I have 237 acres in Missouri. Constantly adding signs and purple paint. Things were bad for a while, but are getting better. Adding cameras this year. No cell coverage here. Any camera recommendations would be appreciated.

Here in Texas we can have Sheriff's office issue a "criminal trespass citation", not a ticket, but, a warning if violators return, they'll be arrested & charged with criminal trespass...

A judge might or might not grant you a forced-taking and decide how much you need to pa for that easement -- but *you dont walk posted-aand-fenced areas until County Engineer or similar VERIFIES the easement exists AND was TRANSFERRABLE to you...unless you want to end up with a DARWIN AWARD.*

My brother has 120 acres in north wis. He has fenced cattle on the property. There was a guy that bought property next to his and started building a house on it. One day the guy comes to my brother and tells him that his cattle had damaged his big picture window that the guy had to install in the house. My brother went over to see hat the problem was and found out the guy had removed three of the fence post on his property because the guy said he wanted to turn the house to an angle to face the road more. They went to court and my brother won hands down! The judge asked my brother if he would sell the guy the property the corner of the guys house that was on my brothers property. My brother said no. The judge ruled the guy had to remove the portion of the house that was on my brothers property. to this day there is a pile of rubble where that house was and no neighbor.

I watched a guy build a house knowing that half of it was on Conrail Railroad right of way to which the RR had a 500 foot wide ROW but only 1 track. To make a long story short Norfolk Southern aquired the track in 1997 in a merger and had half of the house bulldozed the railroad property where the house was built is unused and the railroad wanted to keep it because it was a land grant given in the 1880's. Other issues with the property also accounted of a wreck that had takern place 40 years ago.

I had a young guy who was drunk spin off the road in mid summer and drove through my barn, left his truck there running, keys in the ignition (obviously), open beer bottles on the seat, and even his wallet was left on the seat. When my son ran outside the guy shouted not to worry cuz he would pay for everything. I filed a report with the Sheriff's dep't and a few weeks got a check for the damages in the mail. That guy and his buddy started coming around and doing hole shots out of my driveway in a brand new Mustang GT. So I let my dog out. She immediately started jumping up on that car and scratched it all up! They never came back. LOL Too funny.

Chad: You did exactly what I would have done. I was with my Dad at his farm once and he found 3 guys fishing his stocked tank and they had shotguns. There was also a No trespassing sign posted. My Dad called the sheriff's department and they got there is less than 20 minutes. They were on private land and they had no fishing license which is a no no. I am glad you kept your calm. I too am always packed and I try to always keep it hidden. Be cool and don't try to be a hero. You did good job. Good for you.

I think you handled that situation perfectly. But for the new land owner and real estate agent I think they were complete morons for how they handled it. I had a similar situation here in New York where I bought landlocked property but the auction company said I had a deed for Rite of Passage so I bought the property and a week later jumped in my truck and took what appeared to be a service road to a locked gate. So I backtracked around for a few until I founda house and politely knocked and a rough all gentleman answer the door and asked me what I was doing on this property. I politely explain the situation and showed him my paperwork. He invited me in funny enough for a cup of coffee and his wife happened to be a real estate agent and explain to me that the auction company was wrong and showed me what the paperwork should have looked like if I actually had access to the property. So they told me right now I legally did not have access to the property and that they would not allow me to go to the property because if I got hurt they could be in trouble. So I respectfully ask them well how can I go about getting access to my property and they explained it was through the courts and I asked them if they would fight me in court just to get access to my property and not disturb any of their property and they said of course not so I thank them for their time and shortly after I had access to my property the legal way and they are great neighbors by the way. You get much better results when u r polite and respectful.

