This is spot-on advice. I ran into each of these obstacles before getting my patent approved. The first attorney didn’t interview the patent office attorney making unnecessary mistakes. He changed the wording, making it very difficult to read. I didn’t take into account the cost of the office actions. You live, you learn.

I have a patent and I'm in the process of a potential deal with a big company. I have more ideas I want to patent as well and thought about creating a company. Would you recommend I start an LLC and make a team before making any deals?

I would recommend before you sign any licensing agreement please form some type of business entity. Talk to your tax attorney or accountant. Stephen

I’ve got an electrical invention that would take the world by storm for residential, commercial and industrial. I’ve built 2 prototypes and have videos of them. But I don’t have hardly any money to get a patent. Don’t trust telling anyone about it. I built the first prototype in 2018 and another in 2022. There is nothing out there like it and I would go world wide. I’m just stuck with being broke and insecure because n who to trust with it

Really appreciate your defining lawyer speak! I'm not not inventing something from scratch that you're putting me through here. Darn I see Edison had friends! I only have a idea how something most people use daily could be tweaked. I haven't designed it as it's just the thought. Yet now after watching this I can see why I haven't been able to find my idea implemented. Lots of sharks in the water

There's a decent chance that my blind spot cameras on vehicles were infringed upon. The time frame fits perfectly. I used an ex-patent examiner attorney firm. I'm highly suspicious now. There are quite a few concepts that are really disruptive. Since I've already might have been stolen what additional routes can I take with patents that could be profitable like the above mentioned.

First of all, I should do a video just on this topic. Thank you so much for commenting. I don’t think this happens very often but you do have a few options. Please remember, companies are working on the same idea at times. And I know your law firm was not involved in any type of shenanigans.

That may or may not be the case. I think I’ve more been on the radar of techies and this is certainly an easy one to take for the logic you mentioned. It is a technology that should have been out years ago. Inventions are obvious until they’re not. This one is an easy one to implement quickly. I cannot confirm where the leak could have been or yes for sure that there was a leak. I’ve had a few others exactly as mine taken. More obvious notes on my phone. I think ideas are stolen more than you realize especially when you’re on the radar. Anyhow I more than have a willingness to hire you (need no response here I know it’s not a service you normally do) to help get concepts eventually patented that require additional precautions. These certainly fit the bill there. Thanks

Can you do these processes on your own. What are the specifics and subtleties to do so. You make reference in the title to the effect about doing all this your own. My teachers always taught me to when writing to make many draft copies and leave spaces between lines for corrections. Peruse ,peruse, peruse and of course ask an AI programmer to make corrections and then some...

I’ve built several prototypes and written the information that will go on a pamphlet inside what I have built. #1 I don’t quite understand what you’re talking about as this is the first literal search I’ve made on how to get a patent. #2 I want to make the information in the pamphlet free but it is the box and the packaging and the idea that that I am wanting to patent. I guess I need to take that information to a patent lawyer and start there but I’m not looking to spend thousands of dollars in the process only to find out I cannot get a patent. I’ll just continue to build and put it out there for all to steel I guess.

Thanks so much for this video. I am about to submit a Provisional Patent and your video have help expedite my application. One question - I was looking at a Patent similar to mine but not enough to be an issue and I noted it stated that the Status was Expired - Fee Related, however below it states the Adjusted Expiration was noted as 2031. Do you know if this means it is live or expired?

Many inventors, abandoned, or do not pay the maintenance fees. Regardless, that invention now is in the public domain. Your invention must have a point of difference in order to obtain a patent.

Dear Stephen Keys! I am your fan for years. I have been researching how to write a utility patent for years and have 1 experience filing a patent. However, it was found to be not inventive enough. I have a even greater invention but i always am unable to be confident enough about its inventiveness . I know its new and solves a big problem and its superior to existing methods. But i am always stuck with which embodiment will make it regarded as being inventive enough to the examiner. Is this a common problem with inventors? Any advice how to overcome this bottleneck? I know that with a good engineering team i will be able to come up an embodiment that satisfies the criteria for being awarded a patent.

However I think I made a big mistake by sending a photo of my creation to a invention company for patent purposes. Please make sure to do homework on anyone you’re going to be working with. Type in complaints and lawsuits. If they pressure you to work quickly, that’s a red flag. If they tell you, you have a great idea that’s a red flag! If they’re not on social media, that’s a red flag! Always do your background check.

