yeah i am on the 2nd floor and the third floor people got some bird feeders, had bird shit and seeds all over my balcony, i dont care what you do but as long it doesnt mess with my things i dont care.

I bought my house specifically because there was no HOA. And everyone’s house is nice. Everyone has different plants and color houses. The way it should be.

You’re lucky. I’ve lived in HOA neighborhoods that were great and non-HOA neighborhoods, some great and some not so good. When the HOA functions to prevent trashy people from parking junked cars in yards, preventing on-street parking that impedes flow of traffic, keeping people from hanging offensive signs, making sure trash cans are obscured from view, etc. they are great. Keeps that one trash family from ruining the neighborhood for everyone. Things like prohibiting charcoal grills on condo balconies, etc. are safety issues that need to be enforced. People live in HOAs because others cannot be relied upon to behave properly and show any respect for the fact they aren’t alone on a remote 100-acre farm. But when an HOA gets power mad and starts dictating the types and colors of flowers, the number and shape of shrubs, etc. then it gets oppressive.

Not necessarily. If the government stepped in and regulated them they would be forced to abide by said regulations. That way if they tried any bullshit like this they would get in trouble with the feds. Which could land than in prison.

I don't think they should be ban but I think it should be regulated. Like any resident (and stockowners) can be nominate and elected to be an HOA. If any HOA in the community considers incompetent, controlling and such will likely be impeached or recalled. Of course I do believe when you're in a community you must have rules but should also be mutual for all residents to agree upon and for the good of the community itself.

If the kids were in the street, the person filming could excuse it as them just filming in public and the kids happened to be there, regardless of what they were wearing or not wearing. If they're putting the camera it into a private garden, they're intentionally filming children like that.

So why doesn't someone call the police on them?! It is against the law for peeping toms and especially filming in someone's private home. It's called the "voyeurism law, This statute prohibits anyone from looking into a person's house, structure, or conveyance or from looking at a person's intimate areas that are protected by clothing from the public view.

You have zero right to peer into someone's patio like this. You can't film or take pictures in any place where a "reasonable expectation of privacy" exists. This absolutely ended poorly for this HoA. If this ever happens to you, don't wait for the lawsuit. Call the police immediately.

We just want to live in a country that doesn’t take advantage of its citizens, condemns racism and sexism, equal rights and pay, and isn’t afraid of change for the better. You cannot have progress without changing what wasn’t working. We honestly do not care what people do in their day to day lives unless it directly affects us (such as putting us in harms way, or mistreatment of our fellow man/woman).

Why ANYONE would buy into a HOA is beyond me. My wife and I “looked” at a condo and found out it was in a HOA. We had our realtor get a copy of the “rules” and in reading them over, we laughed at the fact that anyone in the HOA, “even just driving by” saw “from the outside” window coverings, I.e. blinds, curtains, drapes, etc on your widows and did not like them/complaints, you have to change them….That was just one of the stupid things…If there’s and HOA….pass on it, even if the “rules, don’t seem that bad” remember, even years later, a newly board changeover can change the rules you agreed to moving in.

Same people that complain about hoa's for whom exist to impose rules complain about not wanting to follow the rules of the HOA. I do feel sorry for people in situations where the rules are changed after agreement however everyone can save themselves the hassle and never move into one.

CanadianCCP 😀 Yes, probably as much as anyplace! I think the lure of HOAs, though, is more about the maintenance (never having to mow is a plus) and getting to have amenities that they normally couldn’t afford. And people do feel safer in a gated community. I rented a condo with an HOA paid by the landlord which was _spectacular_. 20-person got tub, beautiful pool, tennis courts, clubhouse, barbecues, gym, sauna, steam room, koi ponds, lagoon, you name it. It was beautifully kept by the HOA. I had the opportunity to buy it, however, and as much as I loved the place, I just really didn’t want an HOA. That was even before hearing about all of the nightmare HOA stories out there. I’m pretty thrilled with our tiny house that has none of those amenities, to be honest.

Use a Batleth on the hand holding the selfie stick. Don't think I haven't used one on an intruder, because I have. That why they had extended stays in the ICU. A half sized batleth can gut a man in less than a second, a full sized on can cut him in two.. Son, I hand make them and they are scalpel sharp. and very much in demand.Such Star Trek Props are. I'd stay out of view, go around to where they were, and ask if I could see what they found so interesting. I'd then inform them that what they were doing is not only invasion of privacy, it's also illegal entry onto private property to conduct unauthorized surveillance. When they told me who they were, Mr/Ms self-important from HOA, I'd demand to see the search warrant, which those idiots never have, followed by a call to the local police to have them arrested. Where I live, there is no HOA, and the people who tried to start one were laughed out of the neighborhood many years ago. The closest HOA is about 4 miles from my town, and they don't have any say here about anything.