Hey Chad....I know that this is over a year old post , but I felt you brother. I don't own the amount of property that you do because my wife doesn't want to live that far out. I have an easement between my and the neighbors house, up to his driveway. I sat for 17 years waiting for him to buy the back property which would make BOTH OF US responsible for that piece of real estate. I am only speaking now because I let them use that easement to park trucks, camp;ers, etc. trying to be a good neighbor. I was a kid we would knock on our neighbors door and ask to fish a pond, and even ask if we could bring a fish....cleaned to them for dinner. I respect what you have....but because of many anymore (where were there parents to teach them this)....we have lost access of thousands of acres. I try to be a good steward and watch the waterways, the lands, build my family in the ways....ie, we had a land owner who even took the time to build a step OVER his barbed wire fence because he wanted people to have access to the river to fish with their kids. Went back two years later......One of those he let on his property found out by speaking to him and his wife that they were going out of state. They came back and robbed them. They put up a gate like you show....(cattle gate?) Now no one has access. I would like to say that it is just kids....NO it is Adults that do this...and they know better... they need to stop....i learned as a yungun talk to your neighbors ... poperty owners and respect THEIR WISHES. You will generally find if you do that they are very flexible.

My dad built a circular driveway around his home. The neighbor asked if he could use it to put things in his basement. My dad said he could. Then the neighbor sold his home and the new neighbor told my dad to stop using "His Driveway." My dad explained that the driveway was on my dad's property. The guy had a surveyor check and it turned out part of the neighbor's home was on my dad's property. lol

Knew a guy who's contractor started to build his concrete basement to close to the property line. Inspector caught it and so he now has two basements, the first without a roof. When I built my home, I had 6" leeway each side and Inspector made me double check that I was not too close into to the property line.

My parents had a cottage and the well driller put the well on or too close to the property line. It was a good thing the neighbor was nice enough to say it was ok. The pump house was underground but the concrete wall was a foot on the neighbor's land. But underground. If it was someone griedy the story would have a different ending. People back then didn't need permits. So anything went.

My husband and I have twenty acres in Georgia. The two acres surrounding our home is cleared with gardens-flowers and vegetables-fruit trees, a chicken coop with our beautiful chickens, a half an acre fenced area for our dogs, a pool, and a couple of nice out buildings. The other 18 acres surrounding us is heavily wooded. We like it like that. We like our privacy. You can’t see our home from the road having to come down our drive to see our place but that drive is gated with automatic solar gates plus an intercom/telephone entry system. The only other way to get on our land is by foot. We have no trespassing signs up and have the land posted. Two of my grandsons were out in the woods when they saw six men, hunters, who had entered our back acres and put up a deer blind two weeks before hunting season began. The boys smartly just stayed concealed, watched the men finish setting up, then leave walking through the woods off the back of our property. The boys high tailed it to our home to report what they had seen. After documenting the deer blind with our local Sheriff’s department, a deputy came out and took pictures of the blind, we followed his instructions and left a note on the blind informing them had put the deer blind ILLEGALLY on our property and gave them a week to remove it or we would. Now this was a nice raised blind, nothing cheap...a two person, molded plastic, with built in seats. It took the six men to carry it in, even then it had to be difficult through our thick woods but we saw they had done a lot of damage hacking a trail to use. I couldn’t find a double blind to match this one but a single blind made by the same company was $999.99 before tax. I noticed the company would make custom blinds and I’m pretty sure this blind had been specially made so the cost had to be 3-5 thousand dollars. The men had also put in a salt lick to coax the deer to a spot that aligned perfectly with the gun slits in the blind. Five days later my husband got a call from one of the men. He claimed the previous owner of our place had always allowed him to hunt in that location. My husband pointed out they had to see the POSTED and NO TRESPASSING signs when they illegally came into our woods. He said we don’t allow anyone to hunt on our land. The man wanted to draw up a lease to rent the back 10 acres for the hunting season. My husband said sorry but we don’t allow hunting on our property and told him again to remove his blind ASAP. He also told him we had reported what he had done to the Sheriff’s department. The man was really unhappy but the blind was gone in 5 days. My husband allowed him extra time because he needed to get help to carry it out. Our 14 grandkids are out in the woods whenever they come to visit. Their dads go out when the younger kids are out as they are still being taught safety while in the woods but the teens have been educated about copper heads, gun safety, and even what to do if they come upon the occasional black bear. Our grandkids aided by their dads have built well hidden forts and two tree houses on the 18 acres. They have drinks, with non perishable food supplies and TP in the tree houses. We would never allow hunters out there with my grand babies being Daniel Boone on our place. For these men to plan to hunt illegally here, not to even ASK or get in touch with us was totally inexcusable. We didn’t buy their excuse that they didn’t know the place had been sold. We live in the country but this is a small tight knit community...few secrets. My husband talked with our neighbors to the west, the direction the hunters came from, and found out the property owners of the land they had to walk through to get to our place had never given them permission to do so. There are no homes on either place, just over 100 acres total of undeveloped land, so rarely is anyone on the property. These men knew exactly what they were doing. We gave the man’s name and number to the Deputy that had come out. He had a serious discussion with him and the Deputy was also convinced they were trying to pull a fast one.

