the problem you can be a cop in 22 weeks in USA and most of the time you learn to use your gun, . usa and canada got the lowest cop school in the world. iam from denmark here you can be a cop after 151 weeks in cop school, the drop rate in danish cop school i around 48%, the drop rate in USA is 5% or less

Nobody helps themselves by getting loud and acting a damn fool either. It doesn’t make you look like you know your rights, it makes you look like a toddler throwing a tantrum. Throwing pathetic playground insults around is certainly not going to impress a judge either. Anyone can assert their rights without exhibiting this embarrassing behavior.

I have no problem getting out my car when asked no matter what the reason, but lock it behind you. If a cop ask for permission to search your car, then they don't have reasonable suspicion, by logic.

People need to learn this---> "I am more then willing to answer any and all law-enforcements questions, but not without legal representation, that if I can not afford the courts will afford for me" AND REMAIN SILENT. You can present your license, registration and insurance silently, if it's required.

The best traffic stop I ever had was 100% mute on both ends. I didn't say anything, he didn't say anything, I gave him my stuff, he gave it back, I went on my way. We still never talk to this day

That's correct. The entire car is said to be detained so everyone inside is detained and they can be asked to stay inside the car or get out. It's all part of the erosion of our 4th Amendment rights and it starts with Terry v. Ohio.

The driver and passenger stood their ground? By both yelling at their friend to give his ID so they can get to the lake? By the passenger giving up her ID, without getting the cop to say that she would be arrested if she didn't give ID? That is the strange way of standing your ground. I was a little surprised you said that. I'm also surprised the cop didn't take it further with the rear passenger not getting out, the only one that stood their ground.

In addition to the cases Mr. Israel reference in the video, these two are also relevant.... 2019 United States vs Landeros, 9th Circuit - The U.S. Court of Appeals for the Ninth Circuit held law enforcement officers may NOT extend a lawfully initiated vehicle stop because a passenger refuses to identify himself, absent reasonable suspicion that the individual has committed a criminal offense. 1986 New York vs Class, 475 U.S. 106 - “While the interior of an automobile is not subject to the same expectations of privacy that exist with respect to one's home, a car's interior as a whole is nonetheless subject to Fourth Amendment protection.” The officer "clearly searched respondent's car by opening the door and reaching into the passenger compartment."

This is the problem with half-knowing your rights and the law. He does not need to ID but does need to exit the vehicle, Maryland v. Wilson. The cop knew exactly what he was doing. He never threatened arrest for refusing to ID but he knew the passenger would refuse to exit the vehicle and that gave him probable cause for an arrest for resisting or obstruction.

Eh, perhaps someone can inform me here, but I have a vague memory that police cannot extend a traffic stop just because a passenger lawfully refuses to ID, which is what the cop is clearly doing. Granted, the courts also seem to magically make an exception for cops ordering people out of cars just for spite in general. Disgusting.

Pennsylvania V. Mimms & Rodriguez V. Texas is so important for people to know and I can’t count how many times I’ve had to teach people the precedent made by these cases. So many people accept “deals” not knowing these simple cases. And what’s even worse is their court appointed attorneys letting them when the facts of the case make it so easy to win using precedent. Once I tell them this information and to ask their attorneys then they’re pissed cause they have to do their jobs!😂

End qualified immunity! Make each officer personally liable! Take a percentage of each settlement out of the corrupt police union's pension fund. Maybe when cops are liable for their misconduct instead of innocent taxpayers, they'll properly educate themselves cast out the bad apples instead of protecting them.

one thing i have definitely noticed since i started doing it, if you stop in a manner where it is possible they can be ran over while standing at the drivers window, and make them stand by the drivers window, the chances of the stop being extended lawfully or not get low. if they feel like they could be ran over any second, they aren't searching. they aren't demanding passenger ID. and as a bonus, in addition to the stop being over quicker, you might actually get to watch one of these pigs get ran over. hopefully, you are recording.

Usually police must have reason to believe a person violated, or intends to violate, the law when making a stop." A police officer can arbitrarily use probation and a fourth waiver, without usual obligation to prove reasonable suspicion before initiating a search. The courts let cops conduct a body, vehicle or home search without cause, so long as it doesn’t cross the line into harassment. Here is the key: Cops are required by law to know whether the fourth waiver actually exists before conducting a fourth waiver search. The courts have ruled finding out after the fact doesn’t protect an officer. They also should know the full scope of a probationer’s individual waiver. It becomes a detention - and subject to the Fourth Amendment for those whose rights are still intact - if the exchange is prolonged or becomes accusatory. United States v. Summers puts it this way: It’s not consensual if anything happens that would have “indicated to a reasonable person that he was not free to leave.” The courts have already ruled on the obvious argument here. United States v. Drayton says an officer being uniformed and armed, though intimidating, is not enough to turn a consensual contact into a detention. Nor is asking to see an individual’s hands, inquiring about illegal activity and asking a passenger to get out of the car. But individuals have the right not to respond, and their silence shouldn’t raise reasonable suspicion - even if they’re in a high-crime area.

6:41 in and when one cop is asked the question as to whether or not the passenger is required by law to give his ID, he says "This isn't my traffic stop." So there is the Blue Line in action. Rather than go with the law as a governing authority, he is willing to go with the "gang". Blue Line in action, and it isn't right. I want law enforcement officers who enter a traffic stop to see it as their traffic stop just as much as any other officer's traffic stop when it comes to the law and people's rights. That way they can step up and hold each other accountable, and not go with a gang mentality. We live in a Republic that has laws, not a democracy where the gang always gets it's wishes.

Demanding passengers give ID, asking were you came from, were you are going, if you have any warrants, etc. etc. etc. are all examples of setting aside a stop/investigation they may have RAS for, in order to investigate crimes they don't have RAS for. That by any sane definition is a 4th amendment violation.
