No I'm not fighting with the officers in this building, but take for example the Pentagon which is a federal building you can't just walk in there and start filming s*** LOL there are exceptions to the rule, not all federal buildings are equal as it pertains to right to film or even access.

Law enforcement should be required to be able to recite the Constitution rights before being sworn in as an Officer. And recite them every time they get promoted!

cops need to be able to recite their Oath from memory, not parrot the Oath during swear in, it's not a sworn Oath if you have no idea what that Oath entails. I still remember my scouts Oath and it still influences my decisions and actions to this day

Violation of Federal law... The law states: "Except where security regulations, rules, orders, or directives apply or a Federal court order or rule prohibits it, persons entering in or on Federal property may take photographs of...” Thus, photography and videotaping the interior of federal facilities is allowed under the conditions set forth in (a) - (c) of the regulation (Title 41, Section 102-74.42) UNLESS there are regulations, rules, orders, directives or a court order that prohibit it. In this case, the SSA has regulations! Seems like English is a foreign language for some of these auditors!

I read it the same way you did. Upon hearing Mr Abiyah’s incorrect interpretation and then reading all the comments claiming these cops are fools, I thought I had missed something or couldn’t read. IMO, the DHS officer did a phenomenal job and exhibited the patience of a saint. You should post your narrative as an independent, top-tier comment rather than as a reply to Greg Kasza. That way your correct interpretation is not buried beneath another commenter’s question and everybody reads it. . Mr Abiyah needs to correct his flawed analysis so his viewers are properly educated on this matter. That being said, the one cop’s clandestine surveillance from the woods and bogus story about somebody yelling in the woods was laughably stupid.

Been through this with a local PD in my area. Summersville WV PD (who are in Nicholas county WV, recently on the civil rights lawyer channel, "arrested for laughing") literally cussed at me on their Facebook page on a public post. Then when the topic of identifying people came up, they said they can legally demand ID from anyone at any time they want to....just because they want to. They even cited some case law that had nothing to do with identifying yourself to police. 😂 I replied with a few cases myself that say you don't have to ID yourself unless you're driving or suspected of a crime...as well as WV not being a "stop & ID state" but they still didn't get it.

I think he was saying that they were either deciding to enforce policy instead of law or they were making up an exception that he couldn't record in that particular building.

@@michaeln.2383 If you examine the breakdown of the official rule, photography is allowed in public areas except when it isn't. What if the referenced sign predates the current official policy? What if the sign was posted without official authorization? The policy is lacking criteria to determine if the exception (no photography in public areas) is authorized. It's completely ambiguous.

@@davidrush4908 Yeah, a sign has to have a statute number and policy isn't law. But dishonest cops do what this one did and use copsplaining to try to make a sign law or override a law with policy. This first time I've ever seen cop say that he would have a judge explain the unlawful directives to try to trick an auditor into believing him. So, that's a new one.

@@vinceharrin4490 Yeah, sometimes judges just make up laws to back the cops or they just say your guilty because the cops say so. Even if a cop has no legal basis for an arrest, there's always a chance that a judge will find the person guilty, anyway.

Yeah, most jobs require you to be knowledgeable at the job that you are working, but if you go to the special school called blet for 6 to 9 months and pay a couple thousand dollars then you can become a cop and just try to look cool and bark orders of people, and you don't have to know your job, literally one of the only professions that pays into the six figures in this entire country where you'd literally can have zero actual knowledge of what's legal or what's lawful or what you're doing, but since the police police the police there's a lack of integrity and standards as you can imagine... Imagine if the labor workers at my warehouse police themselves and held themselves accountable we probably wouldn't get it quite as much done as well.

Not that the sub-parts are the exception to the security regulation, they are the only areas inside of Federal builds allowed by code to start - but can be overridden. The officer was right, the auditor was wrong, and the commentator on this channel apparently does not understand English.