I had a guy buy a lot next to mine and said he was going to use my driveway and put a gate across it and I would have to come to him to unlock it everytime I wanted in or out. Also told me he was going to hook up to my well for water and use part of my land for a dog pen. Dude thought he was just going to bully me around. Sure shocked him when "someone" called the local city inspector to check his place out. His lot was too small to put a tiny home and was forced to leave. If he hadn't been so threatening and not tried to take overpart of my property then I wouldn't have been forced to pull the stunt with the city inspector.

I had a trespasser on my property. He intentionally applied chemicals to my property with intent to cause serious injury or death. In my case this was one of the good old boys, connected to City and County authorities, he purchased they legally nonconforming lot from the Mayor of my city. My case ended up nearly costing me my life, I followed all standard procedures for remedy, they followed none. To date they have gotten away with taking of my property by force. look at the evidence I have in proving my case, I cannot find an attorney. It is my opinion that the actions in my case are criminal, in violation of Federal law. I believe it is the US Attorneys duty to prosecute under public corruption cause. Let me know any of your opinions, please. I will most likely have to take medication for the rest of my shortened lifetime. @stan d. upnow I have contacted every authority in every dept. all say they do not have the authority to intervene, I most recently had an investigation by the FBI into public corruption, conspiracy against right, deprivation of rights under color of law. This was a joke of an investigation the FBI agent couldn't or wouldn't even acknowledge my right to private property are federally protected, anyways my first comment to the US attorney was how is it that it took eleven years for my complaint to get from the hands of my US Senator Chuck Grassley to the hands of the AUSA. I still have no reasonable explanation for that, there is none. But the US attorney advised me that he was going to use attorney discretion and not prosecute those who violated my Federal rights. I am now being advised to go file some documents at the Federal Court house in my district. My question is how can the US attorney decide not to prosecute when early on there was a civil trial that the court determined in my favor, citing my right to enjoy my own property. So the US attorney can violate my Federally protected rights in spite of a civil court order? Seems like he could be considered a conspirator against my rights with the rest of these imposters.

ANYONE who regularly deals with trespassers knows EXACTLY what you’re talking about. Trespassers who remain relentless once informed can be dangerous. I’ve called the sheriffs out and had the trespassers get belligerent with the uniformed officers. Over post, maintain fencing and gates and keep the sheriffs involved. But it gets very tiring! Safe safe.

I wouldn't refer to your lane or private drive as a road. I would make sure to call it what it is. A Private Drive. Road gives it the impression that it is open for public to travel. A private drive is just that, private. Not a thoroughfare for public to drive on, such as a road, highway, interstate. I think if you consider it and call it a private drive it may help stop some confusion to others. Roads are normally maintained by a government entity. Gravel lanes, asphalt, concrete, ditching, culverts, are things that the government takes care of on "roads" so I would certainly call it a private drive from now on.

This is what I was going to say: call your own roadwork your driveway "why are you parking on my driveway?" and the easement road call it the private road. You call your fields whether crop or grazing your fields - not the park - and your treed parts the woodlot - not the park. It would also have helped here to use a diagram/drawing to map the roadways it would have helped reduce the confusion that was present in many of the comments.Good luck there and be a good neighbour to those who are neighbourly.

