I really genuinely appreciate his integrity on this. He wouldn't even make a deal with Harvey as a silent partner on it because HE would know about it. I love that Kevin has decided to wait it out and do the RIGHT thing on this rather than do something that would help Harvey benefit in some way.

I hate he feels bad about the movies that human trashes attached to. If he don't condone it now...fair to say he wouldn't have then. It's not like he turned a blind eye to something despicable going on to get his movies made. He had no clue. By all means be passed and outrage, but at least in my mind kevin smith shares no blame so he shouldn't feel bad about being attached to that human stain.

@@jacobpowell2318 It's heartbreaking. He used to sing the Weinstein's praises on the commentary tracks for helping him get his films out, but then all the ugliness was revealed. I can't imagine the gut punch that must've been for him.

Ha, he has "integrity" now but not all the years he was getting signed deals to make movies through his company and even putting jokes in them about exactly what he knew was going on with the man, and all of Hollywood.

@@camerachris Can't blame him. People didn't come forward about Harvey until there was a bigger group to back everyone up. That's how it goes. It sucks, but it's reality. Speaking out about it was career suicide, until it wasn't. Can't make effective change when you have no resources. You can't make references to something you know is fucked up or call it out in your films when you don't have access to that platform any longer. He also wasn't the only one to do so. The references to Harvey's behavior came from multiple pieces of media, and added credibility to the victim's claims once they started pouring out.

Can’t. Judge James Burke was removed from the bench by NYC Mayor Adams’ chief of staff who is on the board that appoints the city’s judges. Apparently the chief of staff was close friends with Weinstein’s defense attorney and didn’t like the Judge’s behavior during the trial. I’m not familiar with NYC’s judicial system and don’t know if his old cases were transferred to another judge. Judge Burke was on the bench for 20 years before he was fired.

@@dr.floridamanphdThis is not correct. They 100% could do it. Judges do not 'own' a case, especially a settled case. They could file with the district, and a judge appointed to that district can make a ruling on the complaint related to denial of assets.
@dr.floridamanphd
@dr.floridamanphd 9 ай бұрын
@@0MohawkWarrior0 judges are assigned to cases and, unless otherwise removed from it, technically “own” the case pretty much in perpetuity. Now that Judge Burke has been removed, and Weinstein’s conviction on one charge is currently under appeal, and the other charge being under a motion to dismiss for being beyond the statute of limitations, it’s unclear who the next trial judge would be if one or both of those charges ends up being remanded for a new trial and would be the one enforcing Weinstein’s payments to his victims. But what do I know? I’m just that weird guy who makes friends with lawyers to learn about these things.

while that is correct, what Kevin means by "Harvey owns dogma" is not only does he own the film that was shot in 1998 but all other SQL and licensing rights. So Kevin can't even approach making a sequel until Harvey lets go of it. I buy a lot of movies. Been buying a lot of movies for over 20 years. One of the few times I can specifically remember buying a specific movie is Dogma. 2-disc special edition, because the one guy working at the Sam Goody at the mall was so eager to sell it to me that while I was looking at it he sidled up next to me and handed me a coupon all "hey, you were gonna use this, right?" To this day it's one of the dvds I'll likely never get rid of, even if I find a blu ray copy of it somewhere. Maybe if this situation ever gets cleared up and there's a nice 4k release that has all the same features, but it'd take nothing less than that for me to part with my copy.

Mirimax had such a amazing catalogue of great movies. I don't know if he had a producer / co-producer credit on all of them, or just an executive producer credit on ones they distributed, but it always taints my mood when put on an older movie that I love and see that logo at the start.

Dogma, I was just a bit too young to see when it came out. Thankfully when Jay & Silent Bob came out, I saw it as an advance screening so in a theater with fans. The Drive In had that playing after Clerks and Dogma after those two, so I did get to see it on the big screen. Inside my car, though the laughs were still heard.

