It is sick no one has the right to hurt or put thier hands on a woman, no one owns anorher person, these are weak, sad, insicure, pathetic little men and I find it really hard to call them men at all because they are not, the think that you have the right to take someone else's life, someone's life that trust you to protect them, and a lot of times these women are being abused and won't leave, I don't know I just think it's sickening all around.

If this was “self defense”, then why didn’t he say that from the very start to the 911 dispatcher? Like, why lie about that if he was in fact so fearful for his life? C’mon man!! Really? And to top of ALL this, there was a CHILD in the home!!!
@joelsommer5765
@joelsommer5765 3 жыл бұрын
It's obvious this guy was guilty as hell so I'm not talking about this guy, but you'd be surprised how many people who have been in self defense or accident shootings but they still try covering it up because if you can't prove it was self defense or you can't prove it was an accident, you're most likely getting charged with murder. It's happened to many already... Hell there's even a lady in my state who is in prison cause she shot at a burglar who entered her home and killed him... But he didn't have a weapon on him. They claim she didn't warn the burglar she had a weapon so she can't claim the Stand Your Ground defense.

So… the defense expects the jury to believe this self-defense story of the accused when he lied to the police and on the 911 call.
@joelsommer5765
@joelsommer5765 3 жыл бұрын
With this guy, probably not. But you'd be surprised at how many people lie or cover up when they've either killed in self defense or even accident. Cause if you can't prove it was honestly self defense or accident, you're getting charged with murder. Theres sooo many cases of people who are reluctant to even be associated with a killing, even if it was self defense. Plus there's a lot of little rules and regulations and exceptions that go along with the self defense stance or the Stand Your Ground law and if your situation didn't meet all these little rules and regulations, you can't claim self defense.

Grasping straws. Lol I mean there's no way that the gun could be fired from 3 ft away. The physical evidence thus far (as far as the prosecutors opening statement) should prove that she absolutely could not have killed herself by accident or suicide.

No of course it was an accident. He shot her twice as a woopsy. Edit: OK but why aren't there videos? Cause if he shut them off that would add to the premeditation part of the case.

The difference between the prosecution and the defense is miles apart! The prosecution was on the ball, had her opening perfected and presented a crystal clear case. Great job! And then the defense? It didn't sound like the attorney even believed himself! If he couldn't make himself believe the story, it's curtains for the defendant! Woohoo! Go get em!

I really haven't seen any defense (even the reality tv dude) that was remotely effective - public defender or paid criminal defense. They do a marginal job at cross and normally put on a nominal defense, if at all. Granted, if this was your client and he insisted he was going to testify (and you knew he was going to hang himself testifying), would you put much effort in a defense vs cases more "winnable"?

The underlying principle is that every accused is entitled to the best possible defence. That means that (roughly speaking) for every prosecutor, the justice system needs a defence attorney. In some cases, depending upon the nature of the crime, the defence attorney will specifically tell the defendant *not* to tell him/her whether they committed the crime. In other cases (Rittenhouse being a case in point) there's incontrovertible evidence as to the defendant's behaviour. The defence attorney's job becomes the provision of an alternative theory of the "event/s" the prosecution calls a crime. As you can see, the defence attorney does not assume the guilt of the defendant, even if s/he was engaged in the bad act.
@quickchris10