This is correct, unless you deed it over the the municipality or the county, it is your private drive......also, if you have given an easement to people you trust, you are not required to offer one to anyone else. If his property is land locked, there is probably an easement somewhere. But it may or may not be on your land....

I hear you on this about how the behavior of these men was illegal however outside of the trespassing and vandalism the owner can take you to court to gain an “easement by necessity” if he’s able to prove that this is the only road to get to his property. Now it’s good that he was very unprofessional about it in the beginning which might help the judge rule in your favor but I wouldn’t be surprised if a lawsuit arises from this and is not ruled in your favor. You have a decent demeanor and handled it pretty well. We use the land for practical purposes like any one else so trespassers safety is a concern too. When we first purchased our land, we were a little mean to people. That really doesn't work. Now, we have a selected approach based on safety and property preservation. Land is posted to the letter of the law x2 posted signs. (No missing the signs coming in). 1. Always approach with positive voice and body language. Ask them if you can help them find what they are looking for. Then politely explain that it is private property. Respect begets respect. 2. If it's kids, they're usually are just exploring. Tell them to respect the woods, don't leave garbage, don't cut my saplings down and above all else, stay safe. 3. If it's adults, most of the time, it's just the same thing. We get hikers, joggers and all the winter travel sports you can think of. Warn them them that at any given time, fire arms may be present on the property. 4. Hunters are a different story. I don't purposely patrol our land for hunters; I let the high and hidden trail cams do that during hunting season. When I do run into them, they are asked to leave. No respect to call the number on the posted sign, no respect for the land or the owner? This is an unsafe hunter who puts themselves and others in harms way. Time to go. I've only had to produce cam art once to the State Police and they just made a cordial, personal visit to the suspects. They have lots of experience with this so; instant non-issue. After awhile, people know what they can and can't do on your land and it doesn't hurt to have a them remember you as a reasonable land owner.

Send him a cease and desist letter by certified mail. Install cameras. Press charges if trespassing persists. File a formal complaint against the real estate agent with his agency and with the National Association of Realtors (if he is a member).

If he gets access you need a road maintenance agreement. My friend let neighbors have access cause their road got flooded and washed out. They never repaired their road. It eventually grew over. Now they destroy his road, never contribute to maintenance. The speed down the road, make ruts that fill with water, then they drive in the ruts making it worse. He is the one who paid for gravel and maintenance. They won’t help.

