Dear Robert Johnson: I’m going to preface my comments with the fact that I really like Justice Ginsberg, and I strongly agree with her on removing gender bias in our laws. But you don’t have to listen to her for too long to see that she is also playing the game of, “let’s get even.“ I understand that in the main stream public domain justice Ginsburg can do no wrong and she he is the perfect person. But in fact she is like the rest of us, not perfect in her judgment, and this is a strong argument against the concentration of any kind of power, one human over another, which is my main mantra. So now I make a case against her flawed judgment. Possibly this is a capital crime but I will do it anyway! Starting at 27:05, regarding the European court of justice ruling on “roughly” equal candidates for a job, where one is a man and the other is a woman, the ruling was that the woman should be selected every time because of implicit bias, therefore she was likely better qualified, therefore the female candidate should always get the job. Justice Ginsburg sees this as just fine, but it is a moral and logical fallacy. The claim I make is against the notion that in every single case implicit bias exists, and always against the woman. Where is the evidence for this in contemporary times? Certainly it existed in many situations in the past, but in the present? It is impossible to conceive uniform and prevailing prejudice always against women in our present times. Recently I was with One of my best friends, a male manager who hires a lot of people and it was clear to me after listening to him that he favors women for promotion and hiring when they are physically attractive - that came through loud and clear Even though he was presenting himself as the most fair and best manager ever. It seems we need a law that when there are two candidates, and one is an attractive female and the other is an ugly guy, we should always choose the ugly guy because of implicit bias. What about that justice Ginsburg? Justice Ginsburg was on the right track when she talked about the symphony and how the best way to hire was to listen to the musician candidates playing behind a curtain so that you could not see them. Of course this is the right thing to do, and I myself have long advocated for this approach. Justice Ginsburg was a very smart person and Often she was fair and just in her rulings, yet, she was far from good enough to wield so much power (The same for the rest of the justices by and large - I can only endorse those who do not want to wield power, the likes of justice Scalia). The obvious right thing to do when two candidates are so called “ roughly equal in qualifications“ is to flip a coin. And that sums up my opinion of the legal system. As a male, I prefer the flip of a coin rather than “get even justice.” I conclude with this: I don’t have to prove that justice Ginsburg operated on a “ get even” policy. Almost every news report regarding her great career concludes with her own statement, “how many female justices on the Supreme Court is enough? Answer: 9 (all of them)”. While she says this rather jokingly, we know the main point of any joke is it’s core truth. You can just see it in her that she resents the fact that the court was all male for most of 200 years, and now we need 200 years of “get even.” I rest my case for all eternity!

As a Chickasaw and an Oklahoman. The tribes are sovereign. The deal/treaty was to provide the land as a reservation. It was then taken. The case you’re talking about will open up new cases, I’m sure, that will possibly allow convicts to go free (only time will tell), but it also helps start correcting one of America’s original sins by returning the shitty real estate that was given to us.