Maybe I’m not explaining this correctly. When Stephen licensed his Michael Jordan basketball toy that was a sports toy but if you put a picture of Darth Vader on it, it might be considered a Disney toy. Would you use one company to try to license in both areas or license to one company to handle the sports side and one company to handle the Disney side. Hope I explained it better

It’s best to find the company that already has the license. Example:Ohio art had the license of Michael Jordan. I submitted to them a concept using Michael Jordan differently. So Ohio art paid me a royalty and also paid Michael Jordan.

When a patent is approved by the USPTO, it is made publicly available. (Non-provisional patent applications become public at 18 months.) So, yes it is possible to search and find patents. Regarding office actions, why would the USPTO be charging you anything because you came up with an idea? It seems a little incentivized for them to just never approve any patents, ever…if they knew they could charge another $10K+ and still wait months or years for it without it ever being approved or looked at. Like how would anyone ever tackle something they’ve created?

I have an idea and it should already be worth 10-100 million $ whether you believe it or not... I wanna share it with Google about KZbin but I'm afraid if the patent team will steal it, like the idea is so crazy that it's gonna be adding an extra 1-5B $ to Google's yearly revenue 💀

I had my invention signed and stamped by an Australian Government official (( Justice of the Peace) just to prove I wrote the concept at such and such a time. I don't have faith in the ability to enforce ownership rights across the globe and demand royalties from whoever uses it. I'm in Australia so doubt I'd travel the world taking people to court.

We have so many Australian inventors as members. You can do this. You don't enforce your patents. The companies you license your ideas to will. in 2000 i looked in search bar of the pat office[nothing] for my invention;got a [perv pat in 2001]$75bucks;for it;the pat office was so nice to help me get a [special pat] untill my death;and that pervisonal pat??he's was a older guy at the pat office i talked too then;;he just laughed and said ;well i never heard of that one?? he was really nice??

Why does patenting something have so much to do with trying to anticipate and control other peoples actions?! Why can't I just do this my self? How many people do I need to speak through? That, to me, is a red flag. It sounds like it would be easier to just make the product before patenting it. I'm not criticizing you at all, just the process. Thank you for the informatino. Please note most products that are on the store shelves are not patented. Most product ideas that we see get licensed there’s no issued patent on a provisional patent application, which is easy to do. Hopefully this information is helpful. It's very easy to waste your money with patents. Don't forget patent attorneys get rich out of it - but you will probably not. You might well get a patent granted - your invention can be almost trivial in technical terms - but if there's no significant technical advantage which translates into a commercial proposition, you're wasting your time and money. One day the world will come up with a definition of the level of invention which is more than simply "it's not obvious" and the number of patents will drop by 99%. Then there will be peace in the valley.

You’re absolutely 100% wrong. It doesn’t take money, it takes knowledge. Reaching out to companies is free. Sometimes you can build your own prototype with things around the house. Putting together an email is also free. Writing a provisional patent application you can do yourself, but you need to file the fee at the US PTO. I think it’s $30. If you cannot afford $30. You should do something else.

So if you're already rich you can get a patent.😂 I mean sure if I try patent a new fork the patent will go smooth no question. But what if I try patent a perpetual motion machine? I'm not saying it works that's not what it is about. I think the patent organization itself will steal my idea. Or my lawyer. And then I might even end up dead.🤣 I mean big ideas I wouldn't even try patenting unless I'm a powerful company already. Well, as you said in your other video, it doesn't always have to be a patent. There are other ways.

Your first point is misleading and could use some granularity. A lot of your other advice is quite good. Here’s one example: if you publicly disclose your invention 364 days ago, and if your patent attorney says rush to the patent office - then LISTEN TO HER!!

I'm a complete noob at this invention stuff, I have a whack ton of ideas as well as a few prototypes... and I still find this whole process confusing as hell. Am I the only one who doesn't have a clue where to start???

There are a lot of steps to commercializing an idea, and a lot of things that can go wrong along the way. You're not wrong to be overwhelmed. Stephen's book "One Simple Idea" breaks down the inventRight process for licensing an idea into 10 simple steps. If you haven't read it yet, we strongly recommend it.