I used to have an apartment, and if I was 3inches out my parking bay, I would get a knock at the door and a letter. The property manager lived below me and didn’t like my car to far under her window. So, I then would go out to work for the day (while they were retired at home all day), and leave my stereo blasting with death metal, or sometimes the Indian channel.

My understanding is it's legally very difficult to change HOA rules once established, even if most homeowners agree. My brother's HOA tried to change the rules about homeowners being allowed to rent their houses. One homeowner challenged it and they were forced to keep the rules as established when homes were initially sold.

Christopher Comer HOAs are everywhere now. it's hard to buy a property without one attached to it. even my neighborhood has one now. when I bought the house in 1987 there wasn't one, but it was created about 15 years ago. immediately they knocked on my door talking about "violations". I told them all to eff off for about a year until they gave up. I'm not part of their HOA, I was here first, before the created it, and I've never joined it so they can blow me with their "rules". this hasn't saved me from their nonsense though. they report me for city code violations whenever possible. if a car tire goes flat in my driveway overnight there is a orange sticker on the window from the city in the morning that it's a derelict vehicle. if my lawn grows over 5" tall there's a city warning on my door to cut it or be fined. when my paint started to chip I was warned to paint it immediately by the city. I painted it baby blue and hand painted a big ass cartoon dolphin on the garage door and left it like that for 5 years. This time when the paint chipped the city politely asked if I could paint it and donated me 40 gallons of beige paint to do it with so they would get a color that they preferred. it's all big bullshit. The HOA, if you are part of it are going to harass you into spending money all the time to keep your property in tip top shape if your not part of it they are going to bust your balls any way they can to harass you into falling into line. they can all move out of my neighborhood for all I care. bye bye.

All of the decent areas around me have some form of HOA. We do not have a choice unless you want to move your kids into the ghetto and possibly get shot or an hour away from the city which puts financial strain on the adults because now you HAVE to have cars which require gas, insurance and upkeep.

I used to manage a condominium with a home owners meeting once a month. Initially upon my hire the members were highly intelligent very capable people whom I enjoyed working with as they worked to pull the condo from the edge of bankruptcy cased by bad management in the past. Unfortunately after our collected efforts had stabilized the condos finances and future, these individuals decided over a short time to step down and let newer members take control. Inside of a year the board totally changed and these newer members started making changes and bickering between each other at the meetings. It soon became clear these individuals had none of the quality's of the older group. These people had low responsibility jobs and no say in how the businesses they worked for were run. So now they were on a homeowner board where once a month they could speak out and be heard no matter how trivial and petty the topic. After they started trying to undo the work of the previous group I just had to quit. Their nonsensical power plays and pathetic arguments made me totally change careers.

Have your attorney prepare the documents to "OPT OUT" of the hoa. Then immediately file no contact order on all hoa members. We did it here at a local airport in Washington. They threw a fit, then they left us alone!!! Cost me $1,500 attorney fees, WELL WORTH IT!!!!

Not everyone have that option. Most HOAs are set up so you can opt in but can't opt out. The exceptions are usually when someone inherits property encumbered by an HOA because they didn't buy it.

When I was looking for a home to buy, HOA would be a deal breaker. No matter how nice the place was, or how affordable. My real estate agent kept showing me HOA houses, so I finally quit him and found someone else.

Dude the HOA is one of the many reasons my family moved out to where there is no HOA and I'm glad out here the only thing you'll get bothered about is maybe if your dogs escape and start chasing people (I get chased all the time) but back at our old house they told my parents that we didn't have enough plants in our yard that was litterly all rock and then they go ton us when one of the plants died which I believe is because they were planted in a yard that was all rock.

Anyone would be perfectly in their rights to get aggressive if they witness a selfie stick cellphone poking into their private space. I've been in a seasonal POA for over 36 years in PA. I've attended many meetings in order to reason with them about their bi-laws. For instance, I can't PARK my RV on my property because I already have a park model trailer. They consider the that a second "trailer". This started 2 winters ago when I parked my RV on my property and had it covered/winterized. What really burns my behind is that it seems it's perfectly ok for some property owners to have run down, unkept trashy looking lots but I can't PARK my RV.

