Its not just about self defense. Its your right to own things like that and exercising your rights is a good thing. Many Americans own and use AR 15s for nothing but pleasure and to pass time. Ain't nothing wrong with that. That being said if you have defend you and yours you could do a lot worse.

Militia is defined in law as males 17 to 44, How can it be illegal for a 17 year old tyo possess a firearm? Seems unconstitutional on its face.

It is unconstitutional in the sense that any law which makes it impossible for an individual to fulfill a Constitutionally mandated duty - like militia service - is a violation of the Constitution's Supremacy Clause. As the militia is defined in federal law as males 17-45 and as militia members are required to supply their own firearms, any state law preventing a 17 year old from acquiring a weapon would functionally prevent that 17 year old from fulfilling his legal obligation.

Can it be constitutional to make it unlawful for a person between 21-44 to have a weapon, constitutionally speaking? Apparently it can be unlawful. How? Make a law. Constitution or law, they are just words on paper. Clearly the words in the constitution do not mean what they say. Way too many places and circumstances where a weapon is unlawful. One has to wonder why those arbitrary numbers, 17, 44. Why not 45? Fundamental rights wouldn't seem to come with age, a community standard would though. Just read the law and see how confusing and twisted it is. A person can argue the law applies or doesn't apply. This would be a great precedent for those who want the law to apply and only a minor win for those who don't. Most read the law as not applicable. Guess we will see how a judge rules. Perhaps to your point, name a right that is protected in the constitution but is not or cannot be limited, restricted or even prohibited. Unless someone strictly enforces the constitution above a law, the law applies. Often even if the law doesn't apply it serves the purpose through procedure of creating the punishment without pesky due process needing to get in the way. Kyle could be acquitted on every charge but can you say he has not suffered harm, not been punished for his choices? How many months in jail? How many court introduced restrictions? How much public backlash? If they can't get you on substance they can often get you on procedure. No matter the outcome some people will disagree. The real injustice is in the writing of and application of the law. Unfortunately there are no consequences or remedies for that injustice. It seems since we've made prosecutions on behalf of the people the general rule, prosecutors have eagerly sought to represent the people as a class ( political party) and have declined to represent any individual rights. They might pretend to be representing a victim if it plays well to the emotions but when's the last time a prosecutor thought about the individual as being essential to the public interest? Seems like they mostly care less about the rights of every individual they claim to represent and more about getting a conviction at all cost as if that makes them a winner, a good administrator of justice. Laws make an otherwise lawful action unlawful. Laws limit, restrict or prohibit rights, they don't grant, provide or protect rights. Laws are not your friends, law enforcement are not your friends, government is not your friend. They are all necessary to a community, a society of cooperative order and peaceful coexistence. They are necessary because peace and order are always going to conflict with freedom and liberty. No matter how kind and magnanimous a ruler intends to rule, he still intends to rule. To enforce, to prosecute and to judge. Peaceful, reasonable people compromise rather that engage in conflict. Until at least there is nothing left to give, until they are compromised beyond tolerance. Those who want and demand always want and demand more. When one law doesn't serve to prevent we make two more. When more government leads to more harm we seek more government as the remedy. Always more, never enough. Says a lot about people who want to be in power and those who want more government. There will never be enough for either. Laws don't stop criminals they criminalize people who except for the law would be lawful citizens. Intentional and certain harm justified by prevent possible fantasy harm. The exchange of liberty for the illusion of security, we get neither. A truly successful criminal commits all their crimes in the name of the law. Just some thoughts

@@eshootziscrs2868 We order levels of government, with lower levels of government being subordinate to higher levels of government. Thus any “laws” passed by a lower order of government which conflicts with laws passed by a higher level of government are overruled by laws passed by the higher level of government. The Constitution is the highest law of the land. Thus, any “laws” which conflict with the Constitution are not laws. They may be enforced in the mistaken belief that they are laws, it that belief remains mistaken - no matter how long it takes for that mistake to be rectified. I would further point out that laws which violate the rights of the individual are inherently unjust laws. Indeed, much like unconstitutional laws, they are not laws at all. For government can only possess such power and authority as we, the people, can grant to it. If we, the people, lack the just authority to limit the rights of an individual, we cannot grant to government the just authority to limit that individual’s rights on our behalf. For in doing so government does not exercise authority which government possesses qua government since, being a human created institution, government has no authority qua government. Just as I cannot grant to another person legitimate permission to murder on my behalf, neither can I grant to government legitimate permission to murder on my behalf. Likewise regarding the violation of any other right.

