There is no way 53% of the Indian population supports LGBTQ+.... the survey was definitely conducted in a metro or suburban areas that are generally more supportive of it. A survey across all of India including the metropolitan cities to small towns in Gujarat and Tamil Nadu to remote villages of Bihar and Uttarkhand needs to be taken into consideration, if so the support is def well below 53%.

Every culture needs to assess this in their own way with their own civilizational values, whether it be India, Nigeria, or Indonesia. Indian culture has never discriminated against anyone on the basis of their sexual preferences, however, it has neither created an identity around these preferences either - I.e. Indian spirituality does not define you by your sexual attraction. So another approach may need to be taken.

As a lay person it seems to me that by referring back to the parliament the supreme court is looking at the separation of criminal and personal laws. Marriage may be considered an issue that falls under personal laws regulated differently depending upon religion. Fundamental rights under the constitution seem to be conditional to being compatible with the personal codes as was seen when some women were denied alimony after divorce in 1986 and later. If and when the Uniform Civil Code (UCC) is passed the supreme court may feel authorized to decide whether same sex marriage is a fundamental right. The court has already decriminalized it because the criminal code applies to all. Just a thought!

For a country as diverse as India, and the population difference and cultural diversity to make a poll of this importance and standing by it is stupidity. They probably conducted the survey among young people. Indian youth are very accepting of the LGBTQ+ community, so it's no surprise that the data tends to be higher. If it were conducted among the majority of advanced individuals, the numbers would be different. And with the diverse demographics like India, this issue is multifaceted.

As a Hindu, I don't have a problem with Same sex relationships at all. What I have a problem is with calling it marraige. A Marriage in our Hindu culture means a relationship between a Man and a Woman. In-fact i support Legalization of Same sex Couples, Let Gay couples have equal rights as married couples in every way possible. In a Democracy, All are equal. Your Hindu culture does not apply to all the people in India, and should not be imposed as such. Hindu culture only applies to people who practice hinduism. Marriage from a secular perspective is a legally recognized union between two consenting adults. Religion should have no say in government policy or definition of words like marriage.

While I take your point, and would agree, too a certain extent. However, in this situation I'm inclined to disagree human rights shouldn't be left up to parliament where they can play politics with the issue. When you put human rights up for a vote 90% of the time people vote against it stupidly. If the Indian court is saying, it's not a fundamental right by their logic than that should extend to heterosexual couples since marriage isn't a fundamental right and should be left up to politicians too decide.

So it should be decided by society/religion and not SC.

Do you know why LGBT people are asking for legal recognition? There is this one major issue that reprieve them of another important status. NEXT TO KIN. They will not even be eligible know crucial medical information about their partner if they are admitted in hospital. If SC doesn’t want to give them right to marry, fine. But the law should make provision for recognizing a civil union at central and state level. That way the so called “sanctity of marriage” can be maintained and the marginalized people will get the right to live freely with their partner. And people should realize that this is not a choice. No one would “choose” to live to a difficult life. This is basic biology. There are heterosexuals in our country and there are homosexuals too. It’s high time people accept the reality.

Although I myself am not a part of it, I am always going to Support the LGBTQ+ community, thank you very much. Being a Hindu myself, as far as i know Hinduism is the most logical and scientific religion to ever exist in the whole world. It is the most open and self-updating religion (according to changing times) and has never imposed any kind of restrictions on same-sex marriages or relationships. Leaving aside the one hateful scripture which imposed strict caste based system on the Hindu community (because i am never going to follow that particular scripture, and I don't even remember its name but I don't consider it to be a part of Hinduism), I think it has always been told in the Hindu scriptures (at least in the original ones, and Not the translated ones), that marriages means people finding their life-partners and to be faithful and devoted to them, and not to be violent with them, etc. in the most simplest terms. Again, this is as far as i know. But, even if that is not the case and i am wrong, i am still going to support the lgbtq+ community. And also in that same case, even though i do believe in one God and that is never going to change, i will be okay with being religion-less.

And yes, I will choose to be a person with no religion over being a person of any other religion other than the Hindu religion, any day, if I ever decide to leave Hindu religion one day, which I won't, since I know the things I learned from Hindu scriptures to be true. Edit: And to be perfectly honest, I Support the LGBT community a 100% with all my heart, but I do NOT support the Q+ community. However, since it is included under that umbrella term, I am just left with no other choice but to reluctantly and unwillingly support it as a package. Sexual orientation or sexuality of a person is something I don't have a problem with (in fact I fully support it, as I stated earlier) until people just limit it to their own species (and the Q+ community might include people who won't restrict their orientations to only humanoid-beings, hence I made my support for them very clear), or at least some other race of beings on Earth as intelligent of a species or race as humans or more intelligent than them is okay too 😅 (which don't exist).

