One of the most "honest" cases I've seen in awhile. No lying, no deception, and no ignorance. The defendants took accountability and moved on without any friction. As my daughter use to say..."Easy peasy, lemon squeezy"😁

I would never agree to let a moving company get my furniture fixed. They are going to attempt to get it done as cheap as possible.

It's mindboggling that a moving company would think they have the right to fix something they broke during their shipping and delivery process. They should have did the right thing and issued the woman the cost of the furniture and her shipping fee. Then they can have the thing repaired and sell it themselves to recoup some of their loss. But for them to try to strongarm her into letting them repair it, then lying and saying it's part of the terms and conditions is totally absurd! They should be shut down by the state.

Yeah, she seems very professional and looking out for her clients. That would really suck to tell a client that if something is broken upon receipt that it's going to be repaired rather than replaced.

Something repaired isn't new. If the customer paid for a new item they want a new item not something that was damaged during delivery and repaired after.

Precisely! I think it is in the company’s best interest to revisit that policy. It doesn’t benefit/help the customer in any way. They will continue to be in court.

Fact of the matter is she paid for insurance on a new item to be shipped, not a repaired item that she lost a sale on because of the shippers incompetence ! If defendant think that item is just as good as new then they can sell it and recoup their losses. Why offer something if you aren’t going to honor it .

just realized that the defendants had a no lose situation on the show: if they lose - they don't pay (the show pays). If they win they still don't pay. the plaintiff only gets the insured amoutn if they win. if they lose, they lose. so for people saying the defendant was surprisingly truthful etc. I don't think its necessarily because they are 'upstanding' defendants - but think it has more to do with : no matter what they say in this situation - they can't really lose

If I am the buyer, and I paid for new, I won't be accepting a repaired one, and if I'm the seller, there is no way I am selling a repaired one, as new. I'm glad she won, but she only won because she hadn't signed their 'conditions' part of the contract...

Why does that matter? It sound’s as though you think the plaintiff won on an a technicality, as though the win wasn’t quite what she deserved. But it’s the defendant’s responsibility to provide the full contract that they want the customer (plaintiff) to sign, which they didn’t do.

While the shippers were likely not careful, that piece of furniture looks very cheaply made. I restore Mid-Century Modern pieces and they would not fall apart like that even when dropped a bit.

Judge apparently thinks a person has to have read and know what the terms are in a contract to be valid . No. The terms are there , and most everybody doesn’t go through them in detail . Terms say repair furniture , which they charge for insurance and shipping based on that . Bad judgment by the judge.

No, the judge said that the customer of the shipping company (“customer” in this case is the plaintiff on The People’s Court) had to have SIGNED an agreement that provided the terms and conditions of the contract, or needed to have checked a box on the signed contract that said she KNEW the terms and conditions by having read them elsewhere on the website. Judge Milian specifically said that it was the customer’s responsibility to read the terms and that if they chose not to read them then any problems arising from that were “on them” (the customer).
