From listening to other parts of testimony I think under Georgia law a person DOESN'T HAVE TO STEAL ANYTHING to be guilty of BURGLARY only to ENTER a dwelling WITH THE INTENTION.TO STEAL something. I can only guess this covers the case where a burglar is interrupted, drops the swag and flees empty handed - thus didn't actually take anything but is still guilty of burglary. Or something similar. I agree that the defense attorneys tactics are despicable. By the fact that the judge recognizes this they damage their own defense, thankfully.

It’s entering private property without permission or against the owners wishes. But I don’t think applies to unsecured construction sites.
