I've seen dogs lunge over fences my entire life. So it is definitely possible. The real issue is Jimmy needs to grow up and learn to speak up for himself instead leaving it to mom.

i guess the judge never saw a pitbull jump before . if a fence is less than 5 or 6 feet tall then a pitbull can actually jump 4 or 5 feet high and move its head forward OVER the fence and bite . there are videos that u can search and see how high pitbulls can jump . the fence was too short to contain a pitbull and even if a person leans their head a little over a fence that is not considered trespassing so i think the defendant should have won .

@@vasylchernovskyi8260 no momentum is needed to land back into the yard , gravity takes care of that , if the dog simply lunges its head forward to take a bite , then the rest of the dog's body will pull it back down to the ground after it bites the target .

We had an attorney friend tell us many years ago, to ditch the 'Beware Of Dog' signs and replace them with 'No Trespassing'. Reason being? If Heaven forbid our dog (Who was a gentle old soul, the sign was more of a deterrent) was to bite someone, and it was litigated, having the 'Beware Of' sign was an admittance we knew our dog would bite. If you warn people not to trespass and they are bitten, that's on them! Of course laws vary from country to country, even province to province where I live in Canada.

ok i just watched this again and this verdict is even WORSE than i thought . the plaintiff walks into an open gate right behind his father when all of the sudden a LOOSE pitbull goes toward him so he backs up toward the open gate to the sidewalk and thats when the pitbull jumps up and bites him . wtf is the judge talking about him leaning over the fence for when u cannot even lean over while u are backing away from an effing pitbull . and why did the lady have a LOOSE pitbull when they knew people would be coming onto the property ? and how can the judge miss all these important details ? this is one of her worst verdicts ever .

I think the judge means, if the guy was 1.5 feet away from a tall fence, that in order for the dog to reach him, it would have either landed on top of the fence or jumped completely over. Neither of those scenarios were mentioned. They said that it bit him but was still in the yard. I don’t think it is a matter of how high the dog could jump, I think it is the fence and the guys distance that makes the scenarios mentioned implausible. Even if he was closer to the fence, the dog’s neck would have caught on the fence to reach him. The way it was described was not plausible.

This happened years ago to a newswoman who was covering a story about a rescued dog from the streets. She had the dog in the studio and put her face up to the dog's face and he chewed up her face severely. This is why no one should put their face in from of a stranger dog. The dog does not know you.

Yes, One of the first things I was taught about dogs when I was little, was never, never put your face in their face, don't tease them or mess with them when they are eating. My parents said if you do that or are mean and the dog bites you it is your fault, not the dogs.

When I was little, my parents had 3 Irish Setters. They are well-known for being one of the sweetest, least aggressive dogs, which is why they get stolen so often. I thought all dogs were this way, so imagine my shock when I tried to give our neighbor’s German Shepherd a hug. He went straight for my face, but pulled himself back at the last second. This was at least 50 years ago, and I can still see those teeth! I certainly learned my lesson!!

Stop. The dog can jump and lunge over the gate far enough to get someone on the face. The dog doesn't have to clear the gate completely. Pits are athletic enough to make an adequate lunge. This judge has formed a picture in her mind and expects the plaintiff to prove her picture. She is contemptuous of the facts presented. These events happen a lot faster than the descriptive vocal telling of it. This judge thinks that the timing of the incident corresponds with her verbalizing of it. It only takes seconds, and I bet this is a behavior this dog does all the time, so it is conditioned and fit to do it.

@@Aceofwolves if u live at a house where u know that people who do not live there will sometimes enter the front gate then u absolutely CANNOT have a loose pitbull in that front yard and im amazed that the judge did not see this because usually she does a better job . and if u cannot shoot someone who is in your front yard near the sidewalk then why can u let your pitbull bite someone ? u can only legally shoot a trespasser if they actually go INTO YOUR HOUSE but not your front yard and the judge should have thought about all this before she gave the verdict .

My young (7 years) son was in the yard, the man was walking directly toward him, and my son jumped back because he was startled. My dog bit the guy once in the shin and then stood between them growling, warning the guy to back off. The man had no harmful intentions toward my son but my dog didn't know that; he did exactly what I would have wanted him to do in such a situation. But, the man won $28,000 from my homeowner's insurance company. For one bite on his leg that required a band-aid (no stitches). Yeah, you can definitely get sued even if your dog is on your own property.

It's really, really sad that the father is a friend of the co-owner of the dog and that same co-owner is literally dying on hospice but the mother of the plaintiff who himself is a barely injured adult pushed and pushed to try and get money for his mistake There is zero evidence that the dog in any way or form breached the fence even in part. The plaintiffs mother should be absolutely ashamed of herself.

