Removing the brace DOES NOT turn it back into a regular pistol, and the ATF can fully prosecute you for having ever had it in your possession without a tax stamp, and they will if they have any evidence you had it like CCTV footage from a gun range or social media posts because they want a conviction and it's the only crime they'll have you booked on. A gang member shoots up a hood party with a full auto converted actual SBR and the gun charge will get thrown out in a plea deal to get a conviction for the shooting, a loving mother or father of two who just likes to go to the gun range on the weekend and doesn't know about the new brace rule is getting bitchslapped with 10 years and up to a $250,000 fine because the bullshit gun charge is the one and only thing they're getting prosecuted for. This rule is a goddamn honeypot with textbook entrapment written a couple dozen times over in it, the "waived" tax stamp isn't even fucking waived and they can still arrest you even after you get for unlawful possession of an NFA item which you have to give them photographic evidence of before getting that "free" tax stamp in the first place.

It's an enforcement agency which makes it part of the executive branch. That gives the ATF the ability to interpret the law through their enforcement. They've decided braced pistols meet the definition of a short-barreled rifle under existing laws and are going to enforce that law the way they've interrupted it. Unless the judicial branch adjusts the scope and specificity of the law or the legislative branch makes a new law impacting the definitions of the existing law, this is absolutely within the ATF's power. It's an inherent power. Like jury nullification or pocket vetos.
