Let`s be honest: James doesn`t likely have any money. I have to imagine this is what Jim`s lawyers told him - don`t bother trying to get our legal fees from this guy, he doesn`t have the means to pay & you`ll just end up having to deal with him longer than you have to. I also get the sense from what Jim was saying that his lawyer talked Jim into being merciful. Lawyers spend a lot of time watching ugly retribution play out and watching `bad` people get absolutely crushed, and I have to imagine they come to understand that this is nothing to delight over. James sounds like, for all of his terrible qualities, someone who is sad & desperate. It probably does the world no favors to make him yet more miserable.

I think you make a point that is worth hearing because it shows Jim holds his principles higher than his wallet. Well, it's more that it's well established law in the US that an opinion generally cannot have falsity. I equally cannot establish the falsity of whether the sky is a pretty shade of blue or whether Taco Bell is great. In the US, falsity is required for a defamation claim (or libel, or slander, or their variations) because of the First Amendment.

I recognized the basic arithmetic was off, but when I went through the mental math, I got the wrong number, too (just a different wrong number than they did), and I didn't get the right answer until I went through it all with a calculator...so I'm a fine one to talk :/

Best I can tell, it was either a math error and typo or two typos or a different combination of two typos. I think that 4.3 mil was meant to be 3.4 mil. That's the one that stays between all scenarios. Math error, and one of the typos, is fairly simple. Instead of 10,761,000, it was meant to be 10,661,000. The last scenario is the most interesting, and also dumbest. Not only was 4.3 mil meant to be 3.4 mil, but it was actually meant to be 3.5 mil.

Never in my life had I watched a video by Jim Sterling, but heaven's sake man. You went through a hell of a legal shitstorm just to arise from it fatigued but victorious, if anything, even more respected by the gaming community at large. Voices like you, that are willing to dig into the worst of the worst and expose them to the light of day even when they attempt to fester and consume you, are a dime-a-dozen. Libel per se is where harm or damages are presumed. Generally, an attorney-client relationship is formed based on the perceptions of the client, not the attorney. If someone reasonably understood a statement as legal advice, then such a relationship was formed. If in following that advice someone suffered harm of some kind, and the legal advice was not the kind a reasonable attorney exercising ordinary professional care would give, then the attorney may be liable for malpractice. Even if the suit is total garbage, defending against it could make malpractice insurance premiums go through the roof. So I'll add that to make it clear to any rational observer that this is not something the reader should in any way rely on. That extends to the above paragraph as well, of course. :)

You are right, but I just want to point out that KZbin's expressed purpose is not "Consumer Review" and the copyright claim system is in place to protect from copyright Infringement- mostly to cover Google's ass- so yes people cannot be silenced from review of products, but no the copyright system on KZbin is not illegal because the intent is for companies to claim their copyright has been infringed. Which is why the argument you more regularly hear about is that KZbins copyright system is unfair because it has no accountability on the side of those frivolously making the accusation, all the accountability is on the producer of content even if the content is following the law, and KZbin does nothing to protect it's content creators who are completely in the right when following fair use. The way the system is misused could be construed as silencing fair review, but you would have to prove it was done for that purpose rather than the purpose of protecting copyright which thus far most KZbinrs cannot afford to do.

Well, at the end of the day. At least that Lawyer got something out of this. Other than payment of course, but that's sort of balanced out by all the pointless work he had to put into this. No I'm talking about something else. He got a story to tell. When his friends and family ask him: "What was the weirdest/stupidest case you ever got". He can smile, knowing he has the perfect answer. "Well..." He begins "There was this one time, this game developer. Tried to sue a reviewer of some kind, for up to $15 million. Because he gave him a bad review. He actually tried to take it to court the lunatic. He tried three times! And let me tell you..." Then he goes on for hours retelling this story, while all his friends and family have a good laugh.

I will freely admit that I'm not a huge fan of Jim Sterling. Nothing against you. Just not my cup of tea. That being said, when I found out this lawsuit was going down, I was by your side 100%. This was just plain and simple stupid, putting it very mildly. Anyone with a shred of common sense could see that this was a cash grab. I am so glad it's over and that (hopefully) they've backed off. They did nothing more than tarnish their already crap reputation and not a single person will ever buy or back any of their trash games again. Good for you for standing your ground and showing them how much of an absolute failure they, their company, and their games truly are.

Digital Homicide didn't back off; it died in the process of suing him and the rest of the Steam gaming community. Their paranoia turned into a deliberate self-destructive rage, wanting to pass over laws to get what they want. They were smart enough to realise that they shouldn't press certain areas, but not smart enough to back off entirely.

Anyone here remember The No-BS Gamer? He was someone who adamantly defended the Romine brothers, going for weeks replying to anyone and everyone who had anything to say about them, positive or negative. My theory back before this person deleted their account was that the account was James Romine himself. The way he argued (he was a huge fan of circular arguments and would use the same statement/argument over and over no matter what evidence/logic was brought to his attention) and the things he said made it pretty obvious. One thing he said that always stuck out, "I don't like Fallout 4, it was trash, I would rather play Deadly Profits myself." He was obsessed with trying to paint the Romine brothers as saints, even though he was extremely vile, hateful and outright spiteful. It was hysterical.

I would usually throw a joke or two here but this is gonna be real talk. Part of me wishes this would have gone to court, it would set a great precedent upon the silencing of critics and critique as a whole. It would have shown the ramifications to others to discourage not only people coming after Jim but any fucker that tries to pull this shit on smaller channels as well. I know Jims channel isn't exactly the biggest thing on youtube but there are a lot of smaller channels on youtube and if this shit was pulled on them would have no way to deal with it. That being said, im glad it ended where it did. It stops the emotional and financial stress on jim and lets him move past this with no impunity on his content. Law suits like these are usually designed to ruin the individuals it targets so I'm glad this torrent of shit is over and Jim can continue to do the work he does without putting any more uneeded stress on the situation. Thank god for you Jim, Truly.

James Yuichi Sato Dissmissal with prejudice does not mean that no similar case can be brought again. It means that Romine v Stanton for this particular case of alleged libel cannot ever be brought again.

I've read quite a few comments on the Jimquisition that basically said "I'd never heard of Jim until DH brought his name up in that ridiculous lawsuit", so yeah, DH was basically Jim's biggest PR agency for a while there.

You talked a lot about the buildup to this video and about what you would say, and I personally think you came to the best conclusion. It was the mature decision which in all honestly probably shows him up as much as possible, as through all the defamation he's thrown at you, you still remain more mature than can possibly be expected considering what he's put you through. I have so much respect for your decision to just let it go when you could have taken it further. Biggest nail in Romine's coffin for sure. Congratulations man, it's finally over.

Mana Caldaria He's an adult, so fuck him. The better reason not to pursue a counter claim is that Jim probably wouldn't see any benefit from it. He didn't have the cash to pay for an attorney and his "company" is gone.
