I've no idea how many live aboard "crew/friends, with benefits end their careers with a lot of money" there are. Superyacht owners are often in a position to tip crew very very generously for special contributions? to the "owners happiness" but are not always in position to allow discretions.

You can still think of it exactly like you would a person: Arrest is legally constrained, a person gets thrown in the pokie awaiting bail, trial or pardon. An arrested ship can't leave or go anywhere pending whatever action - be it payment of a fine (bail) or clearing up whatever legal action (trial or pardon) got it arrested in the first place.

Thank you for your videos and constant updates. As a professional in the industry I can tell you that we are stepping into uncharted territory and quite interesting times. In the last year it was quite difficult for someone to buy a yacht and prices have been skyrocketing. We really don’t know what the immediate future of these ceased or arrested yachts will be. It is quite uncertain at the moment. You are absolutely right on saying that the industry will certainly be turned on its head. Keep the good work.

Every definition of arrest in legal terms speaks of arresting humans. Seize or impound property ,freeze assets But ,this is 2022, so people can change definitions to anything that fits their narrative. Even Esyman is saying "as far as I can tell", which is a statement of doubt Next week, green will be red and red will be blue.....

@@prefersoxygen9373 Arrest if a vessel is a valid legal term and has been for a very, very long time. It has been codified in a 1952 International Convention for the unification for certain rules relating to ARREST of Sea-going ships and a 1999 International Convention on Arrest of Ships.

What we actually have is one rule for us , where America and the West can do whatever they like and are never held accountable, and a rule for them, where we be bleat about innocent women and children and how evil the "they" are and set up war tribunals. Conveniently forgetting the million or so Iraqis & Afganies killed. We go to war based on lies and will even fund groups we are ideologically opposed to such as ISIS and the Ukrainian Nazi element. Yet not one Super yatch has ever been arrested or confiscated. The hypocrisy makes me almost as sick as the senseless deaths. Tribalism is what causes wars, we need a principled approach where we call out our side with the same venom and apply International Law and conventions when anyone steps out of line including ourselves or our friends when in the wrong.

I am amazed at how big these yachts are and how much they cost, and yet, how little they seem to be used by their owners. Just for bragging rights? Arrest derives from the French word arrêt, which means to stop or to stay. It is therefore exactly the correct word for restraining a vessel and preventing it from travelling. It does not imply criminality, but usually involves a reasonable suspicion of criminality. It is only when an asset (such as a vessel) has been seized that the alleged criminality has been proven.

Just to increase the geek level further, mediaeval monks copying the bible endlessly developed a massive shorthand for all the common suffixes, and the circumflex ^ was one, a hidden "s". Another's the ampersand &, a stylised "et". Most died out with latin, though - if you were to do the same today, "-tion" would be a candidate. "con-" as well.

Around 10% of the value of these vessels would normally be spent on maintaining and running them each year, so $279 million based on your figures. It's amazing the yachting industry seems to be shrugging this off. I understand that order books are full at many yacht builders, the estimated impact to new orders is based on the average sales to Russia being around 9% of the superyacht marketplace.

The whole “you can’t arrest a vessel” thing is a symptom of the reason why I quit the marine industry almost ten years ago. So many people in shipping just don’t want to learn about their own industry or take any pride in their work. I just got tired of explaining basic stuff over and over again to people who just don’t want to listen.

Funniest one was the harbourmaster in Valencia. We'd had a consignment of orange juice on a ship which got into difficulties and was salvaged. About the first job I had was to sort out the mess, easy, the juice was now the property of the salvagers, I got a new shipment on its way and claimed the insurance. A couple of years later, I'm clearing my desk in a move to Group HQ, the phone goes. "This is the Harbourmaster in Valencia. We have a pile of boxes on the quayside, with your name on, and the boxes, they go POP. The smell is terrible. What you gonna do?" My reply was terse, "They're not ours, speak to the salvagers." "We don't know nothing about that." "Not my problem." "We'll bulldoze them into the harbour, then." "Be my guest, like I said, nothing to do with us." A few years went past, and a colleague who makes the juice reported back. The colder seawater had stabilised the fermentation at a much lower level, so every couple of months, a can blows, and the port is fumigated. There's a couple of thousand cans there. Spain has its own Beaufort Trench (that's the deep spot off Stranraer where they dumped the surplus munitions after WW2. The UK Government recently wanted to put a Chunnel through there, and that stopped it.)

