Awesome summary. My perception is that people have less and less trust in LE in this case every day. You are correctimundo that the court was shockingly dismissive in almost quoting the Rolling Stones saying 'you can't always get what you want'. Wait, What? this is a DP case, the Constitution requires that the defense receive all exculpatory evidence and also all other relevant evidence. My guess: this case is headed for appeal and multiple trials. Keep it up!

Why does the judge have no control over the prosecution? I blame the judge as he says he read everything yet cannot force the prosecution to be honest. Billy Thompson said he gave Anne Taylor 95% of the evidence a couple of months ago. This whole case is sus.

Little doubt in my mind that, like the Las Vegas shooting for example, we'll never learn what happened. I suspect that Satan demanded an act of allegiance from those indebted to him. B.T. also told the judge that if the defence is going to have expert witnesses testify and show BK wasn’t near the area at the time of the crime that the prosecution will request more time to gather a list of witnesses that can put BK at 1122 king. This is not a normal case!! I have never witnessed such indecisive rulings by a judge or such unprofessional behavior by a prosecutor as in this case. To me, personally the prosecutor & Judge act like we are here to convect the defendant and we aren't going to let anyone or thing get in our way. It's a sham trial 🤬

I was shocked when the Judge said, "You can't always get what you want." That statement was absurd and that is not how the law and discovery rules work in America. If the evidence exists, there is a legal duty to obtain and produce it. If the Prosecution doesn't produce the discovery material, the Judge is supposed to sanction them and bar that evidence from being used in Court. Its also shocking that even after a year and a half, the Prosecution is just now issuing subpoenas to the FBI for certain documents. Honestly, I've wondered, from day one, why the FBI was involved in this case at all. Moscow is a small town and these crimes were not Federal.

When it happened a 2nd time, I thought surely this is a civil court thing because the stakes are relatively low, I’m an older female and they think they can screw me, etc. now I see it in a high stakes, DP case, happening to a young, white male. The trial hasn’t started. That’s where evidence is presented in full. It’s premature to assert the prosecution has no evidence against BK. Perhaps it’s just wishful thinking on your part. Do you believe BK was framed? Please your hypothesis as to how this could have been done before was even a suspect and LE had had no contact with him? Why did he not offer to give LE a cheek swab when asked if he had nothing to hide? Why was he separating his trash from his parents’ trash and then putting it in a neighbor’s bin if not to hide his DNA? The prosecution has, IMO, a key witness-possibly the door dash driver who saw BK at the scene-that they need to protect from scrutiny due privacy and safety. A lot of observers a jumping to unwarranted conclusions based on preconceived notions and plain old bias. Get off the innocence bandwagon and stick to contextualized facts.

Lana, perhaps the answer to your question has something to do with the 4rth amendment to the US Constitution. If the prosecution violated BK's fourth amendment protections it is unlikely they will compromise their case by admitting wrong doing. This concern may be connected to public outcry over nothing being accomplished during the first months of investigation. Public pressure can compromise ethics. Lana, I live in America, and this case is one huge mess. Most of our prosecutors want even try to prosecute a case unless they have that person dead to rights. But this case is a Corrupt prosecution, corrupt law enforcement and corrupt state police. They're so corrupt. Those frat guys killed those 4 out of anger jealousies, and they knew what happened to Huston Lindow they were all at the same party with Huston. The same frat brothers Ethan was in his 1st freshman year with who all know what happened to Huston. This is 1 big frame job 💯 This crime didn't even happen at 4 it was between 2 and 3. For me, the most possibly telling chain of custody involves the paper bag containing the sheath. It seems the Idaho lab and FBI lab failed to find BK's DNA on it, so what happened when the sheath was transported to Texas? Who carried it? I imagine the thinking going on with LE, that they thought they had their man from their dinky connect the white car dots, but that wouldn't get them the search warrants that would nail their suspect. So how about swiping a Q-tip to BK's car door handle, stirring it into distilled water, and injecting it into the paper bag with a fine insulin needle? Then rubbing out the hole so no one would notice. Thus a careful examination of that bag is in order. Is there evidence of a hole? Is BK's DNA on the bag itself? Either would blow up the case.

