Sir any of the above mentioned clauses cannot be removed from agreement as promoters mention the sample draft is provided by rera . If we look at these points we might never be able to sign any agreement in any project

Saurabh Ji, earlier, RERA wasn’t very strict about verifying everything uploaded on its website, but now MahaRERA is highly particular about enforcing non-negotiable clauses. It seems you may have missed the core message of this video. The purpose here isn’t to show how to remove these clauses. Instead, it aims to inform buyers about how developers strategically use these clauses to shield themselves from paying compensation in cases of possession delays. Simply including these clauses does not mean that buyers’ rights are compromised. If challenged in court or with MahaRERA, the judgment is typically in the buyer's favor. Understanding these tactics is crucial. In the event of a delay, every buyer has the right to seek compensation.

Sir, What about the grace period clause. Developer mentioned the grace period of 6month over rera date. Is this legal to add such grace period in the agreement. Then which date shall be considered for filling the complaint for late possession, is it agreement date of building or agreement date of building plus grace period

i recently filled a case in rera. . there is no legal tenability of grace period ... basically it is nothing . .u can file rera case if date of possession as per ur agreement passed

Is भोगवटा पत्र means occupancy certificate ? Because our builder gave me bhogvata patra but he is saying is completion certificate and its because of this i have confusion. How can we verify it. ?

Yes, “भोगवटा पत्र” generally refers to an “Occupancy Certificate” (OC), which is only issued by the Municipal Corporation, not by the builder. The OC certifies that a building is ready for occupation, while a “Completion Certificate” (CC) confirms adherence to approved plans but does not permit legal occupancy. Please check if the certificate provided is from the Municipal Corporation to ensure it’s an OC.

From where can I get model BBA. It should be made available and rera should make it compulsory for builders to use this format only BBA . It is literally not possible to go through these 30 pages or so and also after making all types of payments, I hope u understand what I mean by all types of payments ,there is no going back and fighting and arguing. Please make publik the MODEL BBA.

😅सर फ्लैट खरीदने के लिए खुद बिल्डर से नेगोशिएट करना चाहिए या फिर किसी चैनल पार्टनर के साथ जाना चाहिए, दोनो में क्या फर्क है ? मैक्सिमम लोगों का सोचना होता है कि खुद जाने से ज्यादा सस्ता फ्लैट मिलेगा।

Could you please help to make a statistical video how many buyer claimed the compensation till now and how many have got compensation actually. You can guide us how to get the data or where it is available. In my opinion there might be very very less buyer who has received compensation.

My project got extended for 1yr from Dec 2023 to Dec 2024. When visited CP, he told they can extend for 2yrs also and we are at mercy of builder. I suggest don't go for under-construction projects. Better go for ready possession.

I just watched this video, and it seems that the KZbinr lacks a deeper understanding of the RERA Act. They mentioned clauses in agreements but overlooked an important point: under MahaRERA, promoters must strictly adhere to the model agreement. If a promoter wishes to make any changes, they are required to issue a deviation letter. They cannot deviate further, as that would contradict the RERA Act. Any such clauses introduced beyond this are considered void.

It seems there’s a bit of overconfidence in your approach, though everyone benefits from deeper understanding. Please share the RERA Model Agreement for Sale where these specific clauses are outlined. Previously, MahaRERA didn’t review every clause in agreements as closely. However, they’re now very strict, and builders cannot obtain a RERA number with such questionable clauses. MahaRERA’s vigilance around non-negotiable clauses led to Order No. 60 in September 2024 - please refer to this. Notably, MahaRERA permits only two clauses for delay relaxation, unlike the eight, developers often include in agreements. It’s always wise to be well-informed before casting doubts.

@@ReraGuruji the RERA order already mentioned the developer can delay possession due to "Any notice, order, rule, notification of the government and/or other public or competent authority " but you objected to this....I think however this clause is also self contradicting but still MAHARERA mentioned it....