The Nobel Prize Committee just dump themselves on people uninvited. sent me from my initial reaction of grunting, "that's not why we did it" through "how about that?" and back to "nah, that's not me", because it's a Neurotypical honour. To honour me, listen to the lessons I've learned. Outdo me. Discover how it happened. To hear that xyz Putin claim he's doing the same, though, makes me sick. Zero respect. Zero honour. The willful ignorance of captains and their officers costs lives and causes massive property and environmental damage every year. What would you tell the parents who lost their children when the MV Sewol sank? That at least the crew had a jolly good time with nobody nagging at them about getting the stability calculations right? Would you trust the lives of your loved ones in the hands of people with such a cavalier attitude to the correct practice of their profession?

I used to carry out repairs on vessels along the Cote-d'Azur. Despite I had a good time during when working on those boats, I have changed my perspective over the last years. There are endless arguiments in my point of view that there cannot be enough vessels to be taken away - rightfully so or not.

Further those people who are having yachts belong to the sort of people who fuck up our planet, either with with their factories, because environmental protection is the most expensive expensive expense when running a company. Through something else. Or that they need to go everywhere they like. That included their travels to the polar regions and also to space. In the merchant navy we always referred to the seizure of a vessel as being impounded. When a vessel is impounded, it still belongs to the owner but can't be released until legal matters are resolved.

What you have to realize, is just these superyachts represent almost 3 Billion dollars stolen from the Russian people because that is effectively how they were bought. I've seen plenty of times where they also occupy the best spots in exotic locations. Not a fan as you can guess.

Their repairs, while creating jobs is merely a prop up of the gigantic kleptocracy of Russia, where we see now, any grifting, corrupt oligarch worth his evil salt, has to have a yacht, by which to decimate the hard earned money they simply siphon out of the economy back home, with every devious pay-off, false billing fraud, or simple confiscation of assets. Favouritism wit Putin, and pork-barrel over invoicing as well as outright theft, adds money in their pockets,...for these sociopathic oligarchs to waste on these gigantic baubles !

Those 3 yachts pay hundreds of mortgages. They are money put for the owner but a jobs program for thousands. The subcontractors needed to keep those things floating are all working stiffs like the majority of us.

It's just been made worse by P&O dumping nearly 1000 ferry crew, illegally, for cheaper foreign agency workers, having committed no end of other crimes along the way. The reaction's expanding into a wider classification of oligarchs than just Russian ones. In practical terms, those with a Services background will always find a berth, you just have to look at the courses around Hereford, Poole and Plymouth to see that. For the rest, the loss of so many truck drivers has created a deficit of around half a million jobs which can't be filled. The UK DVLA isn't helping, as they've dug a hole and are happy in it, but other nations' testing is still recognised, you'd have to research which. That gives time for Swansea to get their act together or a new government to get a grip (neither the Transport Minister nor Prime Minister having any understanding of the concept).

Commercial or private aircraft, he did mention at lease one helicopter being seized from one of the yachts. I saw a video about homes on the French Rivera being seized and the local Realtors were whining about how it was bad for their business. 🙄

What are those six vertical stacks on top of Crescent? I saw a similar set, same configuration, but set at a slight outward angle, on another yacht. They're probably completely innocent, but they certainly do look like part of some sort of defensive system.

