There are times where getting a conviction no matter how justified would be difficult at best and mostly counterproductive. A mother protecting her child when no one got hurt would probably be one of those situations. Also you can only fit so much on to an hour of television.

It's hard to watch this show sometimes when you practice law. For instance him being charged on that lineup alone is unrealistic and would never be admissible. There's not only a fresh head wound separating him from the rest of the lineup but it's a high profile case and he was filmed being taken from his home so his image wouldve been everywhere before the ID was made. Still love the suspense and the plot twists. One of my favorite shows of all time.

@@timothyhannon4078 no but you'd have to compile a lineup of that has at least 2-3 people with fresh, visible wounds to even allow the initial ID to stick. Any lawyer could get it thrown out on that alone. Then you'd have to deal with the fact of him being televised causing reasonable doubt in the authenticity of the identification just to even maybe use that in your prosecution.
@FinalLugiaGuardian
@FinalLugiaGuardian 2 жыл бұрын
I agree. Such a lineup would probably be more prejudicial than probative. You can't have one specific individual substantially stick out from the other five individuals. This is also why courts won't allow lineup evidence in in which the suspect was identified by being the lone black guy out of a group of five other white guys.

@RLucas3000 yes. It's absence can make for more captivating storytelling. However, storytelling often ventures off the reality path for the sake of itself. This show attempts a realistic look at the process, so often the conclusions have the simplest thru lines. To make the 2nd act more engaging, they will sprinkle in aspects that could complicate the story. Most of the time, those things are shown to be just that, bc showing a wife murdered=the husband did it-story over(which is most often the case in reality) usually isn't the best way to draw viewers in and hold their attn. Therefore many artists try to avoid ockhams razor in storytelling at least on the surface. Your suggestions ARE noted!😊

I don’t know how I feel about the mother. Like, one might not like her reaction to if her son were actually gay, but the way she reacts when the gavel confirms his guilty verdict-she almost looks exactly like my mother and the timbre of her voice is pretty similar. And given the twist of this episode that Cedric didn’t have quite as much to do with it, it breaks my heart to see the character of the mother just cave into tears, the rush of fear that suddenly comes over you when you have to accept that you’ll now lose time with someone you care about, especially because we as the audience end up getting more context only after the trial. The short wail and the camera changing to show her distraught face was a punch in the gut, cuz (from the perspective of this character) it’s like she feels bad and perhaps guilty that her testimony is what landed her son a guilty verdict. A good mother wants nothing but the best for her child, to give them the best life possible, so for her the despair that washes over when she realizes her testimony essentially ripped away her son’s life; just imagine the guilt you’d feel if you were in her shoes and gave the testimony that the prosecution used to lock up your sibling/cousin/parent/friend/guardian/significant other. You’d probably feel some level of guilt even if it was completely out of your control, but it wouldn’t change how distraught you’d become. Regardless of one’s personal values, the pain of being separated from a dear friend/family member/loved one is a fear that any of us could know, so even though the actress played such a small role (especially given all the episodes of Law Order that exist), for a one off character she played a pretty impactful part imo.

Ooh, so the twist here is the homophobe didn't do the crime! ...or is it?
@aaronburgin1442
@aaronburgin1442 3 жыл бұрын
Oh no, he definitely did it. The twist was that he got the Innocence Project to find evidence that initially got the jury verdict set aside, but then Cutter found evidence that the Project's interns bribed a key defense witness, prompting the director to throw the ultimate curveball - that Cutter didn't have his law license because he technically didn't have a bachelor's degree. McCoy urged Cutter to offer a deal, during which the bad guy called Connie a "sp*c," which prompted Cutter to withdraw the manslaughter deal and gave him an ultimatum that he take a 25-year sentence or he would resign his post to testify to the hate speech he spewed in the conference and that he would then walk the case over to the US Attorney's office, where they could try - and likely convict him of hate crimes under the Matthew Shepard Act. The homophobe took the 25-year sentence. Cutter was ultimately reprimanded by the Bar, but kept his license.