This case is falling apart because of the prosecution. They came up with some weak evidence, and now the FBI is stepping back, leaving the prosecution unable to back up their claims. It's crazy. I'm not sure if BK is guilty or not, I'm kinda on the fence, but either way, this case might just get tossed out due to lack of proof from the prosecution. So, here's the thing: if BK did it, he might just slip through the cracks. But if he's innocent and doesn't get cleared properly, all the media mess about him will seriously mess up his life forever.

Job 1 is confirming the FBI has a requisition from MPD for a CAST report. For all we know, Brett Payne dreamed this expectation that the FBI would be doing a CAST report. I'm not convinced the FBI would admit failure to open some of the phones.

The FBI was asked to look into the ping data, which doesn't really indicate anything. They were not asked to look into anything else regarding cellphones. They did what they were asked to do. It is not the FBI's fault that the Moscow police and DA's office do not understand cellphones. The Prosecution now claims that the FBI will not give them what they want. Wel,, the FBI does not have what they want. Duh.

Small municipalities do not have the resources and expertise to handle a complex homicide. We see this in Delphi. It happened in Boulder in the Ramsey case. It happened in Scottsdale, AZ when actor Bob Crane was murdered. About 50% of homicides go unsolved, and we don't know if the other 50% are solved correctly. Sometimes, the suspect's guilt is obvious because of the totality of circumstances. But some crimes are impossible to solve, even for NYPD.

She also mentioned them refusing to hand things over they DID have and the video you’re talking about is part of that. The FBI isn't required to give the defense their "work product" of the IGG. It isn't required in US law. Ann can ask for it but it isn't required. The FBI didn't create a profile, Othram Labs did. Idaho State Labs did recreate one they ran through CODIS but found nobody.

In my opinion the prosecutor may of signed a Federal Non-disclosure Agreement. The FBI will give leads, or tips, but the other party must agree to not disclose their procedures, and or techniques. When the Stingray, or IGG is involved they will do their best to withhold the info indefinitely. The Civil Rights division has been finding this information through FOIA requests to law enforcement agencies.

Audio was separated from the clips and put into separate files. AT said in an earlier hearing they are having to go through the video clips and try to match them with the audio files and it's an impossible task. What LE has done is called tampering with evidence and is illegal in the United States.

When the Judge was speaking about those with information that they don't want to give up, I believe he was referring to the FBI. BT said that they're the ones holding the evidence. Why won't they give it up? It could implicate someone that they're trying to protect (an informant) for what they consider a more important case than the 4 murders. The prosecution may have thought, early on, that they have years of experiance and have the FBI (drumroll) working with them, and that therefore, going against a lowly public defender, not a top defence attorney, would be easy and a big win. Instead, they find that the FBI did not find anything impressive, and now the FBI does not seem to want to be bothered by them.

While the comment you found most shocking, made by the judge, IS shocking...it's also a realistic observation...in that there is no way of telling the federal bureau of investigation to hand over something they deliberately deleted. There is ONE remedy for this. A trial. The evidence is presented. The jury deliberates. The defendant is acquitted by virtue of a not guilty verdict. There is no one or no way to nullify that, for all practical purposes. So all this blabber out here in the public serves no useful purpose. A trial is the remedy for the grievance. If the jury doesn't find the evidence to rise to the level of beyond reasonable doubt, to convict and apply the death penalty, and they return a not guilty verdict, then this case will go into the 50% of unsolved homicides in the U.S.A. And the Goncalves family will have the justice their publicly condemning a person to death before that person had been tried and convicted for the crime provides them with. Sadly, the other 3 families will receive no justice. The prosecutor, the police will do nothing but release the statement that they "had their man" and blame the jury for not convicting him or some other lame excuse for their failures. If the defendant is found guilty, he will languish in prison, through an appeals process, journeying through an uncertain future that only he knows whether or not he is deserving of. That's the reality of this Idaho 4 case...and a reality that could, for all practical purposes, be visited on any one at any time in the U.S.A. Sobering, isn't it?