@@flatebo1 Well said. The point I'd still say stands us that these are just words. Police can stop any and everyone for a license checkpoint or DUI checkpoint. The interpretors of the constitution, not you or me but the self ascribed translators, SCOTUS, have determined that these laws do not conflict with the constitution. So when you go on to say that laws are not laws even though they are fully enforced and have the same consequences you are speaking in theory contradicted by observable reality. What you believe sounds good, I take no exception. The reality is not the same in practice as the theory in thought. If these words you gave written were in fact true would we have laws that restrict or prohibit constitutionally protected rights? Do we have such laws? Is this not cognitive dissonance in practice? Btw, the oder of government is actually the opposite of what you suggest. The highest government would be federal. But the constitution gave only limited power to the federal and reserved all other powers to the many states and the people. Federal law may allow open carry with few restrictions. A city ordinance can prohibit open carry period. State laws legalize marijuana, federal law makes it unlawful. Do these conflict? Do they exist? DUI checkpoints were first challenged in a case out of Michigan, Sitz v MI. The SCOTUS determined that they were an insignificant violation that served a very necessary function of government interest and therefore constitutional. Even the Michigan Supreme Court disagreed but the state government, the governor and attorney general determined to fight that decision through the circuit court and up to SCOTUS. DUI checkpoints are constitutional everywhere in the country now. Except in ten states that have found they violate state constitutions including MI which amended it's state constitution to prevent them. Interesting that the state government fought so hard to violate the citizens rights, the highest determiner in the land gave them the authority but the citizens pushed back so hard that the legislature changed the constitution. What is said in words has no practical application in the way that what is done in action might have. Tell me the law is unconstitutional while they place the rope around your neck. The words do not protect you whether promising limitation, regulation or prevention. It's not what the words say as much as the actions taken justified by an interpretation of those words. Yes a law is moot and unenforceable when unconstitutional except that by the time the challenge is heard and decided the harm is done. Just like Reasonable Articulable Suspicion. It is completely at individual officer discretion. Maybe a judge will rule at some future date with deterrence toward the officer or whatever political pressure most sways them. But the time of decision has passed, the violation and harm have occurred. Elijah McClain is still dead and gee it's unfortunate that the officers misinterpreted RAS and got a bit excessive with their force but, maybe next time they will get it right. Better safe than sorry? How do you enforce your words in the face of reality? If I convince you that checkpoints for the most part and RAS in general are unconstitutional how do your words or ideas prevent the harm that is continuously occurring? If I agree that every word you've said is accurate and truthful, what does that do to prevent the violations? What actions do we need if we both agree on the idea. Which laws are you speaking to and what lines determine the demarcation between constitutional and unconstitutional? I personally do agree with what I comprehend from your words. I don't find a solution or suggestion in them just an idea of philosophical thought. Speak specifically to the law in question and point to the specifics of the challenge. This law exist, has existed and has been challenged. Now what? Is this a case that can be challenged up to SCOTUS? Very unlikely in my opinion. Will the courts in the current political and public culture determine the law unconstitutional at a state level? Unlikely. So even if we all agree will that change the fact that Kyle has sat in jail for months and still faces defending himself from these charges under penalty of conviction? Not a single bit unless public opinion creates sufficient political pressure to sway the court, the prosecutor and the media. I really like what you wrote and how you expressed it. I don't find that it addresses the issue but rather the theory behind the argument. You reaffirm my thoughts but address not one part of my comment. Not an insult or offense, but I'd really like to hear the specific arguments as to why it is unconstitutional or why it is allowed as a reasonable regulation on the constitution. Why does, shall not be infringed allow for some infringement but not others? Why do gun laws vary by state and municipality. Why are public government buildings among the most restrictive areas for possessing a weapon even though the constitution really only applies to government violating these rights? When does a property become essentially public for the purpose of the constitutional protections? Why are courts the place that denies individual rights by authority far more than any other place. You have no liberty, no free speech, often only a limited right to silence, no right to report, assemble or protest. No actual due process. And certainly no second amendment right. You can be physically removed from a court and placed in confinement simply because a judge doesn't like what you're wearing or your attitude. What redress do you have? Ask the judge to review themselves? Hope the prosecutor charges the judge? Maybe a higher court will punish.......uh huh. My point being ideas and ideals are very good things to share. Thoughts to offer for others consideration. But until those ideals are made into practical applications they are still just words of theory. As is the truth of recent events, it doesn't matter who votes so much as who counts the votes. It doesn't matter the words you write as much as the actions of those who interpret the words. I do greatly encourage you to stare those thoughts here and elsewhere. It is really a message that people should already understand but need to be reminded of as the foundation for their reasoning. We all need direction, something of an ideal as a goal. But please be careful that the ideal does not become ideological to the extent that the ideal overcomes the individual freedom. That according to Jordan Peterson might be the difference between oppression and advocacy. ( In my interpretation of his words) How can we force a prosecutor to charge a cop but prevent or punish a prosecutor who maliciously uses prosecution for political purpose? I'm not sure we can but I'm certain I don't want it to be possible. I no more want a mob dictating the application of justice than I want power to protect from justice. Nature has a way of balancing things out over time though it also never finds a perfect balance but always changes. We humans don't like that, we like control, predictability, stability and the illusion of security. There in my opinion is the real conflict that does, will and maybe needs to exist. Humanity vs nature/reality. What drives us to overcome nature is what will be our imminent downfall. That we are part of nature our only redeeming savior. Everything between is just riding the scales, seeking an ever changing balance. The balance between need and desire, selfishness and sympathy. Between humanity and nature. The Colorado river is a great example of human progression, advancement and struggle against nature. For all of our wisdom and planning our desires and greed have left us with even more problems than we started with. We've eliminated large natural lakes for farmland. Damned wild rivers to provide water and power. And still nature does what it wants. The farmlands are sinking and drying up. The rivers flooding or drying up. Control like knowledge is an illusion our egos cannot help but perceive as reality. Thank you for the well written reply.

