The plaintiff put down a deposit for an RV the defendant was selling. He claims the title to the vehicle was forged, so he backed out of the deal. He wants his deposit back, so he’s suing. The defendant says he was selling his daughter’s RV and he never forged anything

Sounds like the plaintiff put a deposit down impulsively and later changed his mind. WOW, $8k is a lot of money to lose.

I truly believe the plaintiff had serious second thoughts about his ability to handle that RV. You see so many retiress with RVs for sale. It was their dream for their retirement to travel the country, until they have to maneuver it. They have difficulty maneuvering a small sedan, let alone something the size of a schoolbus.

There really needs to be a special endorsement on the drivers license to be able to drive an RV. Some of these owners have huge RVs with a boat, a vehicle, and anything else that they can attach to it going down the road. A semi is shorter than some of these things, and depending on what is in them and attached to them, they weigh close to the same or more than a loaded semi and trailer. We don't allow Professional Truck Drivers to drive without a CDL, and bus drivers also need special endorsements to drive a school bus. RV owners should be no different, especially since most owners have never driven anything larger than a 4 wheel car or truck. RVs can be and are just as dangerous as any semi in the hands of an untrained driver.

@@Sophie-mm7ow You are correct. Some of the RVs are the size of a commercial bus, which you need a special license to drive. Many are driven by retirees that can't back a small sedan out of a parking spot.

Yep. My friend and her husband bought a nice RV. They might do 4 trips a year, but there is a monthly payment and insurance. Now after 4 years, trying to sell it

Camping/RV isn’t the easiest thing for able bodied people. I am sure that his brain talked him out of it. Seems like the defendant was a great guy. I feel bad for both.

In my decades-long experience with computers as both a programmer and a user, I've learned that when files being transferred to a machine "disappear," it's usually because they were saved to the wrong folder and the owner doesn't know that. They're probably on his machine somewhere ... assuming he's telling the truth.

As the Judge pointed out, more people want to buy an RV before summer vacations than at the end. Defendant lost out on sales opportunities because he was holding it for the Plaintiff so he sold it at the end at a loss. The Judge was correct in her verdict. Yes, I feel bad for the Defendant, but it was his choice to put all that money down and then back out a couple of months later. Deposits are not refundable under the law per the Judge.

JM did not ask for proof the defendant sold it for $10K to someone else. Doubt it was coincidence he just happened to sell it for the amount that would allow him to keep the plaintiff's $8K. The defendant seemed to be a very upstanding guy, but that gave me pause. Perhaps he knew he could sell it really quick for $10K and not be out any money since he already had the $8K. Legally, I guess there's nothing wrong if he did that.

Racism has nothing to do with this case. The plaintiff was making problems when there were no problems. The dad signed his daughter's name on totle, LEGAL! The dmv the plaintiff never went to dmv so how was that a problem?? The defendant held the rv for over 2 months with their 8k deposit, which is NON-REFUNDABLE. The plaintiff changed his mind so thats on him.

N he also admitted he signed his ex-wife's name and not the daughters on the form. So to correct it he would have to alter the document by adding the additional name. So isn't that an issue 😕 Bullshit ruling maybe cuz he was a black plaintiff 🤦🏾‍♀️ who knows either way it was a BS ruling

I love when litigants mention they were going to church or are apart of a church like that’s supposed to matter in the decision of the outcome. If you were on your way to a Black Mass ceremony instead of a church, you’re still going to get the same ruling

Given the time between the deposit and raising the title issue, I do think it was a case of buyer's remorse. However - the seller says he ended up selling it for $10,000 looking like he sold it at a loss. He was able to sell it at the lower price because he kept the 7000. - the original asking price.

Wow it sucks the plaintiff's lost their money like that. Technically the title is supposed to be signed by the owner. But the defendant although he lied about the price sold for without a doubt but he was acting on behalf of his daughter. Deposits are non refundable unless it's some shady business going on.