SPOILERS So this whole "Did the husband do it, or was it an actual hate crime" is a diversion. The real plot comes in with the innocence coalition, and Cutter's former mentor. He challenges a drug dealer's testimony, one acquired by the coalition, when he learns that the meeting between them happened at a bar over drinks. Cutter's mentor keeps sidewinding with more threats, and even goes after Cutter's license. McCoy offers a bargain between the Coalition and the DA to reduce the sentencing to 20 years, in exchange for the actual truths behind her threats. In prison, during the plea bargain, Cutter offers the defendant 20 years and manslaughter 1. However, despite the generosity of the bargain, the defendant verbally attacks several different ethnicities and sexualities. Cutter is infuriated by his threating speech, and raises the sentencing bargain to 25 years. Cutter ends up reprimanded by the bar overseers, but able to retain his license. Turns out that Cutter had done all the work for being an undergraduate, but some of it was never recorded. His mentor told him it was a technicality, and he proceeded with the further stages of obtaining his license to practice law. None of his prior convictions were put into question, and he would continue his practice. *Was the drug dealer lying?* We don't know, but it's assumed by the defendant's outburst and attitude that the dealer was skewing the truth.

Why would the mentor choose to get involved in a case if Cutter had moved on and the credit she received for his work wasn’t being questioned?
@vynthiswechseln3868
@vynthiswechseln3868 3 жыл бұрын
@@sarcasticallyrearranged The Mentor was the "Big Cheese" of the Innocence Coalition. Her students would be praised, and rewarded, for work in cases that resulted in their victories. She didn't actively tell them, or encourage, her students to bribe or seek fake testimony but a drug dealer was given a couple drinks during a meeting and some cab fare to get home. As for why she attacked his law-degree, its unclear but I assume it is out of spite for the "attack" on her student's credibility.

@@samcaraballo6218 that's not true. Linus Roach gives a master class in acting in the near final scene. It seems Cutter's old mentor knew he'd completed the work for his Bachelor's, but never got his degree. The Innocence Project initially gets Cedric off, until Cutter finds out one of their witnesses' testimony was suspect. The mentor goes after Cutter's license, forcing an offer of 20 to life. Which Cutter is forced by Jack to accept, until Cedric calls Connie a "spic." After which Cutter loses his mind, telling his mentor to take his license so that not only can Cutter testify about Cedric's hate speech, he can then have Cedric prosecuted under the Matthew Shephard Act, which meant back-to-back life sentences. "You will die in jail" he tells Cedric, who tries to accept the original deal. "It's 25 or nothing", Cutter literally snarls. After being assured by the mentor that what Cutter says is true, Cedric says, "that guy's nuts, you know that?" And the mentor replies, "I know."

Watching Law and Order court scenes is exhausting on the mind because of how messed up it is sometimes. But i love how it shows the expression or body language used. For instance, the mother is all smiley in hopes to be appear more kinder so people would view her as kind and not part of the fiasco. Personally, in a court room especially for a homicide case, i don't think someone would have the mental stability to genuinely smile, her smiley smile is short lived or to me seem a bit awkward. Hence concluding that... even though she may not be the killer, she is somewhat responsible for the horror.

Loved how they point out the double-standard cis-het men have when it comes to homosexuality. If you pay close attention to many tv shows not specifically geared towards queer people, they always try to claim representation with a wlw couple, which don't get me wrong is definitely representation, but there is always hesitation or outright refusal to include a main mlm couple.

extremely hard to take the IP woman seriously in this case--maybe the husband just had a boyfriend before all this, not shocking he would go to him for comfort or normalcy after the murder. maybe he was THEIR boyfriend. you're statistically more likely to find poly arrangements amongst queer people than cishet people.

I don't remember seeing this episode., jus this KZbin Video Clip. The Plot of this reminds me of an Epiosde I saw recently on Reruns of The Closer which is set in LA. In that episode, a Gay Man is Murdered and his lover who claims he was there at the time of the attack, blames a Gay Basher that the Lover, I believe the Husband claims he was not able to get a good look at. It turned out that his lover- his Husband was planning to leave him for a Younger Man after several years of Marriage and the Husband killed his LOver- His Husband for trying to leave him. Sound like a Similiar Plot.