Amazing info and clear definitions. Thank you. Are you keeping track of yachts "arrested" vs. "seized" and if/when ships move between the lists? I suspect that some are first detained as Arrested while the management companies confirm ownership, and then they may become Seized. And sanctioned ships are now very likely sailing without insurance/certification. No port authority is going to allow them to dock. They'll be stranded at sea out of fuel dead in the water, unless they can get to a 'friendly' jurisdiction.

The job loss hopefully is only temporary. I hope everyone finds a way to replace their lost income. Through no fault of their own, they are probably scrambling. It is vital to always have at least 6 months of expenses saved. Preferably several years of expenses saved. Always worth keeping in mind, "this too shall pass". Good luck to all the affected staff!

@@daidavies6210 In ww2, most Europe economies and the UK were in horrific shape. You can't really "blame the victim" which is the EU. The EU probably reckons that russia stopped inside Ukraine is preferable to russia on Poland's border and chose to throw their weight behind containing russia in Ukraine. Logically it makes sense because if russia reached Poland's border, they are effectively on the border of all Nato countries - one misstep and the conflict becomes inconceivably worse. If russia 'accidentally' hit Poland, my goodness, this would be very bad. The EU is doing something it really does not want to do. No one wants it. But it's 100% on russia. And like in ww2, everyone is going to suffer economically. But it's temporary. "This too shall pass."

Is repossession of stolen property really theft? I suppose it’s a sort of re-stealing of stolen goods. You can’t seriously feel bad for oligarchs in a country that is as poor as Russia. In 2015 the average Russian family had total assets of $850 that’s lower than the average in India. The oligarchs are garbage.

So if we play this scenario out a bit. They stay on the bad list and the boats remain under arrest etc, what happens with them in a year for example? Are they sold, scrapped etc? Do the countries pay for the arrest / seizure? For example to the marina or boat yard for storage? I assume fuel and or power is needed for them, or there is a potential they could sink etc?

I like that people don't know what the word 'arrest' even means. you can arrest a person, you can arrest a vehicle, you can arrest a fall and you can even have arrested development. I wonder if these self-proclaimed grammar experts realize that there are 'arrestor cables' on aircraft carriers to arrest the horizontal velocity of landing aircraft. An arrest is just to bring something to a complete and total stop; what most people think of as a legal arrest is actually incarceration, the arrest is just when the officer cuffs you or otherwise apprehends to bring in. The version of incarceration for property is impoundment; and since they are not moving the yachts somewhere else and kicking the crew off, it's only an arrest. Seizing means that the owners have permanently lost ownership of property, legally speaking. you also have detainment, which is temporary and doesn't involve an arrest in and of itself. IE if a police officer stops you for speeding, it's a detainment. If you flip them the bird and refuse to provide licence and registration, you will then be arrested, and likely incarcerated until a bail hearing. Legalese, yeah!

Great points, but to clarify, a person can be arrested as the person is a vessel for the soul, persons have berth/birth certificates as they come ashore from the waters of their mother's womb and are registered on land. Legalese is a fun subject to study and you find so many interesting facts that have been contorted and diluted over the years. It is isnteresting to see most country's laws are based on Admiralty Law, with slight changes in definition and or spelling (ie; birth/berth) which is why all the similarities cause confusion to those who are ignorant of Law.

Nope, we use the word "DETAINED" - But then I don't live in Europe or UK so I wouldn't know how their English works over there. Incarceration means confine to prison not jail. When you are arrested you go to jail. When you are incarcerated you don't go to jail, you go to prison. Incarceration are long sentences. Jail are short term - you could be in jail for 6 months after a light sentencing so there is some overlap here. Usually when you are arrested, you are suspected/charged with a crime. When you are detained you are held for questioning since the authorities are not sure if you are the culprit. From what I can tell, when you are under sanctions list, you are barred from doing business, no Interpol arrest warrants have been made to put these Oligarchs in custody so they the owners themselves are not being arrested then these boats should be detained base on sanctions. That is why the word arrested being use here is bit weird - but then most of us arnt in this industries so maybe using the word arrested is applicable here - but it is not base on the way you are defining it.
