To find out the proper license you need, you must contact the copyright holder of the book. Public performance licenses only over a single performance in person and can't be then recorded and put online without extra licenses. No, that's major copyright infringement. As we've talked about in these videos, you could use like maybe 5-20 seconds of an entire movie and then comment on it. Even that could be pushing it. You definitely can't play even a few minutes of a movie or show and just "chime in" (or even talk through the duration with it behind you, still major infringement)

Just like with everything else, it passes on to next of kin/whoever they left it to/their estate/etc. It doesn't magically go away. You're responsible for tracking the new copyright holder down.

No, that's not licensing. "Crediting" someone doesn't count for anything, it's still copyright infringement. Licensing is getting written documentation from copyright holder (and is almost always something you have to pay for) and anything else is copyright theft. If they prosecute you it can be up to hundreds of thousands of dollars in fines for you per infraction. Highly recommend you stop immediately and pull any content you've already done like this until you can get the proper permissions from the copyright holder.

Yes, ALL books no matter the size are copyright protected and can't be read in public without a performance license from the copyright holder. Keep in mind, with a novel, you'd likely be reading a few chapters...but a picture book would be the entire thing...so if you're violating the law with reading parts of a larger book, what happens if you're reading the entire book? Think of how bad that would hurt the author. All works are copyright protected, no matter the size ;)

Do you own the copyright? If you do, this isn’t a question, you own it and make the decisions. If you sold the copyright to a publisher, etc, you don’t own the copyright and you have to get permission from them.