Kevin Smith is such a legend and a great story teller. I think he and Sylvester Stallone have something in common here. Sylvester Stallone doesn't own Rocky because Producer Irwin Winkler bought the rights. Stallone is really pissed about it. Just like with Kevin he's in a situation where his pride and joy movie is not owned by a Studio but by an individual who won't give it up. Who are these jackasses and why is the industry still tolerating them?

You're right that they're similar in principle, but the difference is that the Rocky IP is still worth a fortune. They're still making movies that make hundreds of millions of dollars under the Rocky license. IF we assume that Stallone is offering fair market value for it, then maybe Smith's situation would be similar. Fair value would be a HUGE number because Rocky movies probably do well in streaming and will most likely be remade at some point in the future for potential billions in box office. So the Rocky IP is still staggeringly valuable and therefore a huge asset for Winkler, who is very near the end of his life. I'm sure he's plenty rich, but that license is a tremendous asset for his estate in terms of future earnings. He produced a lot of prestigious and lucrative films in his career, but those streaming residuals and redistribution payouts are small potatoes compared to Rocky's potential future. It's also a part of Winkler's legacy as a producer. The people that took a chance on that movie with Stallone as the lead ALL contributed to maybe the biggest underdog film of all time. Of course it's nowhere near as personal as it is to Stallone, but it's very meaningful to Winkler, too. Stallone is also an old man now and likewise thinking about his legacy and his family's financial future, but Winkler is in his nineties I think and despite a storied career he's most likely nowhere near Stallone in terms of wealth. That Rocky license could take care of his family for generations, and is rightfully his. I sympathize with Stallone's position. Of course it'd be great if he owned it, but that's the way the business works. He sold something to set himself up for a bright future in Hollywood, and that proved to be a worthwhile sacrifice. He became a colossal superstar on the back of that movie and made hundreds of millions of dollars. It was in no way a bad deal for him. Quite the contrary. What Winkler did is what producers do. They gamble on small films becoming big films, and the enormous successes are what earn them their reputations and money. Plenty of those gambles don't pay off and many lose money. He bought Rocky fair and square and was a big part of its initial success. Should he part with it now IF Stallone offered him a legit fair deal (which, again, would be HUGE money)? Sure, it would FEEL like the right thing to do, but his family would almost immediately lose a large chunk of that money in estate taxes. The most sound thing for his family to do financially is to wait until he passes before selling it, and maybe that's the plan. We have no way of knowing. What's going on with Dogma is entirely different in that way. Dogma earns no money as it is now. It's not available to stream for profit anywhere and is most likely not in current print for physical purchase. And if Smith bought it and made it available, it wouldn't be a huge earner for him. What he says about Weinstein is spot on -- he's holding the movie hostage just because he can. He has nothing to gain from it except whatever feeling he gets from saying no. I'd bet his beneficiaries will sell it when he dies, which shouldn't be long. Unless he puts something in his will that prevents it, which I wouldn't put past the prick.

I don't understand your annoyance. Someone buys something, be it a car, a house or music and film rights... once they buy it, it's theirs. Why should they sell it to anyone else? Buy a painting from a shop, it's yours. Later on, he artist becomes famous, and your painting is now worth millions. Does the shop have the right to claim it back? Just because you don't like the owner, if it's bought legally, it's tough luck.

@@another3997 Not the same thing at all. This is about copyright not ownership. To buy a franchise from under the creator and them do nothing with it is just a dick move. This is why The Fantastic Four had such trouble in movies because people were holding the rights with no intention of utilising them. It's like when supermarkets buy land just so no-one else can put a supermarket there. Or when a jealous Ex kills their former partner so no-one else can be with them. It's just controlling and spiteful. Why buy the rights to a movie and hold on to them when you're NEVER going to use them? Because you're a control freak. It's not even an Investment because No-one's making money on it.

Dogma will always be one of my favorites. I don't keep up with anything Hollywood, I could really care less what's behind the curtain. I am here to be entertained. Saying that, I had no idea about the prisoner owning the movie. I just remember wondering why I never saw it on TV listed and also why was it so hard to get a better quality copy beyond DVD. I later found out why. Thankfully, I found a great copy that wasn't way out of reach.