@@EarlHayward You can't make a crime out of a constitutionally protected activity, freedom of the press. No law, rule, judges order, policy, ordinance, or feelings can trump the constitution of the United States, period. Under federal law 18 usc 242 It is illegal for anyone under the color of law to deprive any person of the rights, privileges, or immunities secured by the US constitution and under 18 usc 241 it is illegal to conspire to violate such rights. It is a felony punishable up to 10 years in prison. This could be applied to local, state, or federal law enforcement or military personnel who abuse the rights of citizens. Glick vs Cunniffee address the citizens right to record public officials in the acts of their office. Smith vs Cummins Georgia People have the right to record public officials in the course or their duties while on taxpayer money in public from public property. Swartz vs St Johnsville is also relevant. Those are just off the top of my head. Why do you hate our constitutional rights. You must be a cop. Now stfu you misinformed commie bootlicker. Actually, I don't think they are dumb. Dumb people can be taught. They are either so stupid that they don't know that they are stupid. Or, as in this case, they know that they are wrong. They are just trying to bully or gaslight us. That is why I usually scoff when someone suggests that they need to be educated. However, I have changed my mind. I think that they are being taught that the public is watching (and recording) them. And that we are not going to let them get away with bad behavior any more. They are fighting it tooth and nail. But the more people from all walks of life stand up to them, the sooner they will get the message.

WOW !!! Amazing how these public servants given some authority seem to have the perceived authority to literally just PI$$ on the Constitution ,the Bill of rights and the supreme court rulings on case law.. also they believe if they just put a sign up or verbalize something it is law !!!! This needs to be followed up with a letter to the building supervisor explaining the law and expected change or expect Federal Civil rights violations !!!!

Sounds like we need to respectfully address our grievances to Deland PD and the SSA so that the next time he goes he finds them passing with flying colors. I'm in SWFL. I just contacted Deland PD a few weeks ago. Smh. Here we go again. 🤷🏽‍♀️ lol

@The Dude I've watched many auditors and I've seen the court cases. The ones that are most powerful are the ones who maintain composure. When the video is played back for the judge it shows that situation for what it is. And for those people who call up cursing, yelling and name-calling they simply make it worse for auditors everywhere. Officials assume and attribute negative motivations before the audit even begins. It's not helpful. Amagansett Press has shown this time and again.

I really hate the way law is written because I can see the argument both ways. I really appreciate good auditors for this reason, I feel like I'd be constantly calling lawyers for clarification on everything.

I did a audit today here in Doverfoxcroft, Maine for the same thing. Except it was the town office saying we cant video in the town office. My cops were much better :)

Either the Supreme Court or a district Court has recently ruled that citizens have the right to record inside a social security office. A man won a lawsuit for recording a security guard mistreating his father and was arrested. You should look it up.

There's no such thing as a good enforcer. The whole “good/bad Cop” question can be disposed of much more decisively. We need not enumerate what proportion of cops appears to be good or, listen to someone’s anecdote about his uncle Charlie, an allegedly good cop. We need only consider the following: (1) Every cop has agreed as part of his job to enforce laws, all of them. (2) Many of the laws are manifestly unjust, and some are even Cruel & Wicked. Those “spaces” pertain to “SCIFs” within those buildings, not publicly accessible areas. Blue Line Unlimited Edition did a great video on that quoting US code for his I.D. refusal video… should check it out!

The scariest part of some of these videos is how the police clearly do not care about the law. Even when the citizen quotes the law and shows them in writing, there are still policemen who continue to violate the law. How can we trust law enforcement officers who choose to violate the law?

Hi, you should fo a follow-up report on that Police Officer that went to California and killed the family of the teenager girl. How there should be deeper background checks and a stronger psych evaluation done on Cadets before they become Police Officers.

Close to the worst thing you could say to an officer is YOU UNDERSTAND THEM ! There are word semantics at play here good people what they are actually asking you is DO YOU STAND UNDER THEM ... what that translates to is DO YOU STAND UNDER the policy they are trying to enforce ! You see why this is bad VERY BAD !

I feel they need pass many written tests of actually knowing the laws that they're going to be enforcing prior to any physical training that they'll be doing in the academy.

99.9% wouldn't pass, unless it was open book. Even then they probably wouldn't know how to use the book. They should also have to recite there oath, individually, to get the badge. Their excuse is there r to many laws. That being said. They taught me the constitution and our rights in school. Makes u Wonder what they r teaching now.

the problem is the tests are too easy and i think mostly open-book. i got a 100 on almost all 35 tests but that guy that failed 4 tests (5 is academic drop) and has a 71 average is just as qualified as i am. and he’s the majority.

