But what if you have evidence they committed a crime and the prosecutor did not press charges. Don’t I have a right to file charges if I don’t agree with the prosecutors decision? How is that fair? Am I just left to no justice?

I am a victim of aggravated battery. I didn't press charges. I saved his job. However, the injuries left me semi-handicapped and in need of bilateral knee replacement... now, we are going through a divorce. Have a prenup. I walk away semi-handicapped. Not able to run or stand for a long time. My life has changed. He promises me that I will get NOTHING. WOW! I read that the court could permit the tolling of statutory limitation in a case of "Physical Incapacitation following the injury" I hope this is true.

So, how do you get the DA to proceed? A police report was already done at the time of the incident but I wasn’t asked as I was the alleged wrongdoer.

You don't. It's up to the DA to decide whether to proceed with an actual criminal case.
