SpiceDAO raised 2.66 million euros to purchase at auction, a rare book containing the script, concept art and pre production materials for an unreleased Dune film from Alejandro Jodorowsky. This auction estimated the value of the book to be between 25 and 35 thousand euros. They paid 2.66 million euros for it and assumed this would mean they could make animated series based on the book. Unfortunately before spending 100x the value for the book, no one told them this is in fact not how copyright works.

The fact that they're considering BURNING this book, which is one of only two ever made, just to massively increase the value of the NFTs they plan to make of the images inside is a fucking travesty.

It is numbered "5" in a run that Christie's pegs as between 10 and 20 copies. About 1/3rd of the book is already posted online as well. That being said, describing yourselves as fans and then going "ok after we mint NFTs we are going to burn it to create scarcity and drive up NFT prices" is disgusting.

2.5 million euros would have been a great start to making an animated, original IP inspired by Dune. And they'd still have had enough money to overpay for the rare Dune book by a ridiculous amount. But hey, not everyone passes grade school math.

@Rusty00 Well, they did say START making. I'd assume that a budget of two million dollars would at least be enough to get together a good concept, a plan for a series, and a pilot, which could then be shopped around to get backing, or used for further crowdfunding.

@@anon9469 An Attack on Titan episode costs around 300.000 to 350.000 USD to make. That 2.5 million budget would have been good for like 7 episodes and Attack on Titan is one of the top tier animes in terms of animation quality. If they were content with lower animation quality (which is not at all a bad thing for a first time project!) they could have pumped out even more episodes. These guys could have made a short animated serie with this money alone and have everything they needed for a crowdfunding to increase the scale even further. RWBY and The Legend of Vox Machinima are proof of where you can get with crowdfunding should you be able to hype people up enough. Compare RWBY season 1 with subsequent seasons and Critical Role literally asked for enough money to get like one or two episodes of the Vox Machinima campaign and instead ended up with enough to make a whole season.

The thing related to the receipt might be a url to a jpeg, and you're right that will probably dissappear. But you'll always have that nft/receipt to show you bought it! This is clearly a situation where they've bought so hard into the idea of what NFTs purport to be, that its warped their understanding of how physical goods and general ownership works. Theyre literally looking at this physical object like its an NFT (or what the culture thinks NFTs are), rather than just a physical item.

i don't think that this could even be turned into made for public thing the way they want to. they have no licence to do so. owning a book doesn't give you the authorial or publisher rites to disseminate it. those rights lay with the author or publisher till copywrite would run its course.

That's not sad, nor does it boggle the mind, as someone who lived most of their life in Seattle. In a worild where I can literally be bullied for being a history buff by people who claim they are "liberals" just because I'm more aware of how the world works than they are. Remember, there are people who think that all of western education is "racist". It's very easy to be deemed bad person for being honest and trying to help people, and that's probably what happened here. They were warned many times, and the people with those warnings were probably bullied for their good deeds.

What gets me even more is that even if the auction included copywrite to distribute, sell, make derivative works (which at 2.6M, they paid enough for) they would still have to defend themselves from all kinds of challenges for the actual owners of the Dune series who would aggressively defend against a group trying to publish some B version of the universe. There’s no money here, even if they were right about what they could legally do.

what i think is also ass backwards about their logic on copy write is that under their own belief, owning the physical manuscript gives them legal standing to distribute. let's pretend that's true, how would they(edit: a court) verify the ownership if the physical manuscript no longer exists because it was burnt.

In Fact if you buy a jpg, but the person who SOLD you the jpg DIDN'T OWN THE RIGHTS TO IT (AKA they illegally sold a jpg that the rights were owned by a 3rd party) That 3rd party can SUE the seller of the jpg for the illegally obtained money and then have the police confiscate the stolen property from YOU and you have no legal recourse, Because buying Stolen property is also Illegal

I've legitimately considered using my fiancé's artwork to mint NFT's, post and sell them to some cryptobro, then DMCA the living fuck out of them just because I/we can just to prove the point that NFT "contracts" are just code for adding to a database system and not in any way legally binding transfer of copy rights.