I think it is possible for a dog who is in an aggressive, territorial state to lunge further than you think over a fence and bite someone. But whether the dog lunged or the plaintiff leaned in, I would think the defendant (who is your friend?) would have offered to pay at least part of their medical bills. Also I'm curious if the defendant had knowledge the plaintiff was coming to visit or was it a surprise. If they knew they could have chained the dog up knowing they were having company. The plaintiff suing for $5000 however just makes it look like they were in it for a payday.

Unless the dog jumped on to the fence, so its neck could stretch that far out and either slid down the fence again or pushed itself back of to land of the ground (I've seen that plenty of times), then his story doesn't make a lot of sense, but that was not how it was described. Plus, it's suspicious with the weird letter from the young son (no kid would word it like that unless instructed) and that the father didn't want to come, maybe because he didn't want to upset his dying friend or maybe, just maybe because he knows they're lying and want no part of that. To me, it seemed like it was momma's idea and her sons did what she asked them to do, but I could be wrong, wouldn't be the first time, won't be the last.

I have 2 dogs (setter mix & a mini schnauzer/terrier mix) & these two goof balls CAN LUNGE across our fence! Edit to add: our fence isn’t a tall one either, but they do get air! Our setter mix is a big dog too. And the fence isn’t to keep the dogs from running off, they have leads attached to the house, it’s so they wouldn’t go to the bathroom on the neighbors lawn- for clarification.

as she said the dog was doing what it was created to do - protect the children or anyone else that was supposed to be there . also like the grandmother said if that kind of dog wanted to bite him other than a warning to stay away from the children he would have lost part of his face . at a time in my life i had a german shepard - a female pit bull - that was bread for fighting that i got from someone who had it in a basement and chewed thru a wire cage that had burned itself by laying next to a heater for to long and i had to replace windows as she broke thru them and found he sitting on the front steps when i got home - and a male pit bull i bought from someone who fought it from the scars on it. every one of them would protect anyone who was supposed to be there including the male that would protect female guests by sitting on their feet facing even me to show they were protected . my neighbors who didn't speak English kept feeding them thru the fence and liked them so much i had to put large rocks in the hole they dug to get to them. they would protect the property but when anyone including children were around they would have had a leg shot off and still gone at the attackers of the children. they absolutely loved ever child they ever met as that's why they weren't put down when i got them and they might have known the life they were removed from having and didn't want to be simply a killing machine for the joy of nasty people .

Judge has an obvious bias against pit bulls. Actually, many, even most are kept as family pets because they are so sweet. They just have to be well socialized and given lots of love. Just watch Dodo videos and you'll see plenty of examples of harmless pitties acting goofy and loving up on everyone they meet. At least Judge had the good sense to rule correctly. Friendly or not, if you trespass, it's your fault for whatever happens. Doggie is just occupying their space and defending it. Sorry for the young man. Tough lesson. He still looks good though.....

Around 1960 my sister stuck her hand through a chain link fence to pet a dog. The dog bit her. My dad sued the dog owner and won. The judge ruled that the dog was not under the owner's control.

Originally I thought this was a wood fence and I agreed with the judge about physics, but with a chain-link fence, the dog can absolutely get his paws in the links to gain leverage and get over the fence and have his head far enough over for a bite. Especially if it had a running start. I don't believe the plaintiff was as far away as he claims, but perhaps right up to the fence, or only inches away (not a foot or two). BTW I'm a pit bull fan and aunt, so I'm not dissing the breed just looking at how what he described could "defy physics" and not be the plaintiff's fault.

To be fair the dog could have lunged over the fence about a foot or so.. but the only way I see that happening is if the dig first jumps up and puts its front paws on top of the fence and then does a second jump/bounce to lift it's front part of the body up and over the fence and land back down on it's back legs. I've seen dogs do this plenty of times when people walk by their fence and it almost happened to me. I was on the sidewalk, had no clue there was even a dog in the yard I was walking by, and before I knew it the dog snapped right by my ear. Scared the bejesus out of me. I was on the sidewalk the whole time, the fence was at least 4ft tall and the dog continued to bounced along the fence until I was gone.

I think the plaintiffs made up a story that was too improbable that it cost them the case. A homeowner who invites guests over has a duty of care to their guests. Just because I, a guest, step onto your property it doesn't mean that I'm subject to whatever happens to me (e.g., you have live electrical wires on your lawn, you have a big hole that's hidden by weeds that I can step into; you set up booby traps, you have a moat full of alligators). They should have tried to demonstrate (assuming such facts existed for this dog) that the particular dog was a known hazard and that the homeowners were negligent in not taking more care to guard their guests from a known hazard on their property.