Although I am a city girl I understand what you’re going through. My late mother always said “ You give them an inch and they’ll take a mile. “. I am now living in the home that my mother grew up in and that my grandparents built back in 1924. Oh neighbors. After my mother passed away and I moved into the house her neighbor couldn’t be nicer to me. When I was out mowing the lawn cutting the hedge he would bring a glass of water out to me and told me to take a break because I was working so hard my face was red. This did not sit too well with his live-in, not living- in, live-in, girlfriend. Oh she hated me and for no good reason. This guy was definitely not my cup of tea but I was nice to him. Here’s getting to the story. After so many problems that I started to have with him that I knew were triggered by his girlfriend so he could show her that he wasn’t interested in me. Trouble began. He put up a 6 foot wooden fence between our houses and our houses are close together. He violated the city ordinance that states the rough side of the fence must face the property of the property owner who installed the fence. I contacted the city and the building inspector said they already okayed the fence. My request fell on deaf ears with the building inspector. So with my camera I drove all over the city and knocked on peoples doors who had the same type of fence. I asked them if the rough side of the fence was facing into their property. They said yes it was it is the ordinance to have the rough side of the fence facing onto the property owners property. They let me take pictures of the front of their homes with the rough side of the fence visible in the pictures. I even drove down the Mayors street and interviewed the neighbors and took pictures. I posted all the photographs on very large mounting boards and brought myself and my two huge poster boards with photographs to the next city council meeting. My very first city Council meeting. I had no idea that all the kings horses and all the kings men were going to be seated at that huge elevated U-shaped council table. I introduced myself presented my case and as I continue to speak I walked in front of every councilmember police chief fire chief and God knows who else was up there and I handed them my poster boards to solidify my case. I had never seen so many board looking people become so interested in what I had to say and so eager to look at all of my photograph. The only one that wasn’t happy was the red faced alcoholic building inspector. He told me that my case was just a matter of semantics. I said “exactly it’s in the building code.The rough side of the fence should be facing his property. “. I won my case. I was not about to let anyone intimidate me when the ordinance law was on my side. That Saturday morning I was awakened by a very powerful sound of a chainsaw. Something you don’t hear in the city unless a tree is coming down. I went to the back door and the sound was coming from my horrible neighbors yard. The bully was chain sawing the brand new fence down to the ground. Instead of turning the fence panels around he chainsaws it all the way down to the concrete that held the posts. I wanted to run over and tell him to stop but I realized that was not a safe thing for me to do. So I said nothing and kept myself safe. His girlfriend came running out screaming at him to stop she asked him if he was out of his mind. Apparently he was. You couldn’t follow the rules of the city ordinance and you couldn’t figure out to just turn those panels around ? What a sore loser. That was insane. Needless to say he got worse. He actually began to stalk my young son and I. It got so bad a friend of mine offered to send him a message. If you have ever seen the movie A Bronx Tale with Robert De Niro and Chaz Palminteri you’ll know what I mean. My friend Sam was just like the character of Sonny in the movie. Nobody got hurt and nobody got bloody. All it took to intimidate this bully maniac was a huge Cadillac parked in front of his house with a huge tough guy knocking on his door and just staring at him. I mean really. No words were spoken no fists were thrown but my son and I were safe after that visit. Man was that a hard time in my life. I kept refusing the help but over two years of harassment by this guy and the chainsaw incident I finally admitted that I needed help as long as no one was going to get hurt. If this guy would have been hurt you know the city would have thought that it was me that did this. No harm done but I was exhausted from the years of bullying. There seems to be no respect left or common decency left in this culture. I enjoyed this video. Plus I am learning a few facts that I did not know about the law as a property owner. The panels of the nice side of the fence we’re supposed to face my property. I was happy not to see him or deal with him but then the idiot chainsaws the fence down instead of turning the panels around. Turning the panels around would have been much easier than chain sawing the new fence down. We have new neighbors now and they are very nice.

We have a large landlocked farm. We have a prescribed easement through two other properties. If the only access to his land is via your road, the court will likely side with him. Title companies aren't a court. You just have to be patient and compromise.

As a sane person, if I came across a road that I'd been told was access to a property I'd bought and it was blocked, I'd simply note down any information available in case I'd like to speak to the owner of the gate - maybe we could work something out or whatever... but until such time, I'd turn around and FIND ANOTHER ROUTE IN to the property I'd bought!! There's almost always some other way to get in, especially if it's a long-standing lot that has been traded several times. So what if you have to drive a few miles out of your way. And to echo what you mentioned - don't buy land sight-unseen, particularly at things like tax auctions. It is still possible that you'll get a parcel that's "land-locked" with no public access to it. Most times you can deal with that by simply speaking to and making an agreement with your neighbors... but SPEAK TO THEM FIRST. You don't just go blithely trespassing on someone elses property!!! What ever happened to common sense and common courtesy?? Sounds like you're doing things exactly right. This guy is probably a land-flipper, and a shady one at that.

People have lost the ability to interact with one another because most feel entitled to their own wants and therefore don’t feel like they need to cooperate with anyone else. I live in the TX boonies and it really surprises me how many folks want to buy hunting land without using a realtor. I'm so glad I did. It was the title company that discovered this place had not gone through probate. Husband had died and wife was selling. Her name was on the mobile home, but it was not on the land. They had bought the land directly from the seller who tranfered the title only in hubby's name and so legally his adult children had inheritance rights, not the wife. Title company refused to insure and seller had to scramble to hire a probate attorney and get this mess resolved. The adult children did sign their rights to the land away, but it was a close call. The escrow period had to be extended. I had decided if the 2nd deadline arrived and the situation wasn't resolved, I would sue to get my money back. I signed the papers 2 days before the deadline. I'm near a tiny town. If I had sued it would have been a major scandal and the seller's realtor would have lost her licence for sure. You can't sell property that you don't have the legal right to sell. If someone doesn't want to use a realtor, at least get a real estate attorney. Protect yourself.

