Abiyah, it nice to see someone acknowledge 'Marbury v. Madison', however, you misquoted the the text of that decision. In Marbury v. Madison, the court wrote, "Any law that is repugnant to the Constitution is null and void."

Yes, and all the fees and court costs will have to be paid by the people arrested. Unless they manage to get a lawyer that can win a civil case against the city. But even then the citizens get to foot the bill. Police get paid by the citizens to collect 'taxes' from the citizens with fines and charges and if they lose a counter case then the citizens have to pay for that as well. And the money the P.D. generates? that mostly just goes to the P.D. Policing is such a scam these days.

Even if they did violate a noise ordinance, ordinances are usually attached with a decibel limit. That said, the officer did not have a way to measure the decibels and just arbitrarily arrested a person based on his own rational.

I agree! Most of the people charged (and even convicted) of these unconstitutional laws don't know they are unconstitutional and don't have the resources to fight them. I think groups should make a list of unconstitutional laws and then bring these lists to town hall meetings and show the town the unconstitutional laws. Challenge them to remove the laws and make residents aware of these unconstitutional laws.

@@1stamendmentmedia464 you don't have to follow laws that are unconsitutional. You may get arrested but it can be proven wrongful by definition if the law is unconstitutional. So I wouldn't give them too much attention.

I could swear noise ordinances have a decimal limit and a time restriction inside city limits......? So technically if they cannot prove those two stipulations were violated, they cannot prove guilt. What if i wanted to use a leaf blower and clean up the street. Noise ordinance violations are in place to deter people from mowing grass at 3am in a residential neighborhood so it doesn't bother productive citizens from getting much needed rest before going to work so they can have a percentage of their income taken from them to enforce said violation..... FTP! Ignorant POS's couldn't provide a real service if they were paid to do so🤦........ PS. Im using sarcasm there😉

When a cop immediately pushes hard for someone's identification and then makes threats to arrest if they don't give it, that's a clear indication of a quota arrest. In the state of Texas, a member of the public is under no legal obligation to provide identification to the cops unless they have been LAWFULLY ARRESTED! Texas penal code 38.02 says so, but as we can see, this cop didn't care about the law he took an oath to uphold. This is an easy win in court if he chooses to file a lawsuit for deprivation of rights under the color of law.

The police officer acted badly, had an attitude problem and did not possess a basic understanding of the Constitution. If he wanted to enforce the city ordnance, he should have brought and used a decibel meter. That being said, you need to look up the word "atheism". Atheists are not part of any church, that's the whole point. You can live a good and respectable life without believing there's a magical being somewhere in the sky.

From what I’ve read, this happened in 2018, and they ended up booking him on trespassing, not a noise ordinance (I wonder why?). Then they took it further by going to the press and saying these guys came on to the property and yelled at kids telling them that Santa wasn’t real during the church hosting a Christmas pageant. This made a ton of news outlets and even the mayor commented “we’re all for freedom of speech but don’t mess with Santa!”. It’s crazy because nobody must’ve watched the body cam footage back then or they would’ve easily seen this whole thing was nothing but illegal cop activity. I hope this guy sued or goes back and sues…

I actually agree with you. Much like you, I'm a former police officer as well. I agree that the overwhelming majority of law enforcement officers are in fact "bad" per se. It's very much the opposite of the "most cops are good" ideology.

The cop immediately jumps to demanding ID and threatening arrest if they don't provide it. - The cop clearly is IGNORING Texas law 38.02 regarding when a person must lawfully provide ID. He also is going for "Arresting for Failure to ID", which happens to be a secondary offense. We are only seconds into the encounter, and he can't stop himself... he throws dives right in and starts digging himself (the department, and city) a massive hole, and goes for the gold, by violating their constitutional rights. He doesn't care because he has "Qualified Immunity" and it won't affect him or his career is any way. The "upside" in his mind is that he gets these "people" to stop doing what someone else doesn't like, and he doesn't like it either. EGO EGO EGO!!!

the noise ordinance (A) Any unreasonably loud, disturbing, or unnecessary noise which causes material distress, discomfort, or injury to persons of ordinary sensibilities is declared to be a nuisance and is prohibited. (B) Any noise of such character, intensity, and continued duration which substantially interferes with the comfortable enjoyment of private homes by persons of ordinary sensibilities is hereby declared to be a nuisance and is prohibited. Seems to be unclear and a violation of the 1st amendment.

