I didn't realize what I would be watching. It caused serious flashbacks for me. I was almost strangled to death at 17 yrs old, and the only thing that saved me was the man with him convincing him to stop at the last possible moment. She went through total terror before she died. I'm glad that they got it on video so her husband was caught. What a sick bastard, bringing their child in there to see his dead/dying mother. That will haunt the poor child for the rest of his life.

Second degree was probably the correct decision, legally speaking. The forethought for first degree must occur before the act. He likely thought she was already dead during the time he sat with her. His defense could argue he didn't know what to do. There was zero proof that he had planned the attack in advance, but plenty that it happened in a fit of rage. Those texts are no different than hundreds of other texts from angry couples who don't go on to kill their significant other. What he did was horrible, and he should remain in prison for life, but you can't charge someone with something out of emotion.

I am in no way defending the murderer, but the intent has to come before the act. If he planned to kill her in advance, even for a moment, then it was first degree. If it was done with the intent to kill her in a fit of rage with no previous planning (as the video seemed to show), then it's second degree. The 40 ish minutes with her could easily be explained away by defense as shock or trying to figure out what to do once he already believed she was dead. They could also claim that since she wasn't dead prior to arrival at the hospital, that his intent was to get her help due to regret for his actions once the shock wore off. It's hard to convince juries of first degree when you have such compelling evidence of a rage killing. The key with first degree, is that you must have time to reflect upon your actions and still go through with the act of killing the person. They didn't have enough proof that couldn't be explained away, since the act of strangulation was done in a fit of rage. I was almost strangled to death at 17 yrs old, so I definitely am glad that this man will likely never be free again, anyway. He is in his late 40s and received 49 yrs. Even with good behavior, he will be extremely elderly when eligible to get out. I doubt he will outlive his sentence.

220 lb is not a healthy weight (assuming she was an average height), but you'd think she was more like 600 lb based on the way he said it. An otherwise healthy woman who weighs 220 lb is probably not just going to drop dead. There's going to be more to the story. He's a total idiot because even without the security footage, the autopsy would have showed that she was strangled. So her weight and drug use and whatever else he brought up was irrelevant. Did he really think they were going to say, "Well, you pointed out that she was 220 lb and did some drugs, so we're not even going to bother doing an autopsy; we'll just take your word for it?" 🤦♀

there's a good reason they have to try so hard to "advocate" for even the scummiest of clients: if they don't explore every possible angle of defense, it opens the door for a later appeal to have better chances of being successful. by ensuring that they leave no stone unturned, they effectively preclude the possibility of a later appeal being successful based on "ineffective counsel".

I found my mom's body when I was 15 after she committed suicide and it still haunts me to this day (I'm 33). This kid was even younger and it was own father so I can only imagine how much trauma he has now.