We also have a "mean old dog" (she's actually nice to us, but a bit territorial, especially in her old age)... if someone reached into our yard and she bit, it would absolutely be their fault.

There’s no way that this dog could have jumped over the fence, bit the plaintiff (resulting in it losing all of its momentum), and jumped back onto the other side of the fence. It would have landed on the outside of the fence. I personally think that both sides were full of bologna. The plaintiff wasn’t accurately portraying the events that happened and the defendant was acting like their house was waaay more prepared for people to know that they had an aggressive dog.

I feel that you are very mistaken. In my neighborhood there was a back yard enclosed by a 5’ wooden fence. The pit bull looking dogs in that yard could not only leap up and get their heads over a foot out from the fence line, one of them actually managed to routinely vault over the fence. It got so bad that the owners (after people made several complaint calls to bylaw) installed a 1’ topper to bring the fence height to 6’. That stopped the shenanigans. So yeah, I can more than imagine a dog reaching over a fence, biting someone, and then dropping back down into his yard. It depends on the strength and athleticism of the dog. Gravity does the rest.

It's not a breed thing....I watched a lab leap over a short fence and chased me up the road... Thankfully the owners were able to get the dog under control before I was bit.

But the fence was up to his chest. Yea dogs can jump, but if the dog jumped straight up and out, it would have come down on the fence.

My mom had a dog that could clear a 10ft fence. It seems unreasonable for Judge M to act like that isn’t possible or even consider the idea. It just makes no sense. Especially with the defendant lying.

One of the few times I don’t agree with the judge. They were there to visit, he was on his way through the fence anyway and on to the property. She’s almost punishing him for being cautious and stopping outside the fence. If he had continued to follow his Father in through the fence the dog probably would have still bitten him, how is that his fault? If you have guest coming over maybe contain your dog better so they can't bite your friends faces.

Um owner doesn’t have to have ANY signs. She has a fence and contained her dog properly. Defendants mother is greedy and looking for a pay day. Jimmy definitely was too close to the fence and to the dog. It was his own fault.

A dog can easily jump onto a fence and reach out over a foot and return, I've seen it happen. I have doubt that that's what happened, but it can.

Absolutely a dog can lung over a top of a fence. Especially a four foot fence , even a five foot fence. Not sure what happened here but my own dogs would easily climb chain link fences.

The judge is wrong on this one, yes I've seen dogs jump up and grab /bite a tire hanging from a tree. Imagine an angry pit 100% they will jump up and snap and bite your face and so fast you will have no time to step back. Notice how everyone in the crowd said the owner was responsible.

I think what she was saying though was if the dog cleared the fence and went another foot and a half, wouldn't the dog now be free? To continue to bite? I agree that it's possible for my pit to lunge at that height but if a person was standing completely upright a foot and a half away, she'd be on top of him at that point. To add to it, his instinct would have been to jump back at that point, making it even more possible for the dog to continue in a forward direction and not like a basketball hitting a backboard and bouncing right back into the fence?!

This was a tough case. It looked like a 4 ft tall chain link fence. If that's the case, a pitbull when I'm running start could certainly jump to the top of that fence and lunge over a foot and a half to bite that kid in the face. I don't think he really told his story well enough for the judge to understand how low the fence was. But I definitely understand her ruling. If there's a dog, and a fence, and a no trespassing or beware of dog sign, it pretty much relieves the owner of liability for a dog attack.

i guess the judge never saw a pitbull jump before . if a fence is less than 5 or 6 feet tall then a pitbull can actually jump 4 or 5 feet high and move its head forward OVER the fence and bite . there are videos that u can search and see how high pitbulls can jump . the fence was too short to contain a pitbull and even if a person leans their head a little over a fence that is not considered trespassing so i think the defendant should have won .

@@marleonetti7 definitely putting your head over the fences trespassing. It will be the same concept as if I own a tree, and the branches hung over your property. You can cut those branches right up to the property line all the way up to the sky. That's my part of the tree. But you're definitely right about pitbulls jumping. There are videos out there of pitbulls that can literally run up a 15 ft wall. I know that takes training, but if the average Pitbull can jump even a third of that, we're still talking about 5 ft. I believe that's plenty of room an opportunity for the dog to bite someone who is *not* over the fence. Nevertheless, it's irrelevant because there's a fence and there are a number of other aggravating circumstances which would have led a reasonable individual to stay away from the dog.

ok i just watched this again and this verdict is even WORSE than i thought . the plaintiff walks into an open gate right behind his father when all of the sudden a LOOSE pitbull goes toward him so he backs up toward the open gate to the sidewalk and thats when the pitbull jumps up and bites him . wtf is the judge talking about him leaning over the fence for when u cannot even lean over while u are backing away from an effing pitbull . and why did the lady have a LOOSE pitbull when they knew people would be coming onto the property ? and how can the judge miss all these important details ? this is one of her worst verdicts ever .