As soon as that cop at the end of video responded with "I know it wasn't you, but did you hear any yelling?" He made sure not to accuse- what a joke. I want to be clear, I don't insult good cops- I don't insult fair cops, I insult bad cops!

Most of these auditors and people on KZbin are wrong from my experience... The law states: "Except where security regulations, rules, orders, or directives apply or a Federal court order or rule prohibits it, persons entering in or on Federal property may take photographs of...” Photography and videotaping the interior of federal facilities is allowed under the conditions set forth in (a) - (c) of the regulation (Title 41, Section 102-74.42) UNLESS there are regulations, rules, orders, directives or a court order that prohibit it. Seems like the officer explain that the SSA has rules that prohibit photography and videotaping in its spaces. Similarly many courts issue no photography or videotaping in courtrooms and surrounding areas. The prohibition must be clearly posted or actual (in-person) notice must be given in order to be enforced. Both existed in this encounter! Apparently, auditors cannot properly read and comprehend the law in order to understand how to apply the law.

The officer is allowed to make most of these mistakes by either using his qualified immunity, suspicion of something or their own safety or they can just play dumb in court. They love to let the judge sort it out in court.

The officer was correct as the law states: "Except where security regulations, rules, orders, or directives apply or a Federal court order or rule prohibits it, persons entering in or on Federal property may take photographs of...” That means that if a security regulation prohibits the recording or photography, it is allowed... Not that the sub-parts are the exception to the security regulation, they are the only areas inside of Federal builds allowed by code to start - but can be overridden. The auditor was wrong, and the auditor (not to mention the commentator on this channel) apparently does not understand English.

Love the Frequent Education Abiyah. You rock. I still wish you would go educate officers directly in the academe! I emailed you about this over a year ago or so. I hope you reconsider the concept as I KNOW you would do quite well. In todays world, Police NEED education. I work in healthcare and I need to do the same in healthcare that I am asking you to do in the police world. PEACE.

The DHS officer is the most respectful officer I have ever seen on this channel. This exact same subject was covered on audit the audit. They went into several court cases. In the end the DHS officer is correct. There are exceptions to the quoted DHS memo.

I think that is unconstitutional because it really does say that you can't film if the building has a rule prohibiting it. You can put the excerpt clause at the end of the sentence instead of the beginning in order to make it more clear. Persona entering...yadda yadda.. except... But that is not legal

There was a complaint. This Law Enforcer was whining about the Auditor's failure to immediately comply with his OBEY ME command. How dare a citizen exercise their rights! Ah but the look of contempt on the faces of our brave Law Enforcers. They smugly look down at the lowly citizen with a camera, knowing that they have the tactical gear AND qualified immunity, and the citizen can't touch them. The Auditor gets TWO THUMBS UP, and the Law Enforcers get NOTHING!

I like how the DHS officer says that a judge knows the law better than him, yet continues to try and enforce a law he doesn't understand. Maybe he should be the one that has a visit with the judge to get better clarification.

Maybe not a good analogy but when I was in the military, if I was caught off guard about a rule I looked it up. I didn't just argue my way through it or try to BS it. Then I went back to clarify. It isn't hard. And it's ok to be wrong if you try to learn and correct it. Of course, these cops aren't getting it😂😂😂

Hello A.I.-WTP, this may be a long comment sorry, I am followed her channel for a little while now watched pretty much all your videos and enjoy all your content thank you very much. I recently watched your video on what it was like going through the police academy and your stories involved with that. And it was eye opening to be because in my line of work it is the same thing. I am a CDL class A truck driver. Been doing it important number for years. And what you gleaned at in that video it's the same in my line of work as far as what they teach you at the school is only to pass the test it's not actually how to do the job properly. That really sparked me to said that and I was like that is the same thing in the trucking industry. They do not tell you in schooling or class how to do your job properly. They simply tell you the bare minimal just enough to pass a final test for completion. Nothing about how the job is supposed to be done if I appreciate all your content once in and keep up the good work.

The problem is they quoted security purposes of the reason why they couldn’t and the law that you quoted stated for “security purposes.” So, yes, they can tell him to leave the property. This is where that law needs to be taken to court and challenged on the “security purposes” because anyone can claim anything as security breaches, especially at the SSA with ID theft. That needs clarified or taken out.
