Absolute gold from start to finish, there was 1 boss in that shop today and we know who it was. Schooling the officer on data protection acts etc. The fool had to try and say he would do it through official channels..... yeah right pal !

My opinion is this... No police force can give details whether civil or criminal. I find this police officer was sticking his nose in where it was not legally or lawfully required.The customer was 100% correct and the shop assistant was just following bad advice! Royal Mint should be taken to court for fraud for making the commemorative coins legal tender knowing full well, that shops and banks will not take them!!! Royal Mint can make any coin they want and it can be commemorative, but the mistake the Royal Mint made was to give the coins legal tender status. Petrol station should just accept the coin and send it to Royal Mint for exchange as the customer had every intention of paying with legal tender and I would hazard a guess, that there was no notice on the pump stating which legal tender was acceptable or not. Great video exposing police officer not acting impartially.

Banaman, you make a good point there, we all love a good loop hole in the law but the responsibility is with Royal Mint. I’d like to see a follow up video of a garage owner going to the mint to swap them for notes. 😂

6:20 This is the moment that the constable stole £50 from the supermarket. He took the money from the cashier under false pretences (because he doesn't know the law and made up some false law) and did it purposefully to deny the supermarket their money. That he then passed it on to the guy who bought the fuel doesn't mean that he's cancelled out the crime, it's just made it worse as he has now exacerbated the crime from theft to handling stolen cash.

I believe this one could be a grey area as the Cop explained this is being passed back to you as a rejected payment and the customer took it from his hand and did not respond. The paying customer should have said "I'll only accept this coin from you as a gift" I believe the best person to decide the outcome might be a judge.

@@saltymemesmith Had a store manager say he didnt want my money so I took it back police took it as a theft and subsiquently dropped the charges a gift doesn't need to be stated as a gift - once its offered its theres same as the fuel - what they do with it after they have it is up to them.

@@saltymemesmith Yeah it actually as far as a breif examination would constitute a theft because by taking it from the store and giving it to a member of the public he has permanently deprived them of that coin without any intent to return it to them. If we had an actual lawful system you could pull him up on theft charges.

6:00 No Merseyside Police will not give out details. The constable might not know GDPR but the people in the supermarket know that they can't get the details via the police and that even if they tried they'd be rebuffed.

What happens in the case of a drive off? Where someone has actually broken the law. Do the police or eventually the court give the garage the person’s ID? In this case where no law has been broken I agree, the garage has no right to obtain someone’s name and address. Hopefully the station will know this.

@@DMC888 The garage can get in touch with the DVLA using form V888 and gets the owners details. Then asks them to pay up or court proceedings will be started. For a drive off which is theft the police can prosecute. The court can add the fuel cost to the fines.

If fuel is drawn and payment is made then the crime of theft or bilking is negated does not exist there is no unlawful intent. If the shop refuses payment whether they have the right or not the debt is settled. As for the cop obtaining details rightfully refuse to give them after all no crime has been committed also giving details to a third party as the date controller is a breach of the DPA and GDPR rules!

@@julianchamberlain5399 One thing that the police don't want you to know relates to their notebooks. You can insist that they read the contents of their book to you. You have the right to make comments, have them recorded and sign the book there and then. This prevents later additions. Makes it absolutely certain its contemporaneous. You then SAR request for a copy of those notes.

@@asitis8990 You get the copy of the part of the notebook containing the information about you. You do not get the data in the notebook about others for obvious reasons. However, in court, they have to produce the notebook, and you get to look at it there. Your solicitor, the judge can even read other entries to make sure its complete.

The key bit "ought to know". That means he can't claim ignorance. In this case he was told, but ignored it. (4) For the purposes of this section, a police constable exercises the powers and privileges of a constable improperly if- (a) he or she exercises a power or privilege of a constable for the purpose of achieving- (i) a benefit for himself or herself, or (ii) a benefit or a detriment for another person, and (b) a reasonable person would not expect the power or privilege to be exercised for the purpose of achieving that benefit or detriment. To me that kicks in, we are talking benefits and detriments.

@@Nickle314 Policeman advised the creditor not to accept payment as the debtor could then claim he had paid. He also advised them to ban him from all their other branches. This is not the full video, but the shop said they don't take £50 notes either. Would the constable have advised the same in that case? Its outrageous that when you consider that a Crown servant of the Queen is advising these things. Hundreds of years ago the Queen would have had him beheaded.