I’m not from Idaho but I can’t imagine the law in NYS is terribly different. I spent 25 years as a police officer in NY. (Talk to a local lawyer there to get info onYOUR laws before you do or say anything) The law HERE pertaining to trespass/burglary is basically you inform someone their right and privilege to be on your property is revoked OR have a posted property (which you already do). You’ll need proof of their trespasses. Game cameras placed in good locations can help. I’d place one at the gate positioned to get plate numbers. Perhaps one to film the stuff you suspect they are going through or vandalizing. It can help to have an attorney send them a certified letter informing them that the land they seek to access is private and the owner (you) does NOT give them permission to go onto your property and that the sheriffs department has been notified and future incidents of trespassing will be dealt with by them and you intend to press charges where appropriate. Keep a copy of the letter, date it was sent, copy of the signed receipt showing it WAS delivered so he can’t deny receiving it, with you so you can show it to responding officers. Keep a notebook with dates and names of officers you’ve spoken to complaining about the trespassers as proof that it’s NOT the first time this has happened. Remember that the cop who down the road has to deal with this will NOT know the entire history of this trespassing and it’s not uncommon for the perpetrators to deny any knowledge they were on your land and deny ever speaking with you about it etc.... If you have “good” neighbors , maybe approach them and ask them to keep an eye out for you and notify you if they see anything amiss. Perhaps they have had a similar thing happen with this guy. Finally a body camera is your best friend. If you have another confrontation don’t be surprised if this guy leaves your property then tries to claim you struck him or threatened him with a gun etc... I’ve seen it happen where the victim (you) suddenly finds himself spending big $ defending himself in court for something he didn’t even do. The body camera is great because let’s say he claims to police he was threatened by you with a firearm. And he’s stupid enough to sign a formal complaint. You’ve got him cold. I’ve never heard of ANY jurisdiction in the USA where falsely reporting a incident/crime isn’t a crime itself. In some areas if the crime you’re falsely accusing someone of is a felony then the false claim is also a felony. While an incident is happening ? Be calm. State things firmly, clearly without showing any anger or hostility. Do not react to threats of violence other than to say you don’t want violence but will defend yourself if attacked. Get it on video and you’re golden. Otherwise it’s whoever calls the police first and can tell the best bs story. I know your intention moving out to this land was to “leave the grid” and leave a lot of this “civilized” BS behind but unfortunately (as every cop in the USA knows) there are assholes everywhere. For all the years that I have lived here on my wilderness farmland in Tennessee, I have come to the conclusion that some people are just down right nosy while always pretending to be illiterate as if they can't read signs & when confronted upon being caught in the act, they even admit to 'just looking around' which is when I tell them to 'go look around' any place beyond the many signs posted at the gate to my property. Yep, if you know you're in the right, lets the cops handle it, it's what we pay them for. Taking matters into your own hands very rarely works out well. The property owner who posted the land sounds like he has a good head on his shoulders. Stay calm, especially if you KNOW you're right, never give the other guy an excuse, and never make yourself look bad. If you go into court looking like you were more than reasonable the judge might even give you attorney fees.

As someone who's gone though property issues this makes me so angry on your behalf. I know this video happened a while ago, but what I have leaned is document, send a formal letter stating they are not allowed on your property again and then take it to court. In my situation my husband and I tried to be nice about it, offered help, tried to be understanding and it just dragged it out unnecessarily. What should have been handled within a couple of months is now going into it's second year because I felt like a bad person taking them to court. It's prevented us from doing a lot of work on our property, which has been the saddest part.

I'm not giving legal advice here, but Google 'implied easement by necessity.' If the person's property is landlocked north of you and using that road is the only way to get to it, then it's very likely a court will allow an implied easement...

