@E . A Heads up, Omnia uses they/them pronouns. It still does not justify the physical abuse Omnia had to go through because it had nothing to do with the problem of the physical abuse, that was just Kai deflecting real hard to discourage his victim of pressing charges by more or less saying "well, if you do anything, you'll be racist and the internet will tear you apart for it while i gloat". As Nawni (I think it was Nawni) mentioned, Kai was a big man, Omnia had no chance to really defend themselves- physical abuse is, sadly, usually the last strawn a victim can take after enduring so much emotional abuse, because once the abuser starts with physical abuse, it's only up from there. There was no projection here, it was clear Kai was trying to silence Omnia because he knew he fucked up big time and knew that Omnia could continue their life without him in the picture- and abusers HATE that, they hate not being the center of their victim's life, so he cut their income so Omnia would grovel back to him and depend on him, he stole their stuff because they had 'lost the privilege to own it' (abusers will give gifts to the victims to hold it over their heads later, not as an act of kindness) and continue to bring out stuff to shame and ridicule Omnia while also invalidating (maliciously addressing them with the incorrect pronouns) them.

Once something is given as a gift, it no longer belongs to the gifter. If Omnia decides to, they can take Kai to civil court for either the return of the item and/or financial equivalent of the items. A lawyer would be obliged to take the case, but it would be a speedy trial for Omnia or for the prosecution in a criminal case

Yes, he paid for those items. BUT if you give those items as a gift to someone, that gift does not belong to you anymore. Omnia asked for those things, which he agreed to. In the screenshots he posted, he willingly bought those things for Omnia with no written agreement in those screenshots that they had to pay him back for it. They DID NOT agree to a conditional gift or an IOU gift. He bought and gifted those items to Omnia, which makes it legally theirs. I'm glad he posted those screenshots because now it's known that he stole them from his ex, probably as an act of retaliation. That's illegal, along with the assault ;) EDIT: He "took back" the CAT FOOD?! Yikes- that's how you know it was a revengeful act! Ermergerd the Sargon lawsuit doesn’t “set the limits on copyright law...” ... it’s an illustration of how a single low-level court decides a copyright issue. John Swan also got this WAY WRONG in his video when he called it “precedent.” The Sargon opinion came from a federal trial court in New York. Federal trial court opinions aren’t mandatory “precedent” anywhere - not even in their own federal judicial district! SDNY’s holding re: copyright does not necessarily impact holdings on identical cases in a federal trial court anywhere else - including California, where I’m sure a lot of KZbin-related suits arise. In the federal context, only the Supreme Court and the circuit courts of appeals create mandatory precedent - and the circuit courts’ precedent is only mandatory within the geographical limits of that circuit. For the 2nd Circuit, which is the federal appellate court to which the Sargon case could’ve been appealed (but was not) this means that its opinions on federal law (incl. copyright) only necessarily apply in three states: New York and two other tiny states, maybe Connecticut and Rhode Island. Not the entire country....!!!!! I will say that the Sargon opinion seems to conform with the copyright law in the federal circuit I’m familiar with (9th) in that extremely minor alterations - like Sargon adding a title and cropping/assembling the clips - are typically considered “transformative” and this support fair use. I just have a big issue with people with platforms (not you, I’m looking at John Swan) misrepresent the legal system in a way that perpetuates fundamental misunderstandings.... like it seems like people see a single legal case and think it applies EVERYWHERE. And I think this is fundamentally harmful, particularly when the case is actually decided in a state court (not the issue here)

So I'll stand by what I said -- that case does not represent the "limit" of copyright law, both for jurisdictional reasons and because I know there are "closer" cases than that. And as for no single factor being determinative -- yes, courts must weigh each statutory factor as part of the analysis. However, it's totally possible for one factor to be determinative at the end of that analysis. 3/4 factors could be a wash or weigh slightly against fair use, but the court could still decide that 1 of those factors (usually #4) weighs so heavily in favor of FU that they determine the use is fair. No single factor being determinative means that the court has to walk through all four factors (so they can't look at the case and decide based on a single factor without walking through the whole analysis)

No, Kai, you cannot just take things from people because you're the one who gave them the items. When an item is given as a gift, it becomes the property of the person it is gifted to unless it is a conditional gift, but even if it is a conditional gift, the conditions must be clearly stated and agreed to as well as probably written seeing as no judge is going to just take you for your word. Even then, I HIGHLY doubt you went to Omnia and said "You can have these glasses as long as we remain in a relationship."