@@julianchamberlain5399 My view take it to court. What you do is go to the court, pay the money into the court, but its marked as "evidence" to be produce at the hearing. Now if the court cashes the money, then there's an issue. They have destroyed evidence. You can also call the copper as a witness, with his little app. As a witness, he has to answer questions, and a decent solicitor or amateur will ask leading questions where he admits to all sorts of offences, particularly data protection. You would do that because it shows lots of things. His ignorance of the law. Breaches of his code of ethics, which means he's hostile to you...

SO IMPARTIAL! My answer is that I would post all of the policeman's details on Facebook within the year. The copper is using the threats as colour of law and is susceptible to all of its punishments. Revolting behaviour by the bent copper. But what actually occurred here is a 'war of words' and no more. The guy should just walk away. The cop will get his details illegally from his car reg. The force will illegally give those details to the shop keeper. The shop keeper will illegally pass those details to a debt recovery agent before arbitration. The agent will legally but unlawfully request payments. The man illegally ignores their advances. Agent legally takes money as goods and chattle. OR...bloke takes the copper, the force, and the shop keeper to court individually using a solicitor. Cool.

6:39 I don't follow the logic of the constable's statement. He says that the shop won't be able to pass the coin and get their account updated by £50. Yet how did the guy get hold of the coin? He bought it. So someone sold it. The same transaction can occur when the supermarket does it and "sells" it on to the whatever company handles their cash.

Often these garages have a private secure company like g4s collectvthe cash. They only collect notes not coins so the coins get used in change to other customers. The shop knows they won't be able to use a £50 coin as change so they are stuck with it. Thats their problem...

Another case of the police representing the corporate company rather than representing the law. He should have just walked away as there clearly was no breach of the peace or criminal offence taking place, so the officer wasn’t required to assist in a civil case, I hope the guy sues the police if they pass his details on.

If you DON'T pay then they have 24 hours recovery company, but surely that if ONLY when theft is involved. Here we have no making off without payment. In a civil dispute you have to give the other party your name and address for service of Court documents, the police do not have the right to them only the other party in the civil dispute.

I'd say allow the coin back into my hand. Let them return my money. An old man walks into a flower shop after his wife has died. The florist says, "Keep your money, John, we all miss your wife," and he leaves with the flowers. The florist can't then take him to court now can he? Nope. Keep the money.

The shop can use the £50 - as legal tender - to settle any debt that it has. Such as its' electricity bill or council tax. There is no actual problem here. The amount of time wasted by arguing about accepting the coin could have been used nipping down the council offices and paying them the £50 as partial payment of the council tax bill. The council could then use the coin to settle any debt it had incurred. And so the £50 coin would go round and round. Which is the whole idea of legal tender. Dumb copper, does the usual thing of siding with the business and against Joe Public. Instead of being professional and upholding the law, and not breaking the law himself, including being part of the chain within his organisation breaking GDPR law. As well as the misconduct in a public office, using his uniform to try to coerce a different form of payment from the customer.

Imagine this .... person is doing ok in life ...sees some new release of com.... i cant spell it but lets just say new release of celibration coins that cost 100 pound ... it states they are legal tender ...this person says wow i love them .. ill take the whole set which is 5 different coins ... puts them in nive display case ....a year down the line ...boom they loose pretty much everything ... who knows maybe they got poorly 🤷‍♂️ or lets just say some weird shxt like covid happened ....anyway this person is on their arse ..can only just about pay for the car insurence let alone fuel the dam thing .... the cars fuel light has been on for days .. this person cant even drive to a poxy job interview let alone actually driving to work if they got the job ...the job that a couple years ago would never be on the cards coz they was doing ok ... but lets just say the fuel light stayed on and there was just enough to get them to the cleaning job interview ... boom they got the job 💪💪💪 but its monthly pay ....so now not only has the car running on fumes but now it looks like they cant start this new cleaning job ....... but hey hang on .... whilst doing a bit of their own cleaning dust off the cabnet ..they see the 5 £100 coins they bought when life was good ... yes these are the coins that can give over a months worth of fuel to get to work ...... to be then told ...(because they went in 1st to ask if they tske them ) NO NO NO 🤷‍♂️ now the poor cxnt dont even have enough fuel to get back home let alone to start new job 🤦‍♂️ imagine theres many actual storries out there where corperations suck the money from you when your doing good but turn their backs on ya when shxts not good ..... P.s sorry for the long comment and bad gramma .... but its just something i thought of off the cuff

Yet another example of when an officer "feels they have to intervene" on behalf of an organisation, whether under pressure to resolve or not, but ends up making the most utter policing bollocks ever. He did not remain impartial and indeed involved himself to the point he has stepped outside his authority and brought himself and his organisation into disrepute. Any wonder Chief Cons up and down the country are going off their heads with useless constables running around rogue. Very poor!!
