Hi Prem The duration of L1b is 5 years max , when the guy got selected in H1b lottery in 4th year then how many years he can continue stay in USA with new H1B Please reply ,if someone knows the answer please share it across

Hi praveen bro This is your answer Say if the L1 guy stayed 4 years then H1B got approved, he can stay 2 years in H1B then it will max out Always L1+H1B is 6 years If the guy got I140 approved then he can extend H1B forever no max out issue then Its great question, we forgot to cover it Thanks for asking 🙏🙏

@@ramyamohan4419 Maximum years they can stay in US. L1 B eligible for 5 years (3 + 2 (have to apply for extension)) H1B eligible for 6 Years I think (3 + 3 (have to apply for extension)) L1 + H1B = 6 Years suppose you came US in L1B and got H1B one 4th year. Then H1B will be given for 2 years. If you not apply for I-140 then you have to go back to India

I came in L1B and now moved to H1B. Few item I would like add here 1. Chances of PERM process getting delayed for L1B will be high due to wage condition , so check with employer to initiate the green card process after 6 month of joining date 2. If you have stayed in L1B for five years and then moving H1B , you will be given only 1 year extension even though you have I-140 , and then next extension will come for three years

@@pauljoemampilly4682 when you move to H1B in the last year you will get 1 year of extension . My point was in general we have an assumption , if I-140 is there , we would be gettin 3 years extension , that’s not the case for the time when you move from L1 to H1 with I-140 approved on the 5 year

good info AP. though L1A EB1 is current, it still takes more than a year for 140 approval and same for AOS. so approximately 2 years buffer time to get a result after filing. even in concurrent cases. Unfortunately there is no way to expedite the process for RB1 category.

Hi Prem & Arthi, your information on L1 visa is helpful. I have one scenario. Got L1A visa for 2 year validity. First extension on Jun 2019 got rejected. By that time I got my I140 approved but unable to proceed for 485 as priority is not current then. Jun 2019 came back India and at 2020 my priority become current. If I come US at different visa(h1b or L1b) am I eligible for apply I485 with the same I-140 I got under L1A? Pls reply.

@Arthi Prem hi bro, I'm currently living in US (h4) visa and I'm applying for h1b lottery this year (through previous employer) and if my lottery gets picked up then should I need to travel to India for my visa stamping? And they are willing to apply for L1b visa as well, so that atleast one of it goes through and I can start working in US. In either of these visa options, do I need to travel to India for my visa stamping, or once the petition is approved I can start working from here? please clarify!

Hi, If you have all requirements meeting EB1C criteria, please set up a formal meeting with your supervisor and HR requesting EB1C. There’s a fat chance they might apply if you request formally and follow up every week. If they say NO, ask for the reason, to check if you can do something about it. As there is no other way to apply, this is the only way. Else try to get Canadian PR so that you can get your Canada citizenship in 3 yrs and then be back to US to work indefinitely without any restrictions.

Saw this little late @Arthi Prem.. I came to US in L1B (Blanket) Visa.. The main criteria for L1B is not just specialized knowledge but proprietary knowledge of the company they are working for.. That differentiates H1 from L1 and also makes it hard to get. I got my L1 in 2009 and at that time acceptance rate was just 5%.

If person comes in to us with L1 visa (A/B) through company X , then company Y cannot sponsor L1 visa for them. They can sponsor only H1B. Preliminary requirements is person should work in a company outside US for minimum 1 year before sponsoring L1 visa. If employer X sponsor H1 B to the employee who is already working in L1 visa for 4 years , then it would be considered as L to H1 conversion and can stay only for 2 years in H1B. So they can come into US after staying in home country for atleast 1 year.

Prem, myself and my wife working on different H1B visa . She got her i140 . I am in the 5th year and I just started gc processing which is in Initial stage . Hi Bro This is just my view and attorney will provide the perfect answer.. You can't hold H1B and H4 as well... Once you switched into H4 you need to give up your H1B visa and you should not work until you gets the H4 EAD...