to be honest, the only criticism i ever hear of hinduism or santan dharm (whatever you want to call it) is that we have a "caste system" and "sati." literally only two things. the practice of sati doesn't go farther back than the 16th-17th century during the height of invasions (coincidence? i think not). and no scripture even mentions it. it took inspiration from jauhar but jauhar was a communal practice (not restricted to upper class women only, i'm sure more women were involved in some way) and it happened in times of war. sati happened in individual circumstances in some places. Evidently, the number of cases for sati had been exaggerated by the british and research has been done in recent years that proves it to be likely as it justified their colonial efforts. and the caste system is only described as rigid in one scripture that likely has been corrupted. people see as people do. it's a cycle difficult to break from, and while i do not defend the discrimination and violence, i'm not surprised why people continue it. but to the main issue, the lgbtq+ community has never been described as it's own separate community. they were very much integrated into our society. our scriptures do mention them, but it's in such a neutral way and similar to how other communities were treated in texts that you don't notice it. there are certain legends that describe them in a more positive way but the discrimination against them has risen since british colonization. gay and transgenders are literally going to hell according to many christians still, and that was definitely the general idea back then. they created the literal hijra "community" and outcasted them from society. today the argument is that being gay or same-sex relations are not natural and nature or "god" has not made us that way. majority of animals engage in same-sex activities. lions, bonobos, koalas, penguins is just a small list to show how the variation. nature also shows that parents can eat their children. but humans don't- usually. humans are complex enough creatures that we can follow the rules of nature but also make a few of our own for a better and harmonious society. Definitely, the lgbtq+ community deserve the same rights as well. we all deserve to happy as long as we aren't hurting each other (as in violence for those who don't get it).

i think its fair that this decision is handed over to the govt of india. becasue same sex marriage will lead to a lot of other questions like adoption .. in indian law, single man can't adopt a girl child, so now does a gay couple can adopt a girl child if same sex marriage is legalized. there are similar such things to be considered, so a proper law and act needs to be crafted by the govt, after looking at it holistically. in an ideal world yes same sex marriage should be as good as heterosexual marriage but we dont love in a perfect world do we.. also in the current times when young generation is going against marriage , i thinkt he concept of partner by law which is there in other western countries can also be considered and looked into by the govt..

In my openion why their civil union must have been legally recognised is because when they enter into relationships are often abandoned by their families in most of the cases and in such a situation to take care of each other in case of emergency like medical emergency they can’t use each other’s resources as per the petitioner which I also found to be valid.

It may have started with the issue of same sex marriage but what it bottled down for the Hon'ble Court was whether or not it has the power to legislate, which the Hon'ble Court do not possess. The decision may seem disheartening to a lot of people but an adverse decision could have had a disastrous impact on the Indian legal system. If the decision had come in affirmative, it would have jeopardised the very essence of separation of power. Thus, in sense threatening the constitutional values. The Hon'ble Court has directed the Govt. to form a committee to properly research and legislate laws required to recognise same sex couple's right to marry, which is at least a few steps forward for the community.

1. How much study had been done on this issue before forcing society to accept this? 2. What are the side effects, consequences, if attraction is permanent or temporary, chances of attraction for opposite sex, then what happens to the rights of other spouse about adoption of child, impact of life lessons on the adopted child, grounds for divorce, what about criminal laws? One can't be of one sex in civil laws and different sex in criminal laws? 3. What about changes that it will bring between heterosexual couples in case of rape, domestic violence, divorce alimony, dowry when the perpetrators will announce themselves as same sex persons be it man or woman? 4. How homosexual couples will prove who has done the crime on them or nature of the crime? If a man identify himself as woman and a woman identifying herself as woman how will he protect himself in crime related sexual orientation? 5. Why such a force is being applied on psychology of people very rapidly and by forcing them by making them feel guilty by announcing them as homophobic, is it because of large profit of pharma business and drug business ? 6. Are those opposing this doesn't have any logical concerns? Why are people tagging them homophobic?

Marrying a tree doesn't give right to tree to sue husband under 498A. So please understand the complexity of ti. There were multiple questions raised in front of bench including inheritance full blood, half blood and who would be a wife because law clearly states these blood relationships from a biological male and female prospective? If a biological male considers himself as women you can't term that person as wife. I can go on buy giving you the context.

To be honest, I support this initiative of legalizing same couple marriage. If this is done, the government will be forced to make changes in the divorce laws pertaining to alimony and other aspects of transforming marriage into a legal contract, rather than considering it to be sacrosanct. It will also benefit the men who are legally scammed by their predatory spouses. I have faith in our govt. If something good comes out , it would be under this govt. The other parties only use us for their own politics, the same way they use other communities. The left liberal are portraying this judgement as a bad decision but for me it's good to check every aspect of it which could influence society in a negative way. Some people from lgbt community may not like it at present but the decision made by supreme court is right. The parliament should decide how and which way the law could be implemented. We can wait some more. Watching the western countries short sighted decision's result, influencing kids in a bad way, i would say it is wise to take precaution before passing any law. Personally i would like to have marriage rights for us. If religiously it is not possible then atleast some legal way the couple should get acknowledgement. Something similar to court marriages is good. Adoption matter is different. I agree with the reasoning. Children don't need to understand something that the adults of our country can't understand. First educate the adults. Legal marriage on papers should be allowed. Let the gen public understand it first. Till then Gandharva marriage is our only option👍🏻✌🏻🏳️🌈🌈

I don't think colonialism has anything to do with this decision of the court. It's fairly normal for a country legal system to pass law using parliament .

India for a bad reason uses English as you can see me (at least online) and this Indians tend to get influenced by western stuff it comes like waves, i totally expect these "i recognise as a water bottle" in a few years
