MINOR CORRECTION: A barrel under 16 inches would still be in violation of the statute. This is still an irrelevant issue here, as there is no evidence that the barrel is under 16 inches.
Kyle Rittenhouse is accused of killing two people and injuring a third. He is claiming self defense as justification. Some people are saying that because he was a minor in possession of a firearm, that he is not entitled to self defense. This is wrong, and here's why.

Me too, banned forever from Twitter for continuing to tweet about Kyle, in support of him. You can not speak of Kyle in a good or neutral light on Twitt, fbk, or instagram. At all. And if you try to post Kyle's website (has defense funding and merch) here on you tube, it get's immediately deleted.

Notice one of the guys that got shot but didn't die was a felon in possession of a handgun. Only one person that physically attacked Kyle didn't get shot and that's probably because Kyle couldn't determine who it was. Good call on his part for good trigger discipline.

@Simon Says Since the legal or illegal possession of a firearm by Gaige wasn't an issue as to why he was shot, I hadn't looked into that aspect of his past. Gaige actually was convicted (plead guilty) of 941.21(1)(b) and had to, as a result, undergo an alcohol assessment. (He plead guilty to being drunk while armed with a handgun.) If, as a result of the assessment he was committed to an alcohol treatment program, he might actually be federally barred from owning firearms. In any event, he has been convicted of a Class A Misdemeanor. He was a Nationally Registered Paramedic but his NRP certification expired several years ago and is/was not a Paramedic at the time he was shot. If he was "holding out" as an EMT or Paramedic while NOT currently licensed or certified as such in Wisconsin, he could be charged with a crime for that. I checked and Wisconsin EMS licensing has no record of him. So, the good news is that I was misinformed, he wasn't a "Felon in Possession" so on that, I stand corrected.

Unfortunately, there is no such thing as declaring someone innocent. You can either prove that someone is guilty, or you fail to prove that someone is guilty. In the USA, those are the only outcomes. But I do wish there is three possible verdicts: guilty (defendant is proved to be guilty and goes to jail and has to pay back his victims), not guilty (could not prove guilt or innocent, and everyone walks away free and clear), innocent (defendant is reimbursed for all costs, expenses, losses, and is "made whole," while police, prosecution, plaintiff, and false witnesses are charged with perjury and/or fraud).

You tube won't let you post links to Kyle's defense fund website. Even if you use URL shortener. Also, I was permenantly banned from twitter for posting about Kyle. After a few week long suspensions, I'm done. Can't even mention Kyle's name anymore. Poor kid will be demonized for the rest of his life. The family even had to move due to threats.

Wow, it wouldn't let me, either. But some of the terms themselves may be banned. Rosenbaum was a "pee-dough", Huber was a repeat woman beater and "ray-pissed", and Grosskreutz is a burglar who was in felony possession of a firearm.

Just reaffirms what I already understood. Hope Kyle has a hell of a counter suit waiting for them. Because his name was ridiculed in the media, since this happened, and his chances of finding meaningful employment anywhere will likely be impossible, in spite of his innocence. .

Self defense training instructors and gun manufacturers should be scrambling to get Kenosha Kid into their businesses. He's a golden example of both amazing marksmanship and use of proper self defense. We've all seen the videos, the kid's a legend at this point.

This has aged like fine wine; and thanks for doing the livestreams this past week!😃 I'm politically non-aligned, but I'm a fierce supporter of our 2A rights, partly because I'm a woman who's a survivor; and as the old cliché goes, _"God made men and Sam Colt made them equal"_ -- Works for women too. One point of order. A short-barreled rifle can be a rifle with EITHER an overall length of less than 26 inches OR a barrel length of less than 16 inches. It doesn't have to be both. If you have a 30-inch rifle with a 10-inch barrel, it's a short-barreled rifle, as would be a 20-inch rifle with a 16-inch barrel.

@@AlexDerange I don't disagree, and thankfully neither does the judge, who just gave some instructions to the jury that will likely end up with an acquittal on the weapons charge, assuming he didn't dismiss it outright. If I heard correctly, Kyle was using a bone stock M&P-15. Just making a minor correction to Nick's explanation of SBR's/SBS's. I'm an NFA firearm owner, and a gun guy in general, so little things like that stand out to me.

@@AlexDerange and a related note, it sounds like the weapons charge was dismissed. The jury was just instructed to not consider that count/charge. So together with the dismissal of the curfew charge, the defense can now say that Kyle was legally allowed to be where he was, when he was, and that he was legally carrying a legal weapon. The prosecution just took a big hit with that one.

It doesn't. And the Supreme Court wouldn't deny a right to self-defense based on age. The minor-in-possession charge won't be used by the jury to decide guilt or innocence. If so, then appeal.

