I remember recently seeing this product on Amazon a few months ago, when I was looking to replace a silicone cap I had, that lost the no-splash cap. I had some of those caps for a few years, which worked very well, and couldn’t locate the original listing on Amazon. Now I know why 😂 The name alone on this product caught my attention right away, and appeared to be a very solid product that wasn’t a knock off. The only reason I passed on this product, is because it doesn’t work for dispensers that have the no-splash feature.

WOW another eye-opening interview! Thanks Stephen. And huge congratulations, Brendan! It seems that the Design Patent alone was not enough for Amazon to take action on infringements, so getting an actual RESTRAINING ORDER was necessary?!

@mkprr this is a legal question. I’m sure if you can prove that they are infringing on your intellectual property with some of the tools such as trademarks, design patents, utility patents all of this can be extremely helpful. But with a design patent it’s very easy to see if someone is infringing on your design. Utility patents are a little bit more difficult to interpret. Just my opinion.

The only people that come out ahead during patent disputes are the attorneys. Get the patent, but they are very easy to get around.

Every situation is a little different. It’s important to be prepared for the copycats and that should include patents, trademarks, and even design patents!

How much did it cost to do this restraining order with est go and how long did it take from when you hired them to when amazon finally complied? Do you pay an ongoing fee with them or was it a one time and done fee? I am part of a shark tank group and tons of us have infringers of our patents and it would be great to share with them what works.

@@ElieAnquetil it really all depends. Design patents can help tremendously on e-commerce sites. But utility patents are still extremely important.

If you market your product with only PPA protection during the one year period and others knock you off, even though you notify them with “patent pending” is there any way to get compensation after the patent issues? I thought you could sue for treble damages, but not sure how successful that approach is. Couldn’t the knock off artists also simply claim “ignorance?”Thoughts?

@@neatmachine that’s a very good question for a patent attorney. In my opinion, there’s nothing to do until your intellectual property gets issued. Then once you notify them if they don’t rectify the situation, it increases the amount you might receive if you litigate and win.
