Wasn't a problem during this games release in the first place, Wolfenstein 3D was banned 1994 due to Nazi imagery and back then the court knew so little about games, all they saw was a program rendering 3d swastika flags.

It looks so tacked-on though, as if the original version was the altered one. It's also fully black while his hair is graying, and I must say surprisingly little considering his apparent age. Also, the spit effects are (unsurprisingly) exaggerated. Likely because the VFX designers wanted to make sure people see it clearly and have no appreciation for subtlety.

But excluded from this law are educational content that uses these symbols, or art such as music videos or pictures or something like that. But here's the problem, games weren't considered art in the past, that was a different time, that was everywhere, it's only in the last few years that video games have moved so much into the mainstream. No. In germany, the laws for artistic freedom are one of the best in the world. Dark humor and satire literally have no limits (even concerning hitler), IF the way of presentation can distinctively be seen as art (stand up comedy, satirical journals, revues, music, movies, paintings etc.) . In this case, the only limit is societys tolerance itself. The problem here is a different one though. In germany video games dont count as art per se. Thus, they dont fall under the aforementioned laws. If you show swastikas (or the nazi salute - imitating hitler so to speak e.g. the beard etc.) in video games, its pretty much treated as blankly showing them to the publicity. And since this IS illegal, the developers had to make these changes. All that needs to be done is making video games countable as art so that the protective laws can take over.

Videogames about Nazism are only censored in Germany, because they are considered "toys," legally. If they were considered "art," (as movies and TV shows are), then these things wouldn't be censored. So, the argument is whether or not the German government properly understands what videogames are.

Some actual information: Germany did NOT censor it. Bethesda censored it, because years ago there was a precedent where a game (with nazi symbols) has been forbidden in Germany. This was only possible because back then video games were not considered "art". Since then many things changed, the government even funds local developers, but because of that incident nobody dares to try to release a game like Wolfenstein uncensored. If Bethesda would've went to court, I really doubt that they would lose today. However, fearing the costs no developer/publisher tries that, so they just choose to censor it.

@@JosephGibson No, not the law itself but its intepretation. Nazi symbolism is forbidden by law except for scholary reasons and in certain cases in art. The German law allows it in theory, but there have been cases early on in the history of video games when court didn't consider video games to be a form of art so games were censored. However, there have recently been a few cases where Nazi symobolism was not censored in computer games that were considered educational and critical of Nazism. Hopefully, in a few years computer games will have the same right to show Nazi symbolism as films do now in Germany.

We have a difficult relation with our past. Sometimes we are a bit too sensitive because of our fear of repeating it.