I was going to mention that objectively Kyle is completely innocent but a Kenosha jury might convict him based on publicity and their perception of him not to mention all the activist pressure, the jury is going to think the entire community is against him when its out of town weirdos and losers from antifa and BLM making a scene. Im also thinking that guy who had his bicep turned into ground meat could look sympathetic and could easily lie on the stand, there is video to refute it but jurors will believe whatever they want to believe they just need an excuse or narrative to hang their decision on. I'm quite worried for Kyle but he's just a microcosm of the dumpsterfire that modern day society has devolved into. Unironically antifa is and the leftist ideologues are proving that the wrong side won the war, all the corruption and modern rot, the enlightenment is over. The promise of a better tomorrow is so thoroughly stamped out that there's not even an illusory image left.

Gaige's defense would be almost as strong as Kyle's. Even Kyle saying he was going to police probably isn't enough to remove the argument he thought he was trying to stop a mass shooter. You have to judge each from within their perception and reasonable decisions made based on it.

CASE LAW - at the time I looked up the case law for the SC of WI. Even if Kyle had the firearm illegally, the binding precedent is that such possession of a firearm illegally does not preclude the use of that firearm in self defense - it does not negate the defense. While - **IF** Kyle was in possession of a firearm illegally - which you pretty well shredded - his right of self-defense utilizing said illegal firearm does not go away. Game. Set. Match. (not bad for a 51 year old 2L) I had to look all this up back when all this happened and my rather (ahem) progressive fellow students were in a frenzy on this subject. I found 3 cases (recent ones) using Westlaw that showed the Wisconsin SC rulings on this very subject.

@Simon Says I'm not sure what you're trying to do here - except string together enough words to paint a negative picture. According to statutes - as others have done a lot of break-downs on what the statutes say as to underage carrying a firearm - Kyle was not in violation of the law for carrying - which surprised me too, but that's where it is. "Negligence" - where are you getting negligence? He was rendering AID - acting as a MEDIC - there is a video of him helping the protesters with medical aid. There is video of him and the others who were guarding the businesses saying and declaring they supported BLM. Did you know any of that? He carried a firearm all night and only then used it when being chased and attacked. Sincerely - do research - and stop coming to a conclusion and then trying to find data that supports what you WANT (feelings over facts). A person who is in possession of firearm illegally can still use that firearm in self-defense. You're TRYING to find ANYTHING to get this kid (now an adult) guilty instead of going in with a blank slate and seeing what the statutes say, what case law says, and then applying that to the facts of the case.

It's always going to be so mind-blowing for me how ardently and aggressively the prosecution tried to hit Rittenhouse with the possession charges, when his conduct was clearly 100% legal in the plain language of the law. I can't believe the defense had to fight so hard and for so many hours just to get this charge dismissed...if Rittenhouse had had a slightly worse legal team he may have very well been convicted on this.

In Wisconsin we have a constitution and under our constitution it says "no person under the age of 18 shall possess a rifle unless for hunting or as part of an armed militia" and seeing how he was carrying a rifle while part of a well armed militia then he is innocent. Growing up in Wisconsin we are raised carrying rifles and shotguns from the time we are 12 years old.

Nick, I find this video to be very disheartening. That's because I've come across a number of people who have been parroting the talking point that Kyle Rittenhouse was in violation of the law. When I share this video with them I get one of two responses. You have those who are only interested in the fact that this is something that Kyle Rittenhouse is charged with. It never occurs to them that a prosecutor charging someone with something that isn't actually illegal does not speak to the guilt of the accused but to the scumbaggery of the prosecutor. The second group of people simply have an agenda and don't actually care what the facts or the law is and claim that they know what they know and they don't have to watch a video explaining the legality. I find it very disheartening because these sort of people are legion. I don't know what has happened in the last few decades, perhaps it has to do with narcissism and the idea that people can have their own truth and bullshit that comes from feminism like "women's way of knowing" which dictates how you feel is more important than fact, but it seems to me it's obvious that we have a huge segment of the population that simply does not care what the facts are or what fair is they are just so arrogant and so righteous that they have absolutely no moral qualms with other people suffering, even dying, for their fucked up excuse for principals. It really makes me reconsider how much I want to engage with a society that insists on making Kyle Rittenhouse the bad guy.

I went through this entire spiel basically right after the incident happened. I even had people try to tell me it doesn't apply because he's from Illinois therefore Illinois law should apply. I'm just sitting there like "Oh okay, I'll just take my motorcycle one state over and when the officer cites me for not wearing my helmet that helmet laws don't apply to me because I'm from Ohio." I'm not even a lawyer and this shit was plain as day to me. Google and a modicum of reading comprehension can make people not look like complete dumbasses.