@Rob - We been through this so many times. Militias are not special. They are not peace officers. They are a group of people no different than a club or association. When there's a curfew, you don't go out in public. If you break the law, you're a criminal. Period. I know you think with your "Militia" tshirt, you're special, but you're not When you break the law and harm some one that's a criminal act as well. You keeping asserting otherwise but like so many other ignorant people you can't back it up in anyway except to just repeating it. Like a child having a tantrum and repeating the same thing over and over thinking it will make a difference. Kyle's finding out the hard way that when you violate the law you pay the price. Sovereign citizens keep repeating the same gibberish over and over again and keep losing when they collide with the law. So sad.

The bit that sold me absolutely that Rittenhouse is a legend was when the guy was approaching him with his hands up, whilst Rittenhouse was on the ground, then tried to pull a Pistol on him, Kyle was quicker on the draw and Shot him in the arm. The guy was disabled but still holding a Firearm, Kyle could have followed up, but didn't. He had assessed the threat was neutralized and didn't use any more force than was necessary. That awareness and restraint told me everything about Kyle's character.

On a different thread I mentioned the age of 18 in the statute is coincidental to the age of majority, as many handgun statutes are tied to age 21. In the meantime the 2nd Circuit declared the sales prohibition to u21's unconstitutional, so that aged poorly.

I mentioned in one of your early videos about Kyle that he was legally carrying that rifle. Also under WI self defense law, if Kyle is found guilty of possessing a firearm as a minor, he still the right to self defense if he meets the requirement of retreating, which he also did in the videos.

@Goblin Goblineus As Stalin told us "show me a man and I will show you his crime". Our system is broken and our society no longer agrees on it's norms both culturally and legally. It would be the least violent option for the states to agreed on a divorce. The issue of Kyle vs. terrorist Antifa/BLM is a clear example of this.

I'd be curious to have someone on the show who thinks Kyle is guilty and what legal reasons they have for it- I've been hearing for a year only lawyers on his side which I'm on, but I don't want any surprises.

Totally agree. Laws like these are quite common in states with large rural areas. In which forms of agricultural, forestry and recreational outdoor activities take place. The specific requirements of safety course. Is held strictly in ones ability to obtain a hunting license and engage in hunting. Nothing else. My state, even adults born after a certain date or cannot prove they've held an adult hunting license prior. Must show satisfactory completion of an Approved HUNTERS SAFETY course. To get a HUNTING license. Other hunting regulations apply only while engaged in the act of hunting. There are no laws restricting possession or legal use by a minor in that 16 to 17 years age bracket. Maybe even younger. They can target practice, dispatch critters attacking livestock, shoot intruders or defend themselves. They can carry, transport weapons. But have to be in plain sight, disabled, or under lock if concealed. During transportation. Truly hope this gets dismissed. And this trial doesn't turn out to be another lynch mob, freak show straight out of an old western, or Twilight Zone episode. Like some recent trials have been. And if these people put half the effort into controlling the riots, looting, arson etc. Or the gang shootings going on today. This probably never would have taken place. Also he did not run from police. Or try to hide anything unlike others. Who fled the scene as police arrived. And really don't want to hear the race card crap. Four men at least one being armed with a handgun attacked and assaulted another person. While being backed by a rioting mob. They lost. Now they want to convict him on a bogus violation by a minor. So they can try and convict him as an adult On other crimes. Does anyone else have a problem with this?

One point I haven't seen... after the shooting of skater / club guy and shooting armed bicep guy look some more at the video. There was one more guy approaching from straight in front of Kyle crouched like he might attack, but Kyle swung the rifle from bicep guy and pointed at this possible new threat... the guy raised hands and backed away AND KYLE DID NOT FIRE! That is some excellent firearm discipline in the heat and adrenaline of the self defense moment and shows that Kyle was not out to just shoot a bunch of people.
