The dress has a “puddle” bottom which surrounds the bottom of the dress. The defendant wanted the “puddle”bottom to remain only to be made shorter. The plaintiff thought that a “train” referred to a longer trailing piece in the back only. In her mind, she wanted a “puddle” hem but not a “train.” She was unable to communicate her vision in a way that the tailor understood, and the tailor did not press her for clarification because removing the puddle made sense for a prom event.

If you had showed me that dress and asked me to name what the bottom part of the dress was called I wouldn’t know. A skirt? I definitely wouldn’t say a train. I think of a long piece of fabric at the back of a dress that drags behind, like on a bride at a wedding. I see now that the bottom part of the red dress could be called a train but I wouldn’t have known that before this case. I think the mother and daughter were just confused on the terminology. But in saying that, if I were the mother and the tailor asked me “do you want the train?”, I would hope I would answer “what do you mean? What train?” rather than answering “no I don’t want a train” 😬

Actually it is his fault. He is the expert, not the customer. He should have indicated what he meant by the train just like JM said. I thought a train was the thing on the back of a dress as well. I wouldn’t have known he meant the thing on the bottom.

@@randyholloway920 I agree this probably wasn't his best work, but instead of only looking at the details of this case, I'm looking at him as an individual, as a black business owner, who's been operating as a tailor for 59 years, which shows strong work ethics, and still at almost 80 years old he continues to still work in his craft. He no doubt has seen a lot in his time, and that says a lot about him as an individual.

Someone in an above comment notice that the daughter raised the dress higher on the right side. You can see it tucked in her armpit. This was a con. I’m glad the plaintiff won. Judge, he can't fix it if he threw away the piece he cut off.. She asked him if he had the part he cut off so he could fix it and he said no, he threw it away. The bottom was clearly a sloppy mess even if there was a misunderstanding about the train part. He should of been liable for at least half the cost.

I get what the mother says about a train. An actual train is where the dress is shorter in the front and longer in the back. This dress is a mermaid hem where it's the same length all around but has the waves all around the bottom. Regardless, the hem is uneven and it doesn't zip in the back.

WHAT? There might have been a 'misunderstanding' about the 'train' but more importantly is the question of why is it uneven at the bottom and even more importantly why can't the zipper be done up fully, NOBODY can wear a dress with a zipper, unzipping, that in itself is bad, but he took too much off around the bust, that is NOT something that can simply be put back, and in order to make the bottom even he would have had to take MORE off, making the dress shorter, so he ruined the dress, so she deserved to get some of her money back if not all of it. In order for him to have kept the 'flare' at the bottom he should have shortened it from around the waist, NOT from the bottom and he should be giving back any cut off spare material, otherwise how was he going to 'fix' it if he had already thrown away the spare material, I think he needs to take his retirement...

Too many things not adding up. The daughter didn’t realize the dress was uneven so she was really crying because the dress couldn’t fit. The dress was purchased in April for prom in June. She probably gained weight hence the comment about her hitting the gym and eventually getting a smaller dress.

She said when he was fitting the dress, that he MARKED the hem with chalk, so the chalk should have told them where he was going to cut and hem and would have determined who was at fault, him or her. If he put a CHALK MARK at the very end of the ruffle dragging on the bottom, but then cut off the ruffle entirely, then he would have been at fault, and it would have shown that he did the opposite of what he paid/instructed to do. If he had put the CHALK MARK anywhere else, then she would be at fault for seeing where he planned to cut and hem and not saying anything about it. I'm a seamstress myself, on my receipt I would have drawn a diagram so that we both understood what was happening, and where I was cutting. I think the work was shoddy to be honest. He has customers all day long, whereas she's only attending the prom once in her life, so I think the burden falls on him supposedly having years of experience, to have all parties COMPLETELY understand what the end result will be. Undoubtedly it was easier for him to cut off the ruffle, than to hem it which is a little more complicated. The ruffle at the bottom was the OUTSTANDING feature of the dress, and since it was at the bottom ruffle that was being altered, it was his job to COMPLETELY UNDERSTAND what they wanted done. Also, I ALWAYS save the pieces I cut off, and allow the customer themselves to decide to keep it or throw it.

These type of issues and the moms involved confirm my joy I never had to deal with them as one who didn't have children. It's a prom dress. In the grand scheme I would teach my children ya gotta bounce back from challenges, small (this) and large (death, divorce). It's not Ukraine so keep it all in perspective ✌️🕊️🙏

JM believed that the plaintiff just changed her mind about wanting the train, but I think there was just a miscommunication about what a train was - so that's on her. But i would have been more upset about the dress not even being able to be zipped, if the material was thrown away, was it actually fixable? Evening up a hem may have been a simple thing to do, but it would be even shorter.

I'm a seamstress & a quilter. The horsehair tape causes any hem to appear uneven, which is why it's only used on a full, free-flowing dress where a straight hem is not noticed -- although it should still be cut straight, of course. If the tailor used Tailor's Chalk, as the plaintiff testified, then they all 'visually' agreed, at that time, where the hem would be moved to. The waistline not fitting is a simple fix. Judge is correct. Plaintiff should educate herself, on tailor's terms, before asking for alterations or buy off the rack only. The tailor needs to print out clear & concise notes as many clients do not know the terms of your trade. It's your job to know exactly what it is they're wanting or this is what happens. Whether it's wood or fabric: measure, measure, measure & then cut! 🙂

@@wysiwyget-420 NO EXCUSES. The same excuse could be used for a vehicle sale. I’m timid and didn’t get a mechanic to look at it
