Part of the reason, I believe, is that the government wanted a bi-partisan group to investigate so as to reduce ability to deny based on partisanship. Just as one side will dismiss everything Mueller found, the other side will dismiss everything Durham finds. A special prosecutor investigating Trump would IMMEDIATELY be dismissed as a Democratic ploy to attack him.
