My company has sent me a full and final settlement statement after resigning but the amount was not credited in my account. In portal it is showing full and final settlement is completed. Respected team also not responding to mails, what should I do now.

You may write to your Manager or the Management of the Company for intervention. If still no revert, then send all of them a mail stating that you will be serving them a legal notice. You may contact a lawyer. But make sure you have all the proper documentation like accepted copy of resignation, clearance from the company etc.

Hi mam, my brother is working as a c2h, as per employment norms he served 2month notice but the payroll company Is not approving the resignation and the payroll manager said "you should get approval from client manager ", and the payroll managers, hr's not responding to emails. Should I take approval from my client manager? If not please help me on this how to proceed to get my relieving and f&f. He served notice period and since one week waiting for the approvals. From both sides payroll and client playing games on this , due to this my brother feeling harassed and completely mentally disturbed so kindly help me on this.

As per the joining letter, my FNF should be cleared after 2 months of my last working day. Those 2 months has already crossed and now I am chasing them from last 2 months now. Here are my concern: 1. When I asked about my salary slips, she mentioned on email ( I have that email) that when any employee resign we delete their data from our system. It's your mistake that you didn't take your salary slip so we can not provide it to you. My concern is I believe any employee has 100% right to ask for salary slips and HR has to provide that. Am I correct? 2. I have received my reliving letter but they are just delaying my FNF and making excuses from the last 2 months. What should I do? Please also provide answer to my point number 1 as well.

1. It's a matter of will. No company ever deletes the employee records. They just don't want to help you or make your life easier. That's why I have mentioned in my video that you should complete your entire documentation even before you resign, after that nobody cares to help. 2. You can write to them that if they don't release your fnf, you will be sending them a legal notice. Please share this video with all your friends and colleagues so they are well prepared when they resign and don't feel cheated by the company or HR.

Yes, I have seen your video very carefully and since this incident happened with me for the first time so I was not aware about the HR's intention. Well, that's a lesson for me now for future job. Legally, I believe I may send a legal notice to HR claiming my FNF and salary slips as well. What should be the practical action that I should take here? 1. Should I by any mean, first take my FNF amount and then ask for salary slip with written mail that I am going to take legal action against you. 2. Or should I directly send an email saying, I am going to take legal action against you.

@@hrfundas9733 Hi Ma'am, I am currently working in an IT MNC firm as a contractual employee and as per my original offer letter my notice period was 30 days but after joining the company they send us an email stating that the notice period has been increased to 45 days instead of 30 days. Can they do that??? Because we never signed on the 45 days notice period. We only signed our original offer letter which mentioned 30 days notice. I dropped my resignation around 10 days back but my HR and her manager (HR) is not responding to my resignation email. When I call the HR manager, he doesn't answer my calls or texts. I have also dropped him a couple of reminder emails but he is still not responding or accepting my resignation. What can be done in such a situation? I do now want to opt for any legal help since that would bitter my relationship with my current employer. Is there any way I can exit the company gracefully? I am hoping for a clean exit. Please suggest.

Hi, A friend of mine is stuck in a situation in which he didn’t sign any bond or service agreement but the appointment letter says amount of 1.5 lacs is recoverable in case you leave the organisation before 3 years. He first put the papers and the employer did not mention anything about tuis amount and asked him to bring a replacement, he then bought the replacement and did the KT process while serving the notice period. He then asked the employer to relieve him, the employer agreed to relieve him and he served 47-48 days and rest 33 days got adjusted in the FNF. Now the employer is asking 1.5 lacs in fnf in return of relieving cum experience letter. What to do?

Mam, i resigned almost a year ago. Still my f&f amount is due. HR also sent me a calculation of it through mail and said they will pay it in installments..but now they are not responding!

Try to reach out to the Management and explain your case. If still no revert, you may send them a notice through a lawyer.

@@amitlala949 i contacted to the owner of the company and it did worked! Till now they have paid me 3installments and i also get to know that they were completely unaware of it though was told they know everything. So try to contact to the top most level of your company.

Mam my hr told before resignation time your full and final settlement it's done after completing 45 days ....but now 45 days complete and they said wait for 3 months .....I have call recording they said me after resignation 45 days in process to full & final settlement .....mam I what to do mam plss tell me my 3months salary they holding because they said we will do full and final direct .....plsss tell mam I really frustrated ....its very bad situation I have one option showing sucide 😭😭😭😭😭😭😭 plsss help me

You may send them a mail stating if your full and final settlement is not cleared in a week, you will be sending them a legal notice. I hope you have proper documentation of your resignation and clearance...then consult a lawyer and take his advise on how to proceed.

You can tell them if you have a proper reason to hold my fnf then give me in writing otherwise I will have to consult a lawyer

You can take a written approval from HOD or get the HR to sign or acknowledge that your notice period has been waived off by your Manager.

Hi My Employer is denying my resignation letter saying I have to work for 2 years as it was confirmed with me verbally at the time of joining. I have not given any commitments to the management or the HR team. but they keep on insisting that I have to serve full 2 years or they won't be providing me any kind of documentation. I tried to talk with my HR he keeps sending me back to the manager saying without his approval he will not start my relieving process. I am on third party payroll and the manager denying my resignation is from client end. The HR won't listen to me and keep sending me back to the manager. What to do in this case?

You may speak to the Manager in your company and ask for his intervention. If nothing has been given in writing about working for two years, they can't force you, however, they can trouble you with your relieving letter and separation process.

You can send them a mail stating your date of resignation and last date of working. Keep your documentation proper. And give a detailed handover. Keep HR or someone in Management in loop for all your resignation and handover related matters.

Yes they can deduct if there are some dues but they have to give you a proper account of all the deductions.

You can send them a mail stating that in absence of any intimation from the company's end, you will be sending them a legal notice to pay your dues at the earliest. Just make sure that you have the proper documentation like an accepted copy of resignation and approved copy of handover of your responsibilities and company assets. If still no response then you may approach a lawyer.

If you don't clear your dues, they will not give your the relieving letter which is an important document. Some companies ask for relieving letters from all your previous jobs, so you might get stuck. Also, if you ever want to go back to this. Company, they might not consider you. So it's better to clear dues and collect your documentation in time.

You need to ask them why they are not releasing your letter? If you gave a proper handover and complied with all separation procedure, they have to give you the relieving letter.

@@hrfundas9733 at the time of leaving there is a bond of two years which i didn't signed now new hr can't find my full and final settlement but they found my data and also find my last working day and also mailed me the same. They even take my exit interview after i had left. I am ready to clear all settlement but still there is no positive response from their side. What next step can i do for that.

A company can hold your full and final settlement for a lot of reasons, so it's always better to get complete clarity on what are your deliverables before you leave. Also, take everything in writing.

I am a contractor and my client is wipro my contract is over and last working day is july22nd 2021 they are not settled my FFS its already 1 month when i am asking they are saying your timesheet not approved my manager is not approving what to do how can I get my FFS.

Did you get any document from wipro or your contractor mentioning that your resignation is approved and there are no dues? Try talking to your reporting manager in wipro and ask him to get your dues processed....most probably it can be your contractor holding back your dues...you may tell them that you will go the legal way if they don't release your fnf.

Hi, they need to give you sufficient notice and reason for termination unless it was related to integrity. In such cases there can be immediate termination. Check their termination policy, some one from office can help you with the policy
If you do this, don't expect Experience Letter, be safe with Bonus Tip!