On the training records… Ann is saying now that this is beyond training records… she wants anything that will show her client did it… period… something… anything… because as of right now, they haven’t done that… and now it looks like she has had her own expert witness (who has testified for prosecutors previously and is a former police officer, so why would he suddenly start trying to help guilty people get off, I doubt it) evaluate and basically extrapolate their own CAST report, since the prosecutor won’t provide one, and it shows that he was nowhere near Moscow at the time of the murders…. And one more thing I want to point out to all the people trying to say he took his phone to wawawai park and left it and then went back and got it afterwards… you were all on board saying he turned it off, and that it connected to the victims WiFi… you all are also ok with prosecutors when they make statements saying that it is assumed that the location of a device is considered the location of a suspect, because in this day and age everyone carries their devices with them…. Well, you can’t have it both ways… either he had it with him, and apparently was driving or hiking or something out of coverage area or he had it with him and airplane moded it in which case it wasn’t connected to a network but was still on (and the phone would be able to show all that) or whatever… you can’t keep moving the goalposts when your trying to make exculpatory evidence fit a scenario…

No, The defense council wants the client (the defendant) to have his rights observed and upheld. That is the job of the defense council. That right includes the prosecution turning over the evidnece they have to the defense council. That is required by law. That way, the defense council will have a reasonable amount of time to prepare their defense for the trial. In these hesrings, the prosecution is claiming that the federal government has the evidense, and reading case laws to the judge, claiming that federal evidince is forbidden from being given to defense councils.

I think the prosecution has a strong case, and must have strong evidence linking BK to the crime. The only thing the defense is waiting for is the stuff that is coming from the FBI, which the judge acknowledged takes time to get from the Feds. If you look in the Alex Murdaugh case, the cass report on his car only showed up after the trial started which was several years after the crime.

The FBI destroyed their evidence, and the local LE has provided only a portion of the white car video evidence, and tampered with what they did give the defense by erasing the audio. That could be critical for proving one of their white cars could not be the same white car as the others. In their connect the dots method, even one mistake over that two hour period in which not a single car was positively identified, the whole thing comes crashing down.

Note The time Ping as cell phone locations say was near Idaho 4 King road where alleged suspect, BK, likes to drive a lot at night or mornings thereby supporting his story and was not in, inner area near Idaho 4 King road house when Idaho 4 crime scene happened. He entered and drove by King Road a short road where for a short time the Idaho 4 crime took place 15 minutes we're told. The smartphone can turn on by itself and turn off much much later by itself. Thus 2 hours it can be on by itself. It can do long ones to after driving by King road and its Idaho 4 crime occurring as smartphone turns on by itself. Remember my scenarios. This covers the 2 hours you asked about. Alleged suspect, BK, I point out I feel was limited to college road and familiar area since a college student. It is not that big of an area, so it is possible his smartphone did turn on and off all by itself as he entered and drove by on King Road and one can never tell or dictate when that smartphone will come on and off all by itself. Note: The cell phone location time Ping puts him on King road, not in, inner area near Idaho 4 King road house when crime scene occurred. We have to go by Ping time. He entered and drove on King road, the short road, where the 15 minutes awful Idaho 4 crime was occurring and his smartphone unfortunately turned on all by itself and Pinged. But he continued up the road for a while driving around as he likes to do for nearly 2 hours. And then returned back on same King road when smartphone came back on all by itself or he noticing it turned off put it back on. This explains the 2 hours you wondered about. But I contended "his life was on the line," so he probably used a fine tooth comb to be sure all his DNA was gone. You can bet on it! If you drove and went 50 miles and 25 miles in a Ping came on and smartphone was turned off then this would be possibly where you'd say it wasn't the smartphone turning on and off by itself.. So you are causing others to be hurt by having them not be on guard if the real perpetrators were still out there. The IGG gets barred is like saying you can’t investigate a tip line tip because the tip may contain a wrong spelling of the middle name of someone the tip is pointing to. LE got the spelling correct with the actual STR DNA. If Defence feels they’ll get a more accurate spelling doing their own IGG work up there’s no one preventing that from happening, it’s a public database.