The plaintiff got free lessons on everything about an RV from the defendant, that bent over backwards to make sure the RV was in perfect condition. I never understand why people like the plaintiff don't just go ahead with the purchase and then sell it on themselves, instead of losing out on a deposit, especially when it is such a substantial amount. The plaintiff was an absolute fool...

The seller of the RV ended up selling it for way less because the buyer held up the sale for 2 months. Seasons matter in the RV market. I'm the spring, they're a hot item. End of summer, not so much. I'm the spring people are getting tax refunds, the weather is getting nice and people want to go camping. Not only are deposits non refundable, but the seller also had to sell it a lesser amount because he held it all summer for that guy to back out. His deposit covered the difference in the sale price, too.

That's messed up. The easiest $8,000 that defendant ever made. I feel so bad for the plaintiff's. The defendant was even selling it for $18,000 & because he already had $8,000 of the plaintiff's money, the defendant ended up selling it to another buyer for $10,000. Defendant made out, if you ask me.

What is it with people who say "I go to Church" that then expect that everybody should believe them word for word. Maybe this poor gentleman did think there was a problem with the title. Instead of trying to get his money back, he should have asked the DNV. Like the Judge says; it looks too much like a guy who realised the Winnebago is too big for him to drive in his condition and he just wanted to cancel the sale and get his deposit back having stalled the seller all summer and leaving him with an unsold Winnebago on his arms AFTER the holidays ... Couldn't anybody in his Church or community have told him what the judge ruled ? What a waste of time and money.

If you sell any vehicle that involves DMV, exchange money at DMV and get out of your name. It's worth the time to do this exchange.

Plaintiff made excuses. They got back from vacation, had rethought it, and came up with a BS reason to try and get out of the deal. It's really suspicious that he neither has any texts of their conversations, nor does he have the supposed evidence of the forged document. And damn, the defendant is a good fucking dude

I’m not sure if the plaintiff actually sold the RV for $10,000 or if he went with that number because …well, Judge Judy would’ve told him that he made more than what he was selling for if he actually sold for more than $10,000 in addition to keeping the deposit…but I could be wrong. I do believe the plaintiff asked if he could come with him to the DMV and he said no because he knew it wasn’t necessary. This was an interesting case.

He was selling it originally for $18k. He got an $8k deposit. Held it for 2 months. At the end of summer when he tried selling it again, he only got $10k for it. So the $10k he sold it for plus the $8k deposit, totals his original asking price. He even said he had someone else willing to buy it in early summer for $16k as is. This guy was willing to pay the full $18k asking price. Then backed out. The seller didn't make more than he was originally selling it for.

I agree, I'm suspect that he just so happened to sell it for the amount he knew would allow him to keep the full $8k. Because if he had sold it for more, he would have had to return that overage amount to the plaintiff. I also believe the plaintiff asked him to go to DMV, but he wouldn't. But the plaintiff should have called the DMV and asked how to handle it if the defendant signed on behalf of the daughter.

The judge should ask for proof of the sale of the RV. For all we know he sold it for 19k. He should also prove that he lost money Not saying that the plaintiffs were right. Just saying that taking the defendant's word for it doesn't make sense

judge says the plaintive said the title thing was the next day, but that's not what he said. He said it was the next day after he got back from vacation

The plaintiff was clearly suffering from a case of buyer's remorse. He paid the deposit, but after seeing the demonstration and reading the manual, decided that it would be too much for him. Fair verdict.

I'm just starting the show. I read some comments. $8,000 is too much to keep even if the judge says it's legal. Sure, the defendant backed out. And, that cost plantiff some value between end and beginning of camping season.. But, not 8k. Keeping that amount from an older person isn't Christian. 33' is too long. Not so much for the general driving. It's that it's difficult to find places to park that accept over 30'. People have trouble driving in small cars, even. It's a lack of awareness. If you don't realize it yourself, what will it matter if it's a motorhome? Practice of poor driving assures poor driving. I see that almost no drivers drive properly.