This is the test that many people fail when it comes to the first amendment. I have been an Atheist my entire life and choose to live my live my life based on facts and evidence that comport with reality rather than faith and superstition. So, I couldn't disagree more with their religious message, however their right to freely speak must be respected and protected. The speech that needs the most protection is the speech we disagree with. I hope these guys follow thru with a lawsuit

I dont think the cop did it all right, but i dont think that freedom of speech gets to be unhindered at 100, 150, or other crazy number of decibels. You dont get to express yourself freely until peoples ears bleed. Of course that is an exaggeration, but shows that not everything is an absolute unlimited right. Personally, i would have preferred a megaphone showdown until both sides went deaf. A perfect self smiting while imaginary god falls off his chair laughing.

This is a 5 year old video. I spoke with a Sargent there today, and all new officers for the last 2 years receive a copy of the US Constitution and are tested on it. Changes in the Right direction, and Accountability for actions being held.

Cops have discretion. That means they can choose to not threaten or cage anyone. It's a personal choice. They can choose to not use "laws" or their job procedures as excuses to threaten and harm peaceful people or they can choose to be tyrants. They can also choose to make up shit to use as excuses to violently punish peaceful people. Choosing to be peaceful with peaceful people is rare amongst the violent gangs of armed enforcer's of politician's dictates.

