For folks who are short on time but want to really understand the defense position, watch the five defense witnesses in the last three days of the trial. Compelling!!! Why is nobody discussing that there was NO SEARCH of the Albert's house. Notwithstanding that the crime scene was outside, any normal investigator would certainly have secured the house as a possible crime scene and done a thorough search of the house and all of the rooms of the house to eliminate them for being connected to the crime. This case screams COVER-UP and malfeasance by the police and investigators.
@johndevlin6 ай бұрын
I think you're getting ahead of yourself to complain that there was no search of the Albert house. There wasn't even a search of the area where the body was found! Several possible eyewitnesses to the collision (Sara Levinson, Brian Albert Jr., the other people in Ryan Nagel's truck, Lucky Loughran, Caitlin Albert and "Trissy Tightlips", etc) weren't even interviewed until Proctor found out people were getting federal grand jury subpoenas sixteen months after the crime. If this investigation was being done in good faith, in the genuine belief that it was a vehicular homicide, why didn't Proctor ever arrange for a comprehensive search of the accident scene? Why didn't he at least try to interview everybody he had reason to think might have seen the collision? Why wasn't the location of ANYTHING measured? Joe Paul's collision reconstruction is based, in part, on a second-hand *estimate* of where O'Keefe's body had been found. Trooper Joe Paul got it from Lt. Paul Gallagher, who wasn't there when John was found. Some unidentified person told Gallagher that O'Keefe was about seven feet from the curb, and Paul just ran with it.

Prosecution originally thought that Karen ran him over at 12;45am, so the narrative of all the conspirators was that all eyes were on Karen's vehicle constantly at 12;20 through 12;35, thru windows and doors and the car that drove up behind. But when it later came out that Karen was already home and on the wifi at 12;36, and that John had actually died at 12;29am, it was too late for the prosecution to shift all of the conspiring timeline testimonies.

I'm mainly interested in seeing whether the prosecutors will ever show that they're capable of feeling shame. They probably never will; their usual practice is just to ignore new exculpatory information as it arises. But maybe someday? I was looking through the "Statement of Facts" in their last pretrial filing this morning. It says Jen McCabe texted O'Keefe at 12:31 ("Hello"), 12:40 ("Pulll up behind me"), and 12:45 ("Hello"), and that she "observed the black SUV drive away from the house" just after the last one. It's now incontrovertible, from the state's own evidence (Nick Guarino) that the absolute latest Read could have driven away from the house is 12:33 (her first ping off a cell tower other than the one nearest 34 Fairview), and that's if she drove back to 1 Meadows at more than twice the speed limit (there is no evidence that she was speeding at all). So, we know Jen McCabe texted John at least twice (probably three times) after the SUV left. The 12:40 text clearly implies that she can still see the SUV, though it had been gone for *at least* seven minutes. Worse (and I cannot understand why the pretrial filings omit this), she also called his phone seven times during this period, including six times between 12:41 and 12:50. These calls were all deleted from her phone (though not from John's) and she claims they were butt dials. She sent a fricking text after the third call! I think any reasonable person has to admit that this is at least a *bit* suspicious. Incidentally, John's call records also show that he *answered* Jen McCabe's call at 12:29:44 and was connected for 8 seconds. So, until 12:29:52. According to the prosecution's new timeline (from the closing argument), "trigger event 2" (24 mph in reverse) happened at 12:30 a.m. Does this still work? How did Jen McCabe repeatedly miss seeing the body out there in plain view and not 60 feet from where she was standing? What SUV did she see driving away? Was that a different SUV? How come that one didn't see the body on the lawn? She called John at 12:29, got an answer (presumably him saying "I'm here"), then this horrific collision happens at 12:30, then she texts him "hello" a minute later? And she deleted that call? I mean, WTF!?

There was so much misconduct that justice simply isn't possible unless someone comes forward and confesses. The evidence doesn't match the state's story. "Evidence" that doesn't show up until the trial starts? Evidence that's effectively missing from the record for nearly 2 weeks... That's not justice. If the family and friends REALLY want justice, they would be willing to look at the TRUTH, which is he was associated with some super shady people. It's easier to blame a girlfriend that no one likes than it is to admit that the victim's own friends might be the cause. That's NOT justice. If the full Blackbox data had survived, then this would have been over, either Karen exonerated or not. So given that why would Norfolk Co DA/Troopers not pulled out all the stops to preserve it? Why not get FBI experts to do what they do best? Mistakes like that are what leave such Qs in Peoples/Jurors minds. Vinnie, you're missing the point. The defense only has to create "reasonable doubt"; and that just got easier since Proctor has been removed. The prosecutor now has to overcome the FACT that a federal agent (Higgins) went to a US military base to destroy evidence, that State Troopers (Proctor, Yuri, Tully) never conducted an actual investigation (they had Read convicted within 16 hours after only speaking with Alberts and McCabes), and their "expert" (Paul) was not only unqualified, he testified to confirmation bias with zero factual evidence. The reality is that the police never conducted a proper investigation, the DA chose to prosecute despite knowing their evidence was tainted (or worse, falsified), and the O'Keefe family still has to deal with a dead family member that no one seems to care about.

