I could be convinced on forfeiture if they had to prove guilt first rather than starting with the presumption of guilt and trying to force to prove innocence. This case is especially egregious in that he had proof on hand to prove the money innocent and dispel any reasonable suspicion, but that was ignored as they wanted to steal the money from the start.
@cjdefrain

If civil forfeiture was attached to provable drug cases only it would be fine. But as usual the law was a knee jerk reaction written way too broadly. Law enforcement should have to prove that money is attached to a specific drug deal. The drugs should be the main focus, not the money. I agree as written it has to go!

They play the whole drug dog routine then and the dogs are trained incorrectly and that little tidbit about cocaine being on most bills makes this whole thing unlawful. We need to help and put pressure on the civil rights lawyers to start going after the companies and or people training the canines since both the cops with QI and a dog can't be held liable but they can. This will ultimately end the practice. A similar premise although different set of circumstances to how breathalizers are now not verifable evidence or cause to be used in traffic stops because they were faulty and/or abused to create a faulty reason to use the law in an unconstitutional and unjust manner.

End qualified immunity! Make each officer personally liable! Take settlements out of the corrupt police union's pension fund instead of from innocent taxpayers. Maybe when cops are liable for their misconduct instead of innocent taxpayers, (even if it's just 10% of every settlement be taken from their pension fund and the rest by each officers personal "shield" coverage) they'll cast out the bad apples instead of protecting them.

Legislation needs to be passed country wide that if police seize money using forfeiture and can't prove its part of any crime within a certain amount of time (2 - 4 weeks), then money has to be returned and the officer who took it be charged for theft. And if its over $5000, then it be a federal crime punishable with minimum of 10 years.

Problem is its civil and like you said legislation would need to be passed. Government moves too slow, we need age and term limits because the criminals and corrupt officials are gaming the system quicker than the rules can change but there is a secret war on cash at the very top. Note that it is possible to complete the Police Academy prior to applying for a police officer. In short in just over 3 months to about 5 months we have some of the lowest educated people becoming police officers in the USA. It is little wonder they make so many mistakes and a well educated citizen will generally know more than they do in knowledge of the law.

I wish more people knew about asset seizure, aka stealing your cash on the side of the road. Anyone travelling with cash and pulled over is at risk of losing all of it. "We suspect it's drug related" is all they have to say and your money is gone, and good luck getting it back. It's legalized theft, plain and simple.

They will then just do the whole drug dog routine outside the vehicle anyways and since 9 times out of 10 the dogs are trained incorrectly, plus the fact that most bills contain drugs on them you know the dog will hit or at least they will say it did.... We need to help and pressure the civil rights lawyers to go after the parties training these canine units since the cops have QI and a dog can't be held liable for inpropriety. This will lead to some chilling disclosures and there is plenty of evidence out there to show canines are unreliable and abused in a way similar to how breathalizers were years ago until case law ended that practice nearly over night.
@BouillaBased
@BouillaBased 10 ай бұрын
They didn't have any reason to call a dog. They stopped him for following too closely. If he had kept his mouth shut, they would've had only the time necessary to cite him for that. Any longer, and it would be a Fourth Amendment violation for unduly extending the duration of his detainment. They hadn't said a word about drugs until he said he had money, so they can't even fall back on lying about smelling marijuana.

I've never been able to find any laws pertaining to using signal without turning/"where there isn't a place to turn". I've actually dealt with similar scenarios pertaining to police abuses in the past, and it always got dropped/cop didn't show to court so it never really got delved into and the victims declined to pursue compensation to challenge it further. It was always written as something related to signaling or without care/reckless if I recall, but I really want this to be challenged to be defined.

Seriously. I have bumped the turn signal on my vehicles over the years many times. Now if it is left on for over a minute that might be suspect but this all seemed to happen in a matter of 30 seconds at most. Even then people drive with emergency flashers for various reasons in many vehicles and all it does is bring attention and caution to the vehicle which can really only be a good thing. You can't tell me law enforcement doesn't want traffic to slow down except...wait that would mean less tickets....
@east-endjustice7883
@east-endjustice7883 10 ай бұрын
@@OSYofRR not to mention there is no hazard with signaling and not turning, only not signaling with enough notice before turning. You could drive for 10 miles straight with signal on and at most it is annoying to other responsible drivers, but not dangerous as they are simply anticipating a turn, not being surprised by sudden tirn without notice lol.
@OSYofRR

@@east-endjustice7883 There really is no appropriate way to defend that reasoning for a lawful stop but many to escalate a situation or profit off someone. They all want to be investigators and the laws many times are so ambiguous to allow such nonsense...

Last winter I actually had an officer pull up and tell me I matched a description for a theft at Walmart, he was cool didn't try to detain me, and he actually pulled up the picture they had to show me and he wasn't lying I looked very much like the picture, but my point is he didn't get out all hot and bothered and didn't even question or cuff me, I think some other officers wouldn't have been so nice.
