Fully refusing to speak at all can get you arrested and charged too, depending on the situation you happen to find yourself in. It's better to answer only what you lawfully must answer, and leave the rest for the lawyers.

@@P3P33U they DID charge her....she got arrested for resisting/not obeying police......the prosecutors decided not to go to court on these charges. she did get a ticket though, so she just has to pay the tint ticket (the letter from procecutors is in this video....)

​@@Tinfoil_HardhatDepends on the judge. Some judges are biased towards the community and don't stand on Court Procedure or Decorum as much. Other's will sentence you with contempt or railroad you into silence because you want to play "lawyer" and want to explain your side in a non-evidentiary hearing.or because you failed to call them, "Your Honor". Every once in awhile a judge comes along that will take the time and ask all of the questions that you might have wanted to ask the Officers that egregiously and ignorantly violate your Rights. Most times their legal representative will defend them using their 5th Amendment Rights. So, see how that works.... sometimes....asking your questions, albeit RESPECTFULLY, allows those questions to be included as Undisputed Facts and therefore the Officerd would HAVE TO answer for them.

He was in reality pissed off that the cop did not tell the person who was pulled over why he was pulled over immediately instead after he was given the drivers license. And the cop other than the seatbelt thing did everything correctly.

Normally I'm with you, but I think Ms. Washington deserves a much worse grade. Calling everyone she knows and ignoring/not complying with the officers is incredibly disrespectful and weird to do. The officers showed INCREDIBLE restraint when she was doing this.

I agree, I feel like ATA has gone a little soft towards his grading of citizens recently. Understanding why someone is upset is different from justifying their actions. Considering that the first cop never even really had to call his sergeant in the first place, they were all very nice to her and she did not reward them for it. Hopefully it won't discourage them from being patient with the next difficult person.-But definitely not sure how she can get basically the same grade as the several cops who issued a rare amount of restraint in comparison to most videos on this channel

And can somebody explain why people put 5% tint on their windows? I have like 50% (came from the dealer like that) and I find it annoying at night. It's not just window tint. Think about the people who refuse to put license plates on the front (and sometimes the back) because it makes the car ugly. Or people who modify the license plate to make it pretty with stickers and such, despite the law saying you cannot do that. People who put covers over their license plates to try to hide them from cameras. People who make illegal mods to cars. It is not hard to keep the car legal. And the people who do it know what they are doing, yet seem always completely outraged when a cop catches 'em for it. When you intentionally break an easy-to-obey law, you are not the victim. Pick your battles. There are laws that need to be broken, sometimes. Window tint ain't one of those.

There are so many instances where police absolutely deserve to be held accountable for really bad actions while doing their job. But we've come to a point in our society where it is in fashion to resist the rest and try to get that $100,000 check! This mentality is getting people killed left and right. And what is fueling this is that there are a lot of cases where the people just did wrong, but they were paid out anyway because it's bad PR and or it makes for good headlines or in this case, a district attorney letter off the hook because of the color of her skin, and a cudgel to beat your opponent politically over the head with. I can’t understand why she needed to talk to her father about this; and was so adamant about not getting the window tested. I suspect it was her father’s car and he knew it was a tint violation. So he told her not to let them test it … and probably misunderstood the law about it too.

Doesn’t happen a lot in my city and state, I get the challengers from enterprise pretty often for a few years for long road trips. And never been stopped yet. The newer ones have surprisingly high fuel efficiency but bleed heat through the hood. I wonder what’s going on?

We had an ancient Toyota Corolla (1973, 3 years older than me & my husband) in the mid to late 2000, it got stopped like nothing else! Record was three times in a week, even my stoic Finnish husband’s sense of humor started to get truly tested by then. Our next car was nearly as ancient Mazda (it had notoriety, you could start it almost with any car key, possibly even with a popsicle stick); same thing, especially when hubby came from work at night. Two times they followed him all the way into our parking lot.. we joked about our magical taillights, that mysteriously stopped working only when officers were around. As soon as we checked them, they were just fine. Like I said, must’ve been magic.. sigh. But as soon as our cars started to get better (less than 10yo Renaults and Opel), the constant pull overs just stopped, almost like pushing a button. What you drive definitely makes a difference, when it comes to cops. Way more than how you drive. Mediocrity rules!