That should be dang near impossible. I myself am a nature girl & recently moved to the beach. I’ve got likely thousands of pics of sunsets & even the moon reflecting off the sea bc it’s new to me & it’s gorgeous! I also go alone to decompress in the evenings after work & have stayed into the am hours. All those photos show location data that can prove where I was & when. Even Google saves gps data in their systems even if it’s deleted on our phones. This is why we can google “restaurants nearby” bc it’s always refreshing location, as are tons of apps like social media, health, banking, weather… etc. All of this data can be extracted. They never said his phone was shut off. Esteemed attorney Andrea Burkhart who has a great channel as well went to wawawai park & had zero service. Our phones are still able to be tracked when out of service, airplane mode & even turned off. That’s why this new expert is huge for his alibi. As far as the sheath, it’s only touch/transfer dna. They found no blood/spit/semen/sweat or fingerprints. Only invisible skin particles, & a minute amount at that. They only have 90 Picograms of dna!! The minimum needed is usually 500. Even specialized labs cut of at 1-200 min. DNA also degrades within 4-12 hours on brass surfaces specifically, which the kbar manufacturer states the snap is made of. We shed 30,000 skin cells per minute, close to a million per day. These cells have been proved to get on things we never even touch. They can get on other people/objects several feet away & are easily transferred from place to place which makes this evidence highly unreliable. Even more questionable, the FBI won’t show their work & also showed up at the Defense’s IGG expert Gabriella Vargas home after she testified. Check out the Lukas Anderson case, it’s a perfect example of how wrong this can go! I could go on & on with pages of faulty things that have happened in this case. I recently found a channel called Truthnation Uncensored created by someone who knew Bryan. He has been contacting others who knew him & asking about their stories & experiences with him which are in direct contrast to what is in the media. One of the guys last interviewed was also on Fox News & said they clipped down his interview where he said positive things about Bryan. Both knew his parents & sisters as well. There are many other things at play in this story. The interview room recently exposed how the U OF I president was brought into the investigation by meeting with LE twice a week, he gets a million dollar grant for the school & won’t disclose the expenses for a crime that happened off campus, he has also raised 800k for a memorial for the Idaho 4 then changed the plans, was donated the crime scene & had it torn down & the rubble buried against the outcry of the families, he has written a book with a chapter about the mrdrs & Bryan Kohberger. Recently a lawsuit has been filed bc a group of 40-50 Frat boys from U of I showed up to a house party & beat a young student (Timmy) nearly to death, all wearing BLACK MASKS. There’s a reason the state had a secret grand jury hearing after learning the defense was contacting surviving roommate Bethany Funke vs waiting on the preliminary trial where Bryan could be heard, as well as why the STATE is asking for closed hearings when the defense wants all info public. I implore anyone with an open mind to seek out facts in this case as I did because it has changed my perspective completely. All I want is justice for those 4 precious students and for the right people to be held accountable ❤

I see you’re on a first name basis with the defendant. Interesting. Taylor dotes on BK like he’s her baby boy. The judge knows what the discovery being argued about is. You con’t. He made the decision to close the next hearing based on that knowledge. It’s not fair to insinuate collusion and bribery with no evidence of such. Through BK’s father’s DNA, LE got to BK himself. When he was arrested, LE asked BK for a cheek swab. He refused. So LE got a warrant. The DNA matched the DNA found on knife sheath found a victim’s bedroom- Madison Mogen’s room, where she and Kaylee Goncalves were savagely butchered. If BK is innocent, why did he not submit to a cheek swab voluntarily? He could have been cleared on the spot. Then consider the alibi he produced after 522 days of stalling. This alibi lacks the specificity required by Idaho law. It only suggests where he might have been when the crime occurred. In no way does it prove he could not have been at 1122 King Road doing the crime. His only witness is himself. So he could take the stand and explain his actions that night/morning. The trouble is he’d then be cross-examined. I find Taylor’s latest behavior to be theatrics aimed at manipulating public opinion and create a narrative prosecutorial deception. It may be working. Plenty of observers are gullible and susceptible to misinformation and propaganda.. But it ain’t over till it’s over. Or the fat lady sings. Supporters of BK’s factual innocence should be wary of counting their chickens before they’re hatched.

