@Vulpeus System "cu*nt c*nt F*ck B*gger sh*t sh*t" There. I just did a modern Sterling video. Honestly, though! Listen to this video in audio only and then one of the modern ones. I really, really used to love Sterling's videos because they were well written and objective and could even convince a stick-in-the-mud like me to change my opinions on a matter I felt strongly about. Now, Sterling's all just venom and swearing. I get passion for a topic you feel strongly about, but now it just feels like they're trying to get views with shock value over what they're saying or something... Edit: and that 'if you dont like it just leave' attitude? How many people do you think have said that to Sterling over their many rants? No, I wont be doing that because I respected their work too much to give up on them just yet.

@@ethericboy I’d actually argue that JSS has changed for the better. I started watching a couple years ago and haven’t missed an upload. The show is more slick now, which I appreciate. The only thing people seem have a problem with is the fact that she’s trans now, that’s literally the only major change. Everything else are stylistic changes. Could you please elaborate on the differences between “new” and “old” Jim Sterling?

Let`s be honest: James doesn`t likely have any money. I have to imagine this is what Jim`s lawyers told him - don`t bother trying to get our legal fees from this guy, he doesn`t have the means to pay & you`ll just end up having to deal with him longer than you have to. I also get the sense from what Jim was saying that his lawyer talked Jim into being merciful. Lawyers spend a lot of time watching ugly retribution play out and watching `bad` people get absolutely crushed, and I have to imagine they come to understand that this is nothing to delight over. James sounds like, for all of his terrible qualities, someone who is sad & desperate. It probably does the world no favors to make him yet more miserable.

You might want to stay away from the whole "interview" if that bit if cringe was too much for you; there was multiple times where I ended up yelling at my monitor because Romine had no fucking clue what he was talking about outside of his argument of Jim Sterling; Notably he's 35, "works" in nerd culture but doesn't know what MST3k or Rifftrax is and specifically makes points to say stuff like that doesn't exist? Are you fucking real? But he took the time to try to Dox Jim by saying he's vaguely related to some random author he shares a last name with.

Best I can tell, it was either a math error and typo or two typos or a different combination of two typos. I think that 4.3 mil was meant to be 3.4 mil. That's the one that stays between all scenarios. Math error, and one of the typos, is fairly simple. Instead of 10,761,000, it was meant to be 10,661,000. The last scenario is the most interesting, and also dumbest. Not only was 4.3 mil meant to be 3.4 mil, but it was actually meant to be 3.5 mil.

For those wondering, "libel per se" means the libel is obvious and doesn't need to be explained to show how it is libel. "Libel per quod" means that the statement is innocent by itself, but because of circumstances it becomes libel.

@mariocerame
@mariocerame 7 жыл бұрын
Actually, "libel per se" and "libel per quod" are special classes of libel requiring different kinds of "elements" (or evidence). Libel is a written falsehood. Harm or "damages" must be proven in ordinary libel (archaically sometimes called "libel per quod," but that's not normally done by sane attorneys, unless they're really trying to look like an asshole). Libel per se is where harm or damages are presumed. Libel per se only applies to a limited set of subject matter, like accusing someone of being an unchaste woman, having a loathsome disease, or--as in this case I presume--a falsehood that goes to one's ability to perform his or her profession or as to criminal conduct. Yes, I am an attorney who practices in this area. No, this is not legal advice to anyone. Jim, I am sorry you have been abused by this frivolous bullshit.
@thenecromorpher
@thenecromorpher 7 жыл бұрын
Cynical Unicorn Think of it as the legal equivalent of "please consult your doctor to see if this prescription is right for you." (at least here in the States that particular phrase is pretty common in all prescription adverts), except it's more implied if anything in the case of legal stuff.
@mariocerame
@mariocerame 7 жыл бұрын
"Why do attorneys always give this disclaimer .... Can you be sued for somebody misconstruing a statement as advice if they take it and it's wrong or doesn't apply to them or something?" Yes. Generally, an attorney-client relationship is formed based on the perceptions of the client, not the attorney. If someone reasonably understood a statement as legal advice, then such a relationship was formed. If in following that advice someone suffered harm of some kind, and the legal advice was not the kind a reasonable attorney exercising ordinary professional care would give, then the attorney may be liable for malpractice. Even if the suit is total garbage, defending against it could make malpractice insurance premiums go through the roof. So I'll add that to make it clear to any rational observer that this is not something the reader should in any way rely on. That extends to the above paragraph as well, of course. :)