Update: Nick agrees with my interpretation: 10:00 To clarify the definition of an SBR: The statute clearly says ‘OR’. 1) If the overall length is less that 26” then it’s an SBR. OR 2) If the barrel length is less than 16” then it’s an SBR. EITHER of these conditions make it an SBR. A 30” rifle with a 2” barrel would be an SBR and illegal. A 25” rifle with a 17” barrel would be an SBR and illegal. But Kyle’s gun was NEITHER so he’s innocent 👌

I think the problem is that with the hunting portion is that people think the gun is allowed because they might be hunting. This isn't the purpose of the law. The law is allowing a gun charge should someone be hunting illegally. The point is that they aren't banning guns rather allowing another gun charge for illegal hunting. That isn't how the anti gun side wants to understand the law.

There is NO more traditional use of the firearm, than to protect the local community from bands of criminals. It is in EVERY way the exception listed in 3 (A). It absolutely DOES apply.

Kyle should sue city officials for being put in that position in the first place. The city officials failed to protect the lives and property, of the citizens of Kanosha. Officials instructed law enforcement to stand down and for that, those officials should be held liable for their actions.

Wouldn't the "or" mean if it falls short of either of those lengths, and not both? Like, you could have a barrel length of 16 inches, but if the overall length is still under 26 inches, it's still technically illegal? Same with the statutes. I read that as it applies to 941.28 OR it applies to BOTH of the other two.

I think hes innocent I've watched videos of this kid and really he was out trying to keep his community from going all to hell putting out fires and yes during riots and helping I would be armed also just incase people wanted to fight me for being a good samaritan. He helped some person with a broken/twisted ankle he put out fires in different places and the whole argument started because he put a dumpster fire out that a mob was gonna use to destroy a building I believe gas station or convenience store but if they did that to your town wouldn't you try to protect your community's businesses?

When did Wisconsin return a warrant? I believe the Illinois arrest was unlawful and the judge should be disbarred for signing the warrant! Just saying.

You are still tilting at that windmill? The defense team has let that go and isn't going to waste any effort on it because it is not a winning argument. Kyle voluntarily informed Illinois police of actions that provide probable cause for arrest. That means Illinois did not have to wait for Wisconsin to produce a warrant in order to arrest him, they only had to wait on it to extradite.

@@troycates8504 the state statute they use is 725 ILCS 225/13. Anyone from the Antioch PD or the local DA's office who watched the recorded Antioch PD interview with Kyle satisfies the "any credible person" requirement, and their knowledge to charge in accordance with the statute comes directly from Kyle's own statements. This is law that has been on the books for more than 50 years and has passed judicial scrutiny. Find a different giant to slay, this one is clearly a windmill.

I may be getting the facts wrong but there was no warrant for his arrest in Wisconsin until the day after his arrest in Illinois. Which is not authorized be the statue that you cited.

Kyle was on perpetual retreat from the moment he was charged at by Rosenbaum. After killing R, he was chased by a mob and retreated. When taken down to the ground on the street, he could not retreat any farther before jump-kick man connected, Huber attacked him with the skateboard and Grosskreutz raised and pointed his weapon. Collectively or individually, Kyle had fully retreated in as much as retreat was available to him.

How does a licensed attorney in a specific state apply to represent clients in other states? I ask this because the content I watch on this platform produced by other attorneys is more informing and presents more of a defense for Kyle, than the courtroom video of his attorneys actually defending him. This is a major case for self defense and hold major implications for all legal gun owners.

@Arrogant Australian Socialist of Victoria intent doesn't really matter in those cases, us law defines a firearm receiver as the part which contains the bolt or breachblock and firing mechanism and which is usually threaded for receiving a barrel. The AR lower receiver only meets one of those things, housing the firing mechanism. The upper receiver houses the bolt and receives the barrel. Neither part meets the definition. Also they are made of aluminum.

I know a guy whose record was squeaky clean, never committed a crime, who when the police made a traffic stop and ran his license and CPL status discovered that his CPL license had expired twenty days before on his birthday, unbeknownst to him. The officer asked the man where he had his weapon. The man answered, "In my vehicle console." "May I look in the car?" "Sure" he answered. Minutes later the officer approached him and instructed him to put his hands behind his back and was cuffed and subsequently arrested and charged WITH A FELONY FOR POSSESSION OF A FIREARM WITHOUT A LICENSE! The man had forgotten that this was the FIVE-YEAR RENEWAL YEAR. He had moved four years prior to this event and never received a renewal notice at six months and three months before expiration. The man is a widow and has four young homeschooled children at home and they are a church going family. He had spent the night in jail and was appointed a lawyer and posted bail the following day.