These "investors" talked about "community" which is a term used extremeley often in pyramid/ponzi schemes. All of these valueless items getting their values inflated to absurd amounts Not because the item is worth that much, but for as long as the value goes up, there is actual money to be made. During the swan song of the Weimar economy, would you believe that things like stocks and bonds were increasing at an incredible rate? People would sell their furniture, clothes, and anything they could just to get in on those horrendously overvalued intangible assets. Well we know how that turned out, unsurprisingly these intangible assets became entirely worthless and the people with physical goods came out on top. Don't need to tell you what happened after that of course. Which isn't to say that stocks and bonds are valueless, but if you have to choose between food and what amounts to glorified baseball cards, the sensible man chooses food.

I was highly disappointed in the final season. Wasn't as funny as past seasons. Felt like they threw something together just to get that final season out.

After seeing people in the music industry talk stuff up really big like this before anyone's even committed to the project, name dropping like crazy and giving away way too much info that's probably mostly hype, I have an extremely strong hunch none of this will happen. They won't even burn the book, they'll just eventually try to quietly auction it off again at a massive loss after everyone's forgotten about them. I mean, seriously, having seen what I've seen, my immediate thought was "does anyone on that list even know they're scheduled for a meeting with these guys?" Because I have definitely seen that happen before: Artists claiming they had a specific high-profile person committed to a project that the person hadn't ever heard of. This thing is going down in flames.

Books--well, blogs--will be written about the folks who put the money in. And those who took the money out. One migjht argue that there may be some value-add somewhere in crypto, all these nft's and pump and dump shitcoin have no exit strategy beyond hoping there's a sucker bigger than you were. There's huge efficiency. Low friction. So it's now possible to say "sell 1 tenth every time there's a gain of x%...and for that to execute.

This is one of the absolute worst aspects of the NFT craze, IMHO. In some cases people are actually permanently _destroying_ items with tangible intrinsic, historical, or cultural value, just to make a quick buck here and now on a passing fad. And the people buying the NFTs are just as responsible as the sellers. It is literally using your money to destroy value in the world, instead of protecting it.

Trademarks are distinct from copyrights. Copyright protects the creative expression of ideas: and in theory falls into the public domain eventually. Trademarks are designed to reduce confusion in the marketplace: and last indefinitely as longs as the mark is in use. One thing trademarks can not do is actually describe the product. Because their competitors also need to be able to describe similar products with common language.

@@SorarikoMotone That is how the DMCA works. If you make a counter-claim (under the penalty of perjury, and disclosing your personal information) the video goes back up. They then need to sue you in court to keep the video down. Not to be confused with KZbin's automated Content-ID system: that has no way of interpreting what constitutes "fair use". Mere trademark infringement should not trigger content ID though (unless you copy a logo or something).

I like to imagine they had big ideas, as they mentioned in their post, then tasked someone on the team with "Hey go buy it at auction" but instead of biding a fair value they just dumped the whole wallet on it. Then feeling proud the member goes back to the team and exclaims "We got it!". They all happily ask, how much? "2.66 mil". They all unison facepalm and call the person an idiot for not understanding the auction process... Eventually they throw their hands in the air and say "Well it's not our money". They think for a bit.. "well, now we *have* to spend the money (we were going to line our pockets with) selling NFT's to pay for the other items on the project plan.". Enter the media and everyone else: "But you don't own the rights!" SpiceDAO group sighs in shame.

I think you're missing one of the main points about this whole fiasco. No one should have to tell you that you don't own the rights to a story just by buying the physical book. That should be common knowledge to everyone. The part you said about "enter the media" telling them they don't own the rights should never have had to happen in the first place.

In case you aren't aware, the K foundation (formerly KLF) took 1 millions quid (of their own money) to a remote island (in Scotland?) and filmed themselves burning it. IIRC, they then took the ashes and made an artwork out of that which they then sold. This sounds like a dumber version of that.

Jodorowsky’s Dune is different enough from OG Dune that a derivative work can be made if you erase all the references from from OG Dune. However, Jodorowsky DID do that and it’s a copyrighted series as well. So absolutely nothing about their plan will work.