A long time ago, my step brother once lived in a two story 4 bed, two and half bath home with a pool sized backyard and two car garage in an HOA and he said that he and his wife told them goodbye. Very nice house too. Typically, those homes go for 150,000...275,000, easy. They had a ban on using a generator on your property. I get that...I have been there before someone who was using a generator outside to power an RV and they truly are obnoxious. However, this generator rule was REALLY BAD. My step brother was using a vacuum cleaner to clean out his wife's car. Small wet/dry vacuum. Only a one gallon wet/dry vacuum cleaner. He got cited for using a generator on his property. Yes, he got a letter of violation for using a generator over a vacuum cleaner. He said that he had a very hard time selling the house. In addition to that, he said that the house was insanely cheap. Only $58,000. And, when he sold the house, he was only able to sell for 30,000. I saw the deed for myself. It is so amazing how bad HOA's can wreck the resale value of the house. Even if the rules are reasonable, be careful. Always ask how the rules are enforced. And, find out what do they consider as violations. It is just beyond any sort of belief what bad and unfair HOA's can do to a home value.

You can stand on a public street, but you can't stick a part of yourself in my private property. Here, the HOA is using an extension to invade the homeowners property. No different if they were using a drone. See 1797's State v. David and 1946's United States v. Causby - very low level flight can be described as a taking, or trespassing.

I use to think that way, but an HOA does actually have a purpose. It's meant to pay for services that are done around the neighborhood like if there is a park, or water for sprinklers, trash pick up, lawn care. If it's something that isn't the responsibility of a home owner on their property, then the HOA is suppose to take care of it. There definitely needs to be more restrictions on what an HOA is allowed to do though. Mainly removing their ability to tell people "No, you can't do that to your home that you payed for". A fine for letting trash pile up on their front porch, ok I could agree with that to an extent so long as the fine isn't for a stupid amount. A fine because they have potted plants on their porch? Fuck that bullshit. Also remove their ability to evict people from their own homes. If they want to enforce a fine, take it to court and let the legal system enforce it if they decide it was for a good reason.

Better yet, that mother should have let her daughter go out onto the patio naked when they were taking pictures with their selfie stick. Then immediately call the police of a possible child pornography ring within the HOA board. They could never withstand that nuke.

@@sempermilites87 Do not remember where it was but a HOA board member was walking into backyards and looking for violations. Walked in on the homeowners wife sunbathing in the nude (set-up like a bowling pin). Cops called trespassing, peeping tom, invasion of privacy etc...

Anyone who chooses to buy a house that is controled by a HOA is an idiot. Why on earth would you pay money to have someone else control your house... Never heard a good hoa story, not once...

idget Fiver i live in an HOA and it’s great. They maintain the property, the pool, repair the roof, the decks and patios. They maintain the road, the parking spaces. They clear the fallen tree branches, they plant flowers, trim bushes, rake leaves. They shovel the snow, and plow the parking spots. All aspects of sharing property with other owners are covered. They make sure other owners don’t park in my spot. They make sure that my neighbors get their chimneys swept and dryer ducts cleaned so that they dont start a fire and burn down my condo. We have rules to enforce, and we have maintenance to do. The HOA accomplishes all those things. In a condo, it’s the only way.

doomtomb3 i was responding to a comment that literally says that they never heard a good HOA story ever. Thats because of negativity bias. Who would report on a HOA functioning as intended? That isn’t news. Thousands of HOAs work fine and are needed for situations involving community property. I in no way am defending this particular HOA, and I am sorry if you somehow misinterpreted my comment as that.

Our lovely HOA left us a letter about our basketball being tipped over because we had to take it down because it fell on my car and dented the roof. It was barely on the ground for a couple days and they left us a passive aggressive letter about the “issue”. It wasn’t as if it was at the foot of the driveway, it was on our end by the garage.

They need to sue the HOA first, if they do the HOA will have to cover the costs of lawyers and such. If the HOA sues first they have to go to court and pay for everything themselves. The fact that the HOA lady has stuff that violates their rules while they enforce those rules one others could be a case of discrimination in court.

We sold our farm on the East coast and moved to the midwest. The first thing on the list for the realtor, No HOA. Second thing on the list, outside any city limits. Cuts down on most BS We ended up outside an actual ghost town, surrounded by woodlands, hayfields, and pastures. Quiet and peaceful.