It depends solely on the wording of the easement document. That is all that its worth. If its an access easement then they can legally go through. If it was (example only) a sewage/water/electrical service easement then only those utilities have access. Its what type of easement it is.

As long as you make sure you DO own the property you are keeping trespassers off of. Ran into a couple situations where that was NOT the case. After being confronted by a land owner who claimed I was fishing illegally even though it was a public stocked state stream. So, after going to the courthouse and researching I found he only owned ONE side of the stream and I was on the other. I went back, armed this time, with full intent to stand my ground, and you would be AMAZED how reasonable he suddenly became. Do your homework, stand your ground if and when you are in the right. Not only trespassers break the law, land owners will take EVERY advantage if you let them.

The cost of the sign isn't the issue, it's the principle that is at issue. He has no more "right" to write on your sign than you have to write on his house/car. You bought it, it's on your property and if I'm seeing this correctly, he had to trespass just to write on that sign. You posted your land for a reason and people are expected to respect that. Let the cops and/or courts handle it if he continues. Always, ALWAYS look like the reasonable party when you go to court. Too many times guys want to look like "Billy Badass" in situations like this which is the wrong course. Part of the taxes you pay go to law enforcement.....let them do their job and document, document, document. You might also want to think about investing in a game camera. It would be pretty hard for them to dispute a pic of them on your property and if they tell a judge (after being sworn in) they weren't it's also perjury, on top of trespassing. He might have a legal easement to the property located somewhere else. A simple records search with the county should clear that up. I had a similar situation and it turned out the correct paperwork was filed (more than 10 years prior) and the easement was legal. Threatening to go to court is a scare tactic that puts you on the defense. Keep calm, do your homework, and work toward a solution. Anyone can file a lawsuit for anything these days.

There really isn't any "landlocked" property. The courts in every state will usually give an easement through the most reasonable adjacent property to the closest public road. Can be pricey though. EDIT: I feel your pain but I think you're going to lose this one.

You're right man, and I understand how you feel. My property is right off of a field, that connects to a government installation and a lake. I have had several instances of trespassers, who ignored my signs, and decided to make themselves comfortable, in some of my own tree stands! I am always armed also, as they usually are, but I am not as friendly as you are when people trespass. I tell them no arguments, my property is posted, and they wall right by the signs, so they need to leave immediately or I am calling the sheriff's department and game warden out, and having them trespassed, and if they come back out again, they are going to jail. We don't let anyone else hunt on the land either, simply because they always want to bring a friend, and that friend than thinks they have access. Like you, I work hard for my money, and that money was used to buy my property. When someone comes along, without permission, and thinks they have rights to what is yours, you have a right to be angry. My issue started about 15 years ago, when I couldn't find anyone on the property, but I began finding trash and beer cans, where it looks like someone had a chair behind some brush. I don’t know where live, but here what you said is incorrect. In Texas, all sold rights are filed on a deed. Mineral, air, easements. Sounds like you bought contested property. Bad buy. This is an old comment but here in California (I know.... I know), I bought 4 acres. On my title and deed there are no easements listed. However, on my two neighbors deeds, they each have a septic easement taking up 2 acres of my property. The county honored their easements, even though it was not in my deed. The good news is the title company insurance was on the hook for not informing me of these easements on my title report. They had to pay me a lot of money.

Liutenant General i personally would approach them friendly and ask them if i can help them with anything. Then ask if they saw the no trespassing signs, and remind them they are trespassing as well unless they have a warrant to be on my property. (Unless it is a conservation police officer, game warden, state game and fish enforcement) they have a job to do and if they are on my property they have reason.

Lance Sheppard state police, who for the last 10 years have bothered me about a person who dont live here. Apparently hes wanted however this is ten years now and every year this time of year they start scoping my property out looking for him. I feel its not only trespassing but harassment. Ive since found that supreme court rulings like warren vs. District of Columbia (police have no duty to protect and serve, they are strictly law enforcement). Police won't enforce against other police in my area as all "barracks" are still part of the (fraternal order of police)

I think you did the right thing cause you don't know if he really thought that was his road to his property so now just put up about 4 or 5 game cameras around the gate to catch the vehicles and the license plate on the vehicles and around your equipment also in case of future snooping or people stealing!