Saqib, who goes by “Soby,” soon after the auction. “But I fronted the $3 million knowing that the community has my back.” A week later, TheSpiceDAO asked its members for $6 million - $3.8 million, after taxes and legal fees, to buy Jodorowsky’s bible, and another $2.2 million to make an animated film inspired by his vision. By the next day, the donations from thousands of friends, well-wishers, and perfect strangers totaled $12 million.

Scanning the book wouldn't be illegal. Museums, libraries, universities...and google...do that all the time. It's what you do with the scans that can get you in trouble. Under copyright, profiting off of them in their unaltered state would definitely be illegal without the agreement of the copyright holder. That one tweet was saying they weren't planning on nft's but instead were going to make a movie based from the book's storyboards. That wouldn't be legal either though. Me making a Harry Potter movie without Rowling saying ok would get me sued before I called "cut". Dune is still under copyright by The Herbert Limited Partnership, and what's in that book have at least two additional copyright holders (Jorodowsky and Giraud). It's odd that these crypto schemes keep coming up with $multi-million "big ideas" but don't talk to lawyers or experts first. I may as well start one of these things and say I'm making a cryptocar that will look just like a Rolls Royce Ghost. It will be the best car in the world, ever. Each one will be individually customized and have rocket boosters and transform into submarines like a James Bond car -- because that would be cool. I do NOT know how a car works (or submarines either), or know how to make one, or have any idea where they would be built or what any of the materials will cost, or understand safety standards or government regulations, or care about copyright, but give me $20 million and I'll work it out later. I swear, it will be the coolest car on the planet. ROFL

i find it ridiculous that century old books that dont be printed anymore cant fall in public ownership in terms of printing rights and anybody could reprint it as long as nothing of the books content is changed. they artificial hold the amount low to push the price up with content was is infinite replicable. absurd.

Not even that, they're publicly recorded as knowing a good spot to view the art. Most NFTs don't even bother to include a hash of the image, just a URL.

I'm more confused on what their end goal was if everything went as it did in their head. I just bought a Harry Potter book so expect a follow up Netflix tv series in which Harry is actually the bad guy and big V did nothing wrong.

I've read too many fanfics to not have wonderful, deranged ideas for a movie. Imagine Slytherins being secretly right all the time. After all wizards feared and hated muggles for a good reason (witch hunts were bad you know). It would allow to build a little more complex and morally gray world But that's not what I want I want accidental N@zi apologia hidden in a movie directed to kids. Something I read in a form of a fanfic Harry bad, Voldie good? What about Harry x Voldie? A beautiful romance with powerful message about love and forgivness There're so many great ideas out there

She literally wrote them into a corner to be the Evil House basing them on preppy bullies in boarding school from her childhood. It makes no sense why Slytherin is allowed to exist in such a state.

They can’t even make NFTs of the pages legally because that would be reproducing a work they don’t have the rights to reproduce. It’s like how the NFL says “Recording this broadcast is allowed for personal use only,” or whatever. If you try to sell the recording you made of an NFL broadcast, that’s illegal.

What weirds me out the most out of all this new crypto stuff going out lately is how much effort these people put into forcing an nft or token into something that has no need for such tech, i mean you could kickstarter this shitty idea and do the animated series and what not and you don't need a token for it, what's the point of the token or the nfts? Is so tragically weird it really makes me feel discomfort.

NFTs are an MLM scam designed to take money from rich idiots who were lucky enough to be early crypto investors who think they are smart investors. It should start to peter out soon as new suckers dry up, and people are left holding the now worthless tokens no one wants to buy.

I think they were conned into it, by the seller or someone working on behalf of the seller. That's the only way I can see a 35k artefact going for 3million, if the seller had someone bidding against these Crypto douchebags. "Hey, if you buy this book, you'll own the copyright and you'll be able to make so much money. Like tens of millions." "Really?" "Yeah!" "For real though?" "Yeah!" "You promise?" "Yeah." "Alright.