5 stitches in my nose because the neighbors dog bit me. Why did he bite me? Because I put my face up to him like I always did with my dog at home. I was 8. My parents were upset that I was bit, concerned if I was ok, turned out to be nothing serious but some stitches, but never once considered suing. That dog would never have attacked me if I did not do that.

The people who is blaming the plaintiff for getting bit in his face is not right if ya'll were bit in the face how would you feel? I believe this: The plaintiff went to walk behind his dad and he was too close up to the fence, the dog started barking then the dog jumped up and bit his face. The only thing is I don't believe the dog bit his severely to cause stitches because he don't even have 1 scar on his face. The dog nipped him on the face but not enough to leave deep puncture wounds. Another thing is why the dad didn't show up in court, that's odd?🤔🤨😐

I'm having a problem, with people showing up, at a house surrounded by a fence, and just walking in. He said they were in the area. Were they expected? Even a service worker would not enter, with a dog in the yard, without a homeowner's presence.

I think the young man was less than honest when he said he was not on the property. He probably followed his dad to the door. The dog lunged at him. My personal observation and opinion . In any case the owner should have had the pit bull contained. And have a ‘beware of dog’ sign on the fence.

I think the dad brought his son and told him to stay put cuz he prolly knew the dog was aggressive to strangers. The son prolly didn’t believe him and tried his luck and got bit which is why dad ain’t here. Or the son is telling the truth and the dog lunged at him. Either way the defendant did her job by enclosing the dog in her yard. Sign or not.

Whether it's a beware of dog or no trespassing sign it doesn't matter it's telling you to stay off the property for a reason not only that but the dog was inside of the gate.

A pitbull can easily lunge foward by pulling itself with its front legs, using the fence as leverage. However i think he was closer than 1ft away

Even if the dog jumped and its jaws crossed the top of the fence, the defendent had to either be leaning on the gate or, at the very least, had the front part of his body in contact with the gate. It would be too much of an angle otherwise.

The judge has clearly never seen a dog jump up and lunge over a fence. I used to have a great dane that did it to passers by. Admittedly all he ever did was wag his tail and try to lick people 🤣 But yeah, dogs can do this easily. 2 seconds of searching on youtube and you can see tons of clips of dogs doing it.

I don't believe the plaintiff leaned in. It is absolutely possible for a dog to jump on a fence and stretch out as it's excited and bite someone. And that's a chain link, those can have a little give. Not like it's a privacy fence or something. Judge had her mind made up before the case started

Absolutely! Grew up with dogs, not pits. When a dog jumps excitedly, their head is easily over the fence and they land back down. Grew up with dogs that stayed behind a chain link fence. THEY DO HAVE GIVE! Also, It’s sad his Dad didn’t show up, he choose an old neighbor over blood??!! Then the defendant lied about the signs. Please!

He probably did. If the dog was already barking and he was wary of it, he would have had plenty of time to get away from the fence if it reached over to get at him. But he somehow got bit. He *had* to have poked his head over and gave the dog a little greeting. Maybe it stood up slowly and he thought it was nice, but it bit him instead. That I have seen happen. You think a dog is friendly, it sniffs you for a bit, you think its fine, then suddenly it snaps. I work with rescue dogs, so I know. Fortunately I have not been injured. Yet. xD Some co-workers though I've seen this happen to. Anyway, even if the fence had give, he stated he was a good distance away. If the dog had a running start, he would have seen it coming and moved away no? On the other hand, if the dog was by the fence, I do not think it could have jumped up that height, extended its upper body and head that far to reach him, snap his face, *and then* pull itself back into the yard as if it was holding onto the fence. It's just not possible! Imagine it, and consider where most of a pitbull's weight is! It would have bit his face, flipped over and fell onto the footpath if things happened the way he and his mom are saying! ;w; More likely scenario: He peeked over, it stood up to nip him, and he just had that split second to recoil so it wasn't able to grab onto his face to do more damage. It ends up right back in the yard.

I was a mailman for over 7yrs . I’ve seen many dogs get over fences . They bite the Judge was wrong!!