@@ritaeichler2066THEY NEVER SWABBED THE ARM WOUNDS!! Fact!!! They only did one swab of the SHIRT, not the wounds!!! And it showed PIG DNA, it’s common for large dogs to chew on pig ears as treats. I don’t know why/how this much misinformation about the arm is being spread, watch the testimony again if you don’t understand! Wounds were not swabbed. Multiple EXPERTS testified these were dog bites and scratches. When a dog lunges, it is human instinct to throw up an arm to block the face and neck. The wounds are EXACTLY where they would be in a dog attack, don’t believe me, listen to the experts! Attorney Melanie Little had a great interview with a former police dog trainer who had decades of experience training canines to bite. He explained it very clearly, perhaps better than the expert in the trial who was very knowledgeable and qualified having published research on dog bites…..Garrett was 100% sure it was dog bites

@stevenprice69576 ай бұрын
Incorrect. 2 cops did. One was undercover and virtually had to. There’s still data from the phone. What’s it matter. John didn’t move after the crazy reverse. He didn’t go in. It stayed there till John was found and low and behold. The phone is right where he lay. So he didn’t move. I’ll make it simple for you. John’s DNA was inside the housing of the tail light. A drakes tail light. A brand new car. Think about it. It had to be broken with a part of him inside that tail light. It’s very simple.

the truth and evidence you need is; that woman googling 'how long for a body to die in the cold', that the cops in the house didn't go out when the rescuers and police were all over their lawn, the dog they got rid off and the carpet in their cellar they got rid off and all their phones for starters

The jury was confused by the the verdict forms. There is a good coverage of the issue by emily D Baker. Basically, the jury seems to have thought they needed to be unanimous for all three charges to give a verdict. They did not realize they could give a verdict for the murder charges and be deadlocked on the drunk driving charge. There is a motion from the defense EDB covers that explains some of the controversy.

“O’Keefe’s arrival at the Albert Residence at 12:20 a.m., between 12:21 a.m. and 12:24 a.m., Apple Health recorded O’Keefe taking 80 steps (i.e., traveling approximately 200 feet or 60 meters) and climbing the equivalent of three floors with his location data pinging at or near the Albert residence,” the motion continued. “The only reasonable interpretation of O’Keefe’s Apple Health Data, which shows an elevation gain of three floors at or near the Albert Residence, is that he made it inside the Albert’s three-floor residence.” Also, in the morning after his body is found, the data from his phone also matches all of the movements from Jen McCabe's Apple Watch, leading people to believe she took his phone inside the house, as she was caught on dashcam going inside. The first responders so far have all said they never saw his phone, but I've also heard people say it was found under his body.
@milart126 ай бұрын
But how can this data be correct? O Keefe's I-Phone indicates that O Keefe did not arrive at 34 Fairview until 12:24. O Keefe/Read did not leave the Waterfall until 12:12. Video evidence was shown of Keefe/Read travelling in Read's SUV at 12:18, still minutes away from 34 Fairview. Jen McCabe's phone records establish that there was a call to O Keefe, answered by O Keefe, at 12:18:47 in which McCabe provided directions to O Keefe. Brian Higgins texted O Keefe at 12:20-'Where you at" At 12:20, O’Keefe’s cellphone location data shows him on Dedham Street. The address of 34 Fairview Road is entered into his Waze navigation app. When they reach Cedarcrest Road, Read, who is driving, goes past Fairview Road, does a three-point turn and turns onto Fairview. O Keefe's phone information established that he never left the front lawn of 34 Fairview. Why is O Keefe going up AND down stairs? The defense indicates that he was either dragged DOWN the stairs to the basement or UP the stairs where he was beaten by someone inside the house. The prosecution made a compelling argument that the Apple Health data was incorrect and that the device misinterpreted O Keefe travelling in Read's car for ascending/descending stairs. I don't know what you are implying about Jen McCabe taking O Keefe's phone. When? Why?