Obviously he never read up on the "Consumer Review Fairness Act" which pretty much legally protects critics. @cornbredx
@cornbredx 3 жыл бұрын
You are right, but I just want to point out that KZbin's expressed purpose is not "Consumer Review" and the copyright claim system is in place to protect from copyright Infringement- mostly to cover Google's ass- so yes people cannot be silenced from review of products, but no the copyright system on KZbin is not illegal because the intent is for companies to claim their copyright has been infringed. Which is why the argument you more regularly hear about is that KZbins copyright system is unfair because it has no accountability on the side of those frivolously making the accusation, all the accountability is on the producer of content even if the content is following the law, and KZbin does nothing to protect it's content creators who are completely in the right when following fair use. The way the system is misused could be construed as silencing fair review, but you would have to prove it was done for that purpose rather than the purpose of protecting copyright which thus far most KZbinrs cannot afford to do.

And what if a massive volcano sprouted underneath Jim's house and began disgorging shock troops from the mole-people army? That would also put an end to Jim's employment. Finally, imagine if history itself was rewritten, and the Daevite Civilization remained the dominant world power up into modern times. I don't think I have to tell you that the field of Garme Jarnalizm wouldn't exist in that scenario. I guess what I'm trying to say is that...that...shit, I seem to have lost my train of thought. He was someone who adamantly defended the Romine brothers, going for weeks replying to anyone and everyone who had anything to say about them, positive or negative. My theory back before this person deleted their account was that the account was James Romine himself. The way he argued (he was a huge fan of circular arguments and would use the same statement/argument over and over no matter what evidence/logic was brought to his attention) and the things he said made it pretty obvious. One thing he said that always stuck out, "I don't like Fallout 4, it was trash, I would rather play Deadly Profits myself." He was obsessed with trying to paint the Romine brothers as saints, even though he was extremely vile, hateful and outright spiteful. It was hysterical.

It was a bloody masterful payoff to the perfectly open way he discussed the mental energy expended by the case, his resolve and conviction was communicated exceptionally. I've been reading Plutarch's lives and that line gave me the same depth and quality of feeling as the below quote; Jim can be a truly exceptional wordsmith at times. *"Besides,* *those* *of* *the* *enemy* *who* *carried* *the* *head* *of* *Publius* *fixed* *high* *upon* *a* *spear,* *rode* *close* *up* *and* *displayed* *it,* *scornfully* *asking* *after* *his* *parents* *and* *family,* *for* *surely,* *they* *said,* *it* *was* *not* *meet* *that* *Crassus,* *most* *base* *and* *cowardly* *of* *men,* *should* *be* *the* *father* *of* *a* *son* *so* *noble* *and* *of* *such* *splendid* *valour.* *This* *spectacle* *shattered* *and* *unstrung* *the* *spirits* *of* *the* *Romans* *more* *than* *all* *the* *rest* *of* *their* *terrible* *experiences,* *and* *they* *were* *all* *filled,* *not* *with* *a* *passion* *for* *revenge,* *as* *was* *to* *have* *been* *expected,* *but* *with* *shuddering* *and* *trembling.* *And* *yet* *Crassus,* *as* *they* *say,* *showed* *more* *brilliant* *qualities* *in* *that* *awful* *hour* *than* *ever* *before,* *for* *he* *went* *up* *and* *down* *the* *ranks* *crying:* *"Mine,* *O* *Romans,* *is* *this* *sorrow,* *and* *mine* *alone;* *but* *the* *great* *fortune* *and* *glory* *of* *Rome* *abide* *unbroken* *and* *unconquered* *in* *you,* *who* *are* *alive* *and* *safe.* *And* *now* *if* *ye* *have* *any* *pity* *for* *me,* *thus* *bereft* *of* *the* *noblest* *of* *sons,* *show* *it* *by* *your* *wrath* *against* *the* *enemy.* *Rob* *them* *of* *their* *joy;* *avenge* *their* *cruelty;* *be* *not* *cast* *down* *at* *what* *has* *happened,* *for* *it* *must* *needs* *be* *that* *those* *who* *aim* *at* *great* *deeds* *should* *also* *suffer* *greatly."* *"* Crassus was an arrogant arsehole, in many ways mirroring the NPD traits displayed by James Romine, though unlike James Romine had a famous reputation for his rhetorical skills. Plutarch was not a historian in the modern sense, his sources aren't always real and he likes to go off on anecdotal rumourous tangents, therefore it is reasonable to expect that Plutarch himself embellished or edited this speech. My point being that the James Romine figure should not get credit in this story ahahaha

