I agree. Republican voters will still have an eligible candidate to vote for in the general election, like they always have. If they can vote for their party's candidate and choose not to do it, that's them making a choice for themselves. People who are disenfranchised don't get to choose.

Hi Al and Dahlia Regarding the 14th Amendment case, I think there may be an example of similar situation from Australia, where I'm from, which might provide some lessons. A few years ago, a few smarties realized that the Australian constitution prevented people with certain types of dual citizenships to be members of parliament. Like the section of the 14th Amendment, this is very clear from the text of the constitution. But Australia's highest court, being the High Court, did the right thing which was ignore the politics completely and follow the letter of the law. As a consequence, a whole bunch of members of parliament had to resign. This was huge. It potentially could have changed the government of Australia. But guess what? We all survived. Members of parliament had to resign, relinquish their citizenships of other countries, follow the rules and rerun for office. And most importantly, our democracy survived, stronger, because we followed the rule of law. Love the show. Thanks.

I honestly find it so utterly mindboggling, how Americans talk about this 14th, section 3. Coz as Dahlia says, the text is very clear, if u go by the law, there is zero doubt.. Yet all I hear is "oh, let the voters decide", "oh, how will Trumps cult react", "it will be political" bla-bla-bla. Its all bs. Either ur a country of laws, or ur not. Like another poster from Australia described, they had a case a few years back, that went solely by the law and meant a lot of MPs having to resign, and they survived. Guess what, America, u will survive following the law. I dont get, why following the law is even up for debate. Its not something, that would even be discussed in any other Western democracy, we follow the law as written, as thats it, politics do not get a say, nor do feelings or what ifs or any of the other bs. How is just following the Constitution as written so hard???

There is an assumption of the prevalence of "good-faith actors" baked into your analysis. To the American public, it's pretty cut and dry. (Of course I mean, to those who think for themselves, not the hat-carrying cult members, they'll do whatever the Emperorange says) But to the Federalist Society who selected the Supreme Court (and the right-wing ecosystem behind the entire process), _any_ challenge to power is just an opportunity to find that one innovative loophole that just needs a little more money to squeeze out... It's a 1789 worldview when it suits them, and if that proves inconvenient, then they switch to the 2540 worldview (632 AfterFord) to get the job done. Capitalism drives innovation, ya know. 🤦

You are missing the point entirely. This whole premise is based off an assumed fact that an insurrection actually took place. Someone just labeled it that, and the left went with it. But what makes that true? I would assume, for the purposes of 'a country of laws', that someone, in particular Trump, would have to be actually charged an convicted of said violation of the law. No one has been convicted of committing an insurrection. As matter of fact, no one has even been charged with it. Lacking that makes the 14th amendment argument irrelevant, and means that not allowing Trump to be president should be decided by the voters. See how that works, you know, in a country of laws...?

Of bringing unhysterical analysis to these highly charged events and making them accessible to us lay people. I'd go so far as to say your shows are pretty good! I think they will be a valuable part of the historical record when we have a chance to look back at these fractious times. Assuming we have a chance to look back from some point in the future. It may be a good thing that the payoff of a porn star goes first in a criminal case - the evidence is incredibly strong, and if he's already a convicted criminal felon, that can't hurt in a general election or in the minds of the public at large - these kind of cases are watched lol it's a shame, but that's the nature of sex stuff, it gets attention... Your first pt is understood. It begs the Q, if SCOTUS judges were subject to threats of violence against themselves, their families and associates from the left, if they ignore sect 3 and allow Trump on all ballots, would their decision be different. The argument to ignore sect 3, no matter 😊the contrived benefit, has to be unconstitutional. If we can select which amendments to follow and which to ignore, we don't have any amendments. This SCOTUS will, IMO, will have spent their legitimacy and the consent of the people will have been dissolved. SCOTUS gonna need an army to enforce their oppressive, unconstitutional rulings.

I want to vote for Obama to have a third term. Does that mean if a State puts him on the ballot, then the Supremes won't order Obama's removal under the Constitution's bar on 3rd terms because it would disenfranchise me and other Obama voters? Roe vs Wade was decided on a broad reading of the 14th Amendment. Dobbs was decided by this SCOTUS on a narrow interpretation. It will be interesting to see which SCOTUS shows up if these insurrection cases make it that far. BTW. My high school US Government class taught the insurrection clause, so, no, some people were aware of it, but that was decades ago.