Recently a lawsuit has been filed bc a group of 40-50 Frat boys from U of I showed up to a house party & beat a young student (Timmy) nearly to death, all wearing BLACK MASKS. There’s a reason the state had a secret grand jury hearing after learning the defense was contacting surviving roommate Bethany Funke vs waiting on the preliminary trial where Bryan could be heard, as well as why the STATE is asking for closed hearings when the defense wants all info public. I implore anyone with an open mind to seek out facts in this case as I did because it has changed my perspective completely. All I want is justice for those 4 precious students and for the right people to be held accountable ❤

Anne hired Sy Ray who is top tier in all forms of cell data. Stating he can show his location, PROVING he was elsewhere as well as it being pattern of behavior w/photos from prior/post trips “of the night sky” which ppl are trying to make a joke of but Sy using his GPS RF, Cell geo blended data etc are all exceptionally more accurate than the ping mapping in the PCA. We are talking 20 mile radius down to 2ft. The state also won’t give him his own IGG info, still haven’t given them the CAST, haven’t given the training records for the LE they asked for, haven’t given them full video footage of what they claim is Bryan’s car.. I believed Bryan was guilty initially but I’ve followed solely this case, watching all hearings, reading all docs & the longer the time goes on, the more it seems that they caved to the pressure & built a case to try to make Bryan fit without having the pieces expecting that his car would be a “treasure trove” as experts said yet no dna/hair/fibers- nothing, same as appt, office & parents house after harming 4 people in only 8 minutes & speeding off. That should be dang near impossible. I myself am a nature girl & recently moved to the beach. I’ve got likely thousands of pics of sunsets & even the moon reflecting off the sea bc it’s new to me & it’s gorgeous! I also go alone to decompress in the evenings after work & have stayed into the am hours. All those photos show location data that can prove where I was & when. Even Google saves gps data in their systems even if it’s deleted on our phones. This is why we can google “restaurants nearby” bc it’s always refreshing location, as are tons of apps like social media, health, banking, weather… etc. All of this data can be extracted. They never said his phone was shut off. Esteemed attorney Andrea Burkhart who has a great channel as well went to wawawai park & had zero service. Our phones are still able to be tracked when out of service, airplane mode & even turned off. That’s why this new expert is huge for his alibi. As far as the sheath, it’s only touch/transfer dna. They found no blood/spit/semen/sweat or fingerprints. Only invisible skin particles, & a minute amount at that. They only have 90 Picograms of dna!! The minimum needed is usually 500. Even specialized labs cut of at 1-200 min. DNA also degrades within 4-12 hours on brass surfaces specifically, which the kbar manufacturer states the snap is made of. We shed 30,000 skin cells per minute, close to a million per day. These cells have been proved to get on things we never even touch. They can get on other people/objects several feet away & are easily transferred from place to place which makes this evidence highly unreliable. Even more questionable, the FBI won’t show their work & also showed up at the Defense’s IGG expert Gabriella Vargas home after she testified. Check out the Lukas Anderson case, it’s a perfect example of how wrong this can go! I could go on & on with pages of faulty things that have happened in this case. It’s terrifying bc this could happen to any of us with a white car, bushy eyebrows or a love for nature lol. In all seriousness, this case has been the first to truly wake me up to the flaws in our justice system. Largely what’s in the media about Bryan has been false. He wasnt stalking, had no connection to the victims, there’s no factual validity to the “birthing hips girl”, the girl who says he installed cameras to “leak her nudes” they don’t even know he visited the house bc of the few cell towers in the area, he could ping off the king rd tower from his home if the towers were busy. I recently found a channel called Truthnation Uncensored created by someone who knew Bryan. He has been contacting others who knew him & asking about their stories & experiences with him which are in direct contrast to what is in the media. One of the guys last interviewed was also on Fox News & said they clipped down his interview where he said positive things about Bryan. Both knew his parents & sisters as well.