scott cawthon: hears his games are bad from notorious games journo man jim sterling, goes on to bust his ass and build a multimillion dollar multimedia empire by playing to his strengths and making a horror game scary enough that horror aficionado ben "yahtzee" croshaw cannot bring himself to play it for more than a few minutes and which got cawthon a _fucking movie deal._ digihom: hears their games are bad, spends four years crying about it, one spurious lawsuit later, and immediately tries to justify themselves the moment they reemerge from their rat den. also, i listened to the digihom interview on podquisition. it took me several hours, during which i did not sleep a wink, because i kept having to pause it, get up and walk around to cool off after listening to romine's voice spew lies and nonsequiters like an incontinent fire hose.

@@Yal_Rathol I'm right there with you. Direct comparisons can be made over what do and what not to do with fair criticism between Scott and the Romines, and represents most keenly the necessity of critique on the industry. Because in the best of circumstances it forces a reevaluation leading to innovation leading to massive success, in the worst cases it exposes snake oil salesmen for who and what they are. And they dont like that.

lmao, that's literally the point of critics. to improve the medium which they're critiquing. if creators don't listen to the *constructive* criticism their work receives, they'll never improve their craft.

@Lazu Imani He definitely contributed. Highlights on the Chipper and Sons video include: "Terrifying", "You may notice the dead, terrifying, souless eyes of the background characters..", "And that thing looks like it is going to kill your children!", "I don't know if you saw the mushroom but that is creepy uncle territory.", ".. ghastly faces twisted in a grimacing mockery of joy", "I imagine the phrase 'kill me' is stated over and over again in the world of Chipper and Sons", "Of course it is a creepy owl!", "Oh they're robot beavers. That's not good.", and of course "Fuck me. I ain't sleeping tonight". The last one of course was repeated by many FNAF players.

I would usually throw a joke or two here but this is gonna be real talk. Part of me wishes this would have gone to court, it would set a great precedent upon the silencing of critics and critique as a whole. It would have shown the ramifications to others to discourage not only people coming after Jim but any fucker that tries to pull this shit on smaller channels as well. I know Jims channel isn't exactly the biggest thing on youtube but there are a lot of smaller channels on youtube and if this shit was pulled on them would have no way to deal with it. That being said, im glad it ended where it did. It stops the emotional and financial stress on jim and lets him move past this with no impunity on his content. Law suits like these are usually designed to ruin the individuals it targets so I'm glad this torrent of shit is over and Jim can continue to do the work he does without putting any more uneeded stress on the situation. Thank god for you Jim, Truly.

You talked a lot about the buildup to this video and about what you would say, and I personally think you came to the best conclusion. It was the mature decision which in all honestly probably shows him up as much as possible, as through all the defamation he's thrown at you, you still remain more mature than can possibly be expected considering what he's put you through. I have so much respect for your decision to just let it go when you could have taken it further. Biggest nail in Romine's coffin for sure. Congratulations man, it's finally over.