We have 10 acres, fenced on three sides with no trespassing signs every 100 ft. and a locked gate. People still walk in, over the gate, I guess. I've met men three times with my nine millimeter visible. Always some stupid excuse. I don't want trouble, that's one reason we moved to a rural area...to not be around so many people! I am always armed, and I know how to use all the guns we own. Trespassing here is a serious matter and can end badly for anyone not invited to be on my property. I'd let the sign issue go, but not anything further.

I love this guy! I'm StocktonRob and a combat Nam vet who's 70 and living in Northern Califronia so I ain't gay by saying that! I just mean that this guy is absolutely correct about his property rights and the outrage (very measured and reasonable) that he shows at people trespassing on his property, writing a note on his signage and then rummaging through his construction materials is exactly what would have done, except I am NOT as measured and reasonable as he is. I have PTSD from Nam (spent two full years in combat there with the 1st Infantry Division) and thus have a "low boiling point!" I guess that's why I admired his whole approach to this. I don't attack people but I think I would have been more confrontational with the two men who trespassed and boldly walked past his No Trespassing sign and through his locked gate. StocktonRob

I don't know why they just don't go to the county land & improvements office (different names in different areas), in 10 minutes they will know how to legally access their land. If you are buying raw land that is usually the first thing you ask - where the legal access is from? Is there a road? If not, who's responsability is the cost of the road, etc.

Your 5th Amendment rights were violated. You can sue and include legal costs with damages. I own wooded land surrounded by subdivisions. Kids use my POSTED acreage as their own 'personal green space.' They come on my land to smoke, fight, build campfires and play with their paintball guns. 40 years ago I get a letter from an attorney advising me his 'client' broke an ankle on my property. Demanded to know *who my insurance carrier was* !!! I filed trespassing charges against the precious little angel and the lawyer immediately calls asking " *Sir, WHAT can we do "to make the matter go away* ???" (^: =It is a big deal and being a nice guy will not control it.

You only need to defend your property and show that you hold the title to your land and that there's no part of it showing that you owe anyone access to it. It's your property and your right to say who can and cannot be on it. You said he was there with a real estate agent to sell the property he bought at an auction. He has no intention of being your neighbor, just looking to make money off his investment. I'd say the guy is a bully and needs to be put in his place and you did the right thing by notifying law enforcement and keeping a calm head. Maybe you can acquire the property from him and prevent a future problem from when he sells to someone that thinks they will be building their own off the grid dream home only to learn they were taken by a fraud. As for those of you who think the $1.00 sign being vandalized is petty and that someone walked across your property without permission is petty, how would you like it if someone came onto your property and took a crap on your front porch? It would not cost you anything to just go out and pick up their crap with some toilet paper ($.05) and flush it down your toilet, but you'd probably call the authorities and make a stink out of it (pun intended).

If you have any trail cams, put as many as you can out there around the gate high up in a tree angling down. Those guys will be back soon. You want to document their coming and going for legal reasons, so they can't say "Oh we weren't there." Make sure the camera's time stamps and dates are correct when you set them up. The more accurate your information is, the better off you'll be in court. Also, download whatever images you get daily so that that proof doesn't get destroyed some how. If there is any other way up to his supposed property, show him how to get there. But just keep an eye on that area of your property. Do not tell them you have cameras. Showing up at night is rather strange to see a property. Just keep that in mind. Maybe they're just idiots, but I think you're going to have more problems from them. Get the license plate number of any and all vehicles that show up if you can. The more details you have, the better off you'll be. Oh, and inform your other neighbors that do have the right to go through that gate of what's going on and tell them not to let the guy through. Keep that gate locked all the time. Tell them what kind of vehicle you have seen him in and what he and the "real-estate" guy looks like. Tell them not to get nasty with him, but to just not cooperate with him.

I have property and when I walk it.. I always carry a big rifle. Lots of things in the woods might want to challenge you. You’re well within your rights to be armed on your property.. At least in SC.