For real this is one of the few gradings I strongly disagree with. She was fine with getting the ticket but not to have the window tested? She knew damn well her shit was illegal and tried to cry racist profiling cop and gain sympathy from daddy and everyone else on the scene. I can commend trying to stand up for your rights but when you do that with a clear misunderstanding of the 4th and 5th and try to weasel your way out of trouble you’ve lost my sympathy. How in the world does she get a B- and they get a B. The police were impeccable here. Gave her tons of chances to comply, called a supervisor, EVEN ENGAGED WITH BYSTANDERS. They could have, if they'd wanted, ordered every Bystander out of the scene, arrested her after a first refusal and impounded the car. The cops deserve an A- for this one. She deserves a D+ at best. She was respectful, but she still was completely resistant without any legal standing behind it. And she's a corrections officer who would probably NEVER allow the prisoners under her charge to get away with her level of non-compliance.

Wrong. Traffic/ state laws do not supercede constitutional law. No where does it say you have to help with an investigation. She literally said "give me the ticket" which she would end up in court either way. This was a power trip because she didn't do what they said when they said it. His comparison of speeding then refusing ID is not even in the same realm. For one, they already have evidence, pacing or R-gun, and have PC to pull over which gives them the authority to detain and makes most commands lawful. If the officer is that unsure that he won't write the ticket then he is actually proving their is doubt and proves the officer has no authority. Y'all need to wake up and realize that officers don't have authority unless the circumstances of PC have been met. They are not all powerful

This means, at the time she was pulled over, for window tint, as the officer stated is primary, the stop should not have happened without some other offense. Using window tint for the obstruction charge still makes it a secondary charge, which is probably why the DA dropped the charges. Worse, the officer takes it upon himself to contact her supervisor, probably in the hope to get her in further trouble for not "obeying" his commands. That now becomes a possible lawsuit for defamation, which was recorded for the record. You might see at least 2 charges, you ignore too many facets of law enforcement, how and where they choose to enforce, which in many states, overly enforces in non-caucasion communities, who face a higher level of fines, jailing, and criminal charges in comparison to caucasian communities. Worse, we allow law enforcement to have much darker tints on both work and personal vehicles with zero enforcement of laws towards them. Good for thee, not for me.

You gave the driver a B-? That was the biggest L (or F in your case) I have ever seen. To sit there refusing to allow a window test simply because she mistakenly believes she doesn't have to, while jeopardizing your job, possibly going to jail, and wasting both your own and the officer's time (and as a corrections officer herself) is a well-deserved F. Neither her nor the numerous goofballs that showed up later seemed to realize a ticket was the worst thing she faced if she simply rolled the window up a bit. Instead, she decides she'd rather risk more than just a ticket. She wants to try for being yanked from the car, jail, ticket, and losing her job? This has to be one of the most idiotic traffic stops I have ever seen.

One thing it seems he failed to recognize is that if it was a regular person not in uniform they never would have given her that much leeway. If it was me they would've jerked me out of that car after 30 seconds. Also, how you gonna give her a b minus when she clearly doesn't know the law or her rights. What exactly about this encounter did she not fail? People not knowing their rights and cops not treating everyone the same is a big part of why situations escalate and why the system is so jacked up.

I've been pulled over for tinted windows before. The officer checked the tint, verified it was too dark, and gave me a warning. Most people who get arrested as this woman did, are more guilty of stupid behavior than the actual violation.

I feel that over tinted windows should be illegal in every vehicle except the back in vehicles that require concealing a persons privacy. Like ambulances for an example.

It 100% is the car. When my Audi was wrecked the rental car agency gave me a charger. One night around midnight I was on my way home and multiple officers passed me going the opposite direction. The last one made an illegal and unnecessary turn and started to follow me. Luckily I was just about to turn into my complex and was able to park and get halfway up the stairs before he caught up. For some reason when he turned into the complex he put his car in black out mode no lights whatsoever and was looking for the car then he saw me looking at him from the stairs and turned around and left. If I had made a traffic violation he would have made contact with me regardless or turned his lights on and try to pull me over. Clearly the car was why I was followed.