Nope - I disagree. In this case, the police officer is 100% CORRECT. In Cleburne, TX they have two relevant ordinances that do not violate the Constitution. § 130.05 LOUDSPEAKERS - USE ON OR NEAR STREETS and § 130.21 NOISE AS NUISANCE. This is an example of where the government can apply time, place, and manner restrictions as long as they aren't regulating the content of speech. Specifically, "the use of a loudspeaker or amplifier of such intensity that annoys and disturbs persons of ordinary sensibilities" is valid. Now, cities MUST allow the use of amplified sound devices; however, they CAN require a permit to do so. Typically, a permit MUST be issued the same day. The ordinance clearly states that you have to request a permit from the Chief of Police. This is usually done to ensure that applicants understand the time, place, and manner restrictions. For example, it is reasonable to prohibit sound amplification after 10 p.m. 1989 Ward vs Rock Against Racism, 491 U.S. 781 - Time, place, and manner restrictions are required to be “content-neutral limitations” imposed by the government that serve a significant governmental interest and leaves open ample alternative channels of communication. If these young men didn't use a sound amplifier, then the cop would be 100% WRONG. But they did and citizen complaints were valid based on the noise produced (not on the content of their speech). That said, in Texas you do NOT have to provide identification unless you are LAWFULLY ARRESTED. They CANNOT arrest you for not providing identification... period. The officer had specific and articulable facts that supported his reasonable suspicion that a crime had occurred, and the detention was lawful. But you can't arrest someone just because they refuse to identify. In this case, you can arrest them for violating the sound ordinance (and then get identification). Title 8, Chapter 38, Section 38.02 - Failure to Identify happens when a person intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information. 1985 Hayes vs Florida, 470 U.S. 811 - The Court held where there was no probable cause to arrest, no consent to the journey to the police station, and no prior judicial authorization for detaining a person, the investigative detention at a police station for the purpose of fingerprinting violated the Fourth Amendment. 1979 Brown vs Texas, 443 U.S. 47 - The Court held that to detain a person and require him to identify himself violated the Fourth Amendment because the officers lacked any reasonable suspicion to believe he was engaged or had engaged in criminal conduct. You have the right to express yourself, but cities CAN require a permit for a sound amplifier. Just using your voice CANNOT be restricted in a traditional public forum, like SIDEWALKS. Using a megaphone may be against the law without a permit (check your local city). 1983 Perry Education Association vs Perry Local Educators' Association, 460 U.S. 37 - Traditional public forums include streets, parks, and places traditionally open “to assembly and debate.” That said, arguing with police is LEGAL. Interrupting police when they are talking to you is LEGAL. In Texas, your speech CANNOT be considered "interference." Title 8, Chapter 38, Section 38.15 - Interference with Public Duties requires criminal negligence; furthermore, subsection (d) states that “it is a defense to prosecution if the interruption, disruption, impediment, or interference consisted of speech only.” 2020 Voss vs Goode, 5th Circuit - The U.S. Court of Appeals for the Fifth Circuit, which includes Texas, held that “merely arguing with police officers about the propriety of their conduct falls within the speech exception to section 38.15” and thus does NOT constitute probable cause to arrest someone for interference. 2007 Freeman vs Gore, 5th Circuit - The U.S. Court of Appeals for the Fifth Circuit, which includes Texas, held that although Freeman was “yelling” and “screaming,” that alone does not take her conduct out of the realm of speech. Deputies did NOT have probable cause to arrest Freeman for interference. 1987 Houston vs Hill, 482 U.S. 451 - Held that “the First Amendment protects a significant amount of verbal criticism and challenge directed at police officers.” It is lawful to interrupt a police officer and to verbally challenge them during ANY investigation. “In the face of verbal challenges to police action, officers and municipalities must respond with restraint.” “The freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state.” You have the right to hold signs in public. You have the right to offend anyone in public. 1975 Glasson vs City of Louisville, 6th Circuit - The U.S. Court of Appeals for the Sixth Circuit held that police officers were not authorized to forcibly take a poster from someone standing on a public sidewalk and destroy it. Police were held liable under section 1983 of the Civil Rights Act because the activity was protected by the First and Fourteenth Amendments. 1992 R.A.V. vs St. Paul, 505 U.S. 377 - "The mere fact that expressive activity causes hurt feelings, offense, or resentment does NOT render the expression unprotected." 1949 Terminiello vs Chicago, 337 U.S. 1 - The Court held that a “breach of peace” ordinance that banned speech that “stirs the public to anger, invites dispute, brings about a condition of unrest, or creates a disturbance” was unconstitutional under the First and Fourteenth Amendments. That trespass warning was COMPLETELY BOGUS. Title 1, Chapter 1, Section 1.07 - Definition of Public Place means any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, and shops. 2000 Loera vs Texas, 5th District - The Fifth District Court of Appeals for Texas determined that “if the public has ANY access to the place in question, it is public.” “The evidence of this case turns on the meaning and application of the term ‘access,’ not on the common understanding of the term ‘public.’” Title 7, Chapter 30, Section 30.05 - Criminal Trespass occurs when a person commits an offense if the person enters or remains on or in property of another, including residential land, agricultural land, a recreational vehicle park, a building, a general residential operation operating as a residential treatment center, or an aircraft or other vehicle, without effective consent and the person: (1) Had notice that the entry was forbidden; or (2) Received notice to depart but failed to do so. 1988 Reed vs Texas, 6th District - The Sixth District Court of Appeals for Texas held that a volitional refusal to leave when requested is required for a conviction. This cop didn't try the 'ole disorderly conduct nonsense that most cops do, but just in case a Texas police officer tries to arrest your for disorderly conduct, remember the following. Also, contrary to what every Texas cops believes, vulgar language is NOT illegal in Texas (unless you are trying to bait a fight). Title 9, Chapter 42, Section 42.01 - Disorderly Conduct is an intentional act to incite a breach of the peace by attempting to provoke violence in public by using abusive language or offensive gestures, create noxious odors by chemical means, or make unreasonable noises. 1997 Spiller vs Texas City, 5th Circuit - The U.S. Court of Appeals for the Fifth Circuit, which includes Texas, held that section 42.01 applies to “fighting words” only. 1971 Cohen vs California, 403 U.S. 15 - Held that profane words, in themselves, cannot be banned under the First Amendment and prevented the conviction for the crime of disturbing the peace. 1942 Chaplinksy vs New Hampshire, 315 U.S. 568 - Established the doctrine of “fighting words” as having a direct tendency to cause acts of violence by the person to whom, individually, the remark is addressed.
