A $20 ham radio from Amazon set to 433.92 MHz Will defeat the door and glass break sensors of a simply safe system. It will overwhelm the bay station and the bay station will not hear the 1 milliwatt Signal that the sensors send out when there is a 5-10 watt radio transmitting nearby on that frequency? There are videos proving this on KZbin from reputable people, including the lock Picking Lawyer. As strongly recommend, people do not touch the system or this brand. I got. Rid of mine as soon as I found out and tested that that trick mentioned above works. Look, defense attorneys try to set absolute criminals free as that individual has a right to a fair trial. So the DA does the same with officers to defend them even if they personally don’t think it’s correct. It’s their job and also to protect the government money they serve. Less money provided because of a lawsuit means less they can spend which could effect their paychecks. It’s not right, just facts.

Suspicion of WHAT???? They can't finish that sentence because there's no specific crime. He's not walking around with a crowbar to break into cars. His actions were not suspicious of a specific crime that they could or would articulate. They created the reason for his arrest by trying to force him to identify. They seized his personal property and wanted to search it without a warrant to find some evidence to use against him. So, "In this day and age" police are allowed to walk up to someone who is committing no crime, demand Identification, and arrest him for "Interfering with police." We are no longer living in a Free Country if this can happen.

The Turner v Driver case: Yes, cops are authorized to detain subjects for investigative purposes, but the cops only detained/“hot boxed” him for the sole purpose of obtaining his ID. The court concluded that there was no investigative purpose, but rather to torture Turner with the hope that he would voluntarily comply. Yes, they were afforded QI from criminal prosecution, but they did agree to a settlement in the civil case. More importantly, they created case law, thus Turner v Driver. What I never understood about this case was at the time of Mr. Turner’s detention, the Texas Identification law, 38.02 clearly states that the only time a member of the public is lawfully required to present ID was when operating a motor vehicle and a traffic stop is conducted, and when the subject has been lawfully arrested. I think there’s something about presenting ID when you are identified as a witness to a crime, but I’m not sure about that one. With that being said, how could those cops be granted QI for violating an established law? It’s not like it’s some obscure law, like eating vanilla ice cream in church is a crime. It’s the law that governs every crack addict/ID junkie in Texas.

That's what the charge is. Suspicion is not a crime so they just book it with obstruction or hindering an investigation. Pretty shitty but usually because of QI they can just book you on charge as long as it's even slightly close to what the suspect is doing.

Suspicion of a crime can be the basis of a Terry Stop. If the cops suspect someone of a crime, they don't need to know you committed a crime. There may be a legitimate excuse for your suspicious behavior, but in some states, you can be arrested for obstruction or other laws if you refuse to provide a name to officers during that time.

@@luciddream2033 In no state do cops not have to have RAS before detaining someone, and if they do not have RAS for detaining someone, they cannot compel someone to give their ID. There's no such thing as stop and ID. The stop and ID just means that if they are detained for lawful reasons, they are required to provide ID if requested. But without RAS, no ID required in any state. Once any suspicion of a crime is dispelled, then any detention after that is unlawful.

I want to see more auditors reply to the "suspicious" argument, "I'm a suspect? For what crime?" Then at least you get it on video one way or the other. Follow-up is "what implicates me here?" Cops are masters of "I'm not saying that," and other evasive language, but a filmed admission of no RAS would help a lot in the courthouse.

An investigation requires that they first identify a crime, THEN look for a suspect. When an investigation identifies a person, then look for a crime, is absolutely a violation of basic constitutional rights and piss poor investigative skills.

@kennyo0079 the measure of if they violated your 1st ammendment rights is "would this have a chilling effect for a normal person" meaning, if this happened to a regular person would they stop doing it even though it's perfectly legal? If yes, then they have violated your rights. If you flip off a cop and they pull you over and arrest you it's a violation because a normal person would be careful not to flip them off (legal) because of that action

Great analysis and fully agree with your grades. I love how you make it clear that RAS could have been possible in a similar situation. The theory of someone casing out a place for a future crime could provide enough RAS, even if the subject was not actually casing the place. And that would be a good lesson for would be auditors. But I do agree with you that in this case, it didn't seem like he could have been perceived as casing the place. I do understand the extra caution by officers in wake of the nightclub attack 3 days earlier.

Ultimately they can stop and detain anyone within hundreds of miles of the border due to the current illegal invasion. Everyone can be detained for the purposes of identification. Illegals have no constitutional rights.

They certainly did NOT know that he was "no threat of any kind". Having said that, they were still absolutely wrong, and were nasty to this gentleman purely for exercising his constitutional rights. That kind of policing has NO PLACE in the United States. But to say that they "knew (full) well he was not a threat of any kind" is just false. There's no humanly possible way for them to know if he is a threat or not. To reitterate, that certainly doesn't give them the right to detain, identify, or harass the guy..and they were flat out wrong in arresting him... Claiming he was "interfering with police" makes absolutely NO SENSE. I can't walk into a police station, make demands of the officers, and then have them charged with "interfering" because they won't do what I'm telling them to do... I mean... that is, admittedly, not a great analogy, but... the point is the same.

Lt. Jim Holcombe retired in 2017. He is a horrible example of why policing as a whole is so corrupt. All the officers on scene will forever think they were right and continue to believe they can demand ID because they have "Terry suspicion", which isn't a thing. They can either have specific individual facts that indicate someone is involved in criminal activity or they do not. We are all dumber if we listen to any of these officers.

I have come to the conclusion that it's not a good idea to ask for a supervisor because you will probably find yourself surrounded by four officers trying to outdo each other in showing how to take control of the situation. This was a prime example of this behavior. The lieutenant went from detention to arrest in seconds.

There is no such thing as a "Stop and ID state". I'm in Louisiana (a stop and ID state), and the police cannot just stop and ID me for no reason. It falls under Terry vs Ohio. They have to have reasonable articulable suspicion that a crime has been, is being, or about to be a crime committed - just like in all the states that aren't 'stop and ID states'. All 50 states require reasonable articulable suspicion of a crime to 'stop and ID" someone, and no state can just stop and ID anyone at anytime for any reason minus reasonable articulable suspicion of a crime.