It seems to be a corrections officer thing. There was that other guy whose wife failed to stop at a stop sign, failed to stop for the cop, the husband then pretended to be a cop and asked for a professional courtesy so his wife would get out of trouble and then he phoned the cops senior officer and lied. I agree completely, a lot of these videos I look and I say I hope that nobody like that ever works in a police department that I interact with, I would interact with these officers anytime as long as they behave this way. They communicated what they want why they wanted it the answer to everybody's questions that was on site not just the driver or a passenger but anybody that came up they didn't let the situation escalate when it seems like it could have very easily gotten out of control but they maintained their professionalism despite several people coming up and approaching them that were unrelated to the vehicle when it was moving. This is about as good as it could have been of an interaction. I'm not saying that there's not room for improvement because I think everybody has the chance to improve but I'd be proud to have all of these officers on my Police department.

Just give her the ticket and move on. You really think this is a valuable use of taxpayer dollars to waste all this time? No. It wasn't about the upholding the law. Granted they both refused to give in because of their egos, but it would be nice if law enforcement would just be the bigger men and move on.

Further, when he gives police A or higher he sounds almost proud to be doing so. Sometimes he is harsh yes, but he just wants them to do better. MOST of the time the ratings are very fair, you cannot in good faith say "[ATA] rarely gives them (the police) their due".

Why didn't the cop just write the ticket? Seems like his "I have to test the tint" was really just a pissing contest. He didn't want a citizen to deny him anything. He could have easily wrote the ticket and drove away. He turned it into a custodial arrest for no good reason. THAT is why it wasn't prosecuted. Awful use of police discretion there.

The point is it takes only one prosecutor to imprison an individual, it takes 100s to go out an collect or generate revenue for the system. Those revenue collection agents aka members of law enforcement don't have to know the law nor the Bill of Rights, nor the U.S. Constitution. No one is under any obligation to assist, be forcefully compelled to assist with any investigation into themselves or any other person. The Fourth Amendment Secure the People and Their affects I.E. property. If tint on a vehicle is a crime why do law enforcement agencies have it on their vehicles? Is it for officer safety? Equal Application of the law is already encoded in the U.S. Constitution. Policing for profit in the United States of America has to stop. Funny story. My uncle was speeding officer pulled him over. Uncle tried saying he was going with flow of traffic. Later reiterated everyone else was speeding. Precisely - they are enforcing laws for the public that don't apply to them in some cases, in other cases (certain states) there is no exception for dark tint on emergency vehicles and the police simply do it any way. Just write the ticket for the maximum tint and call it a day. Calling her job was just petty, and she should be able to sue him for damages especially if she got in trouble with her job.

@@MoonLiteNite The SGT should be fired. Nowhere in the laws/police standards say you call an employer. A violation to share the information. The SGT has the wrong personality to be a supervisor. He didn't give her enough time to get out of the vehicle. A punk for a SGT.

She is nowhere near mature enough to be a corrections officer. AtA, your grades are the dumbest yet. There's never been a better case for the cops getting an A than this one. They showed patience throughout and treated her with the utmost respect. And the fact that you gave her a passing grade when she jeopardized her career is mind-boggling. So let me get this straight. It is not a violation of the 5th amendment to be required to move your window to assist the police in their window tent investigation. But you do not have to assist the police by performing roadside Sobriety test (stand on one leg, touch your nose white your eyes closed etc). Can someone explain the apparent inconsistency?

Well the thing about the roadside test is that everyone regardless of sobriety or not performs differently and there is no “standard” by which tone measured on since it’s so vague the officer can just decided himself and it seems law makers recognize that and allow you to refuse it because I may have great balance and you may not it’s overall unfair to everyone. Everyone cannot be tested the same way that’s why we have chemical tests which are much more accurate always refuse the roadside do not refuse chemical tests most states will penalize you for refusing the chemical test even if your sober because the moment you got behind the wheel these rules apply to you
